AN ORDINANCE CREATING FUND 017(ARTICLE 36 SEIZURES) AND FUND 018
(DISPOSITION OF PROPERTY) AND AMENDING THE FY 2008-2009 BUDGET TO
REFLECT THE SAME
WHEREAS, Article 36 of the Criminal Code of the State of Illinois allows law
enforcement agencies to seize a vehicle and cause said vehicles to be forfeited pursuant to the
process outlined by statute;
WHEREAS, when vehicles are seized and sold pursuant to statute, the revenue generated
from the sale needs to be deposited into a segregated account;
WHEREAS, 765 ILCS 1030 et. seq., allows, under the Law Enforcement Disposition of
Property Act, that has been abandoned, lost or otherwise illegally possessed to be disposed of
pursuant to the process outlined in the statute; and
WHEREAS, when property is disposed of pursuant to statute, the revenue generated
from the sale needs to be deposited into a segregated account; and
WHEREAS, on April 14, 2008, the City Council of the City of Canton adopted
Ordinance 1928 adopting the FY 2008-2008 budget for the City of Canton; and
WHEREAS, the budget adopted on April 14, 2008 does not provide line items where
revenue from Article 36 seizures nor from the Law Enforcement Disposition of Property Act can
be deposited; and
WHEREAS, Section 5/8-2-9.7 of the Illinois Municipal Code (65 ILCS 5/8-2-9.7)
allows, by a vote oftwo-thirds of the members of the corporate authorities then holding office,
the annual budget for the municipality may be revised by deleting, adding to, changing or
creating sub-classes within object classes and object classes themselves; and
WHEREAS, the Public Safety Committee has determined that it is necessary and in the
best interests of the citizens of Canton, Illinois to amend the FY 2008-2009 budget to create
Fund 017 (Article 36 Seizures) and Fund 018(Disposition of Property) and amend the budget to
reflect the creation of said classes; and
WHEREAS, the City Council has made a similar determination.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CANTON, Fulton County, Illinois, as follows:
1. That Fund 017(Article 36 Seizures) be created and that funds from any seized
auto pursuant to the statute be deposited into said fund.
2. That Fund 018 (Disposition of Property) be created and that funds from the
sale of lost, abandoned or otherwise illegally possessed property be deposited
into said fund.

regular meeting this 21st day of Oc oh r , 2008 upon a roll call vote as follows:
AYES: Aldermen Strandberg, IT-n~.es, Nidiffer, West, Sarff, Berardi, Schenck.
NAYS: None.
ABSENT: Alderman. Lewis .
