ORDINANCE N0. 1344
AN ORDINANCE AMENDING THE LEGAL DESCRIPTION OF ORDINANCE N0. 1235,
AN ORDINANCE ANNEgING CERTAIN TERRITORY TO THE CITY OF CANTON,
FULTON COUNTY, ILLINOIS. (BAR-MAC SUBDIVISION)
WHEREAS, a petition was filed with the City Clerk for the
annexation of the real property described below, and said real
property is not within the corporate limits of any municipality,
but is contiguous to the City of Canton, Illinois, said real
property being apart of the Copperas Creek Fire Protection
District but not being a part of any public district,
Outlot "C" as shown on the attached map being legally
described as follows:
A LOT LOCATED IN THE i~1EST HALF OF THE SOUTH HALF OF THE
NORTHEAST QUARTER OF SECTION NUMBER FIFTEEN (15) IN TOWNSHIP
SEVEN (7) NORTH, RANGE FOUR (4) EAST OF THE FOURTH PRINCIPAL
MERIDIAN, FULTON COUNTY, ILLINOIS, DESCRIBED AS FOLLOWS:
Beginning at a point 652.5 feet East and 968 feet South of a
stone near the Northwest corner of the South Half of the
Northeast Quarter of said Section #15, thence West 150 feet,
thence South 269 feet, thence Southeasterly 170 feet, and
thence North 357.5 feet to the place of beginning,
containing one hundred and seven one-hundredths acres, more
or less. EXCEPTING:
Beginning at a point 652.5 feet East and 968 feet South of a
stone near the Northwest corner of the South Half of the
Northeast Quarter of said Section #15; thence West 150 feet;
thence South 145 feet 2 1/2 inches; thence East 150 feet;
thence North 145 feet 2 1/2 inches to the place of
beginning, containing one-half acre, situated in the County
of Fulton and State of Illinois.
WHEREAS, proper notice of the filing of the petition for
annexation was given to the Trustees of Copperas Creek Fire
Protection District and notice has been made and filed with the
Fulton County Recorder of Deeds,
WHEREAS, a public hearing on said petition was conducted by
the Planning and Zoning Commission of the City of Canton on March
13, 1989 pursuant to proper notice having been published in the
Canton Daily Ledger,
WHEREAS, on March 13, 1989 the Planning & Zoning Commission
recommended to the City Council that the real property described
in the exhibit attached hereto be annexed to the City of Canton
pursuant to Chapter 24 of the Illinois Revised Statutes,
WHEREAS, it is in the best interests of the City of Canton,
Illinois that said real property be annexed to the City of Canton.
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CANTON, ILLINOIS:
1. That the City Council finds as facts the assertions set
forth above.
2. That the described real property be and is hereby
annexed to the City of Canton, Illinois.
3. That the described real property be and is hereby
rezoned R-2 Residential.
4. That the Zoning Administrator is directed to make the
appropriate changes to the zoning maps of the City of Canton to
show this annexation and zoning.
5. That the City Clerk is directed to record with the
Recorder of Deeds of Fulton County and to file with the County
Clerk of Fulton County a certified copy of this ordinance together
with an accurate map of the annexed territory.
6. That this ordinance shall be in full force and effect
upon its passage by the City Council of the City of Canton and
approval by its Mayor.
PASSED by the City Council of the City of Canton, Fulton
County, Illinois at a regular meeting this 7th day of April, 1992
