PLEDGE OF ALLEGIANCE OPENED THE MEETING, FOLLOWED BY THE INVOCATION GIVEN BY CITY CLERK NANCY WHITES. Mayor Edwards asked for roll call at 6:30 P.M. Present: Aldermen Kovachevich, Hammond, Savill , Sarff, Grant, Carl , Larsen, Horr. Absent: None. MINUTES OF AUGUST 17TH MEETING. Motion by Alderman Savill , second by Alder- man Horr the minutes of August 17th meeting be accepted and placed on file. Voice vote, motion carried. MINUTES OF AUGUST 25TH SPECIAL MEETING. Motion by Alderman Grant, second by Alderman Sarff, the minutes of August 25th special meeting be accepted and placed on file. Voice vote, motion carried. PUBLIC HEARING CONCERNING THE PROPOSED TAX LEVY - 7:00 P.M. Adjourned the regular meeting for a public hearing. Mrs. Iva Ludlum 73 North 3rd Avenue objected to the proposed tax rate listed in the paper. We can't afford to pay the taxes now she stated. Mayor Edwards related to Mrs. Ludlum that if she could come in and talk to the city treasurer or city clerk they would help her understand it better, as it is some what misleading. He reported that the advertisement read that it's 25% over the extension of taxes for last year. The extension is what we actually collected. They (state) make us compare tax levy with what we collect. A letter was read from John Barclay 142 N. Second Avenue, it reads as follows: I have been informed that practically all of this increase is state mandated, and that there is no increase in the city's operating budget over last year. Ordinarily, this would have been acceptable, but, in view of this diminished economy, with unemployment at its present level , it would seem that there should be an effort to cut back on all spending, in order to reduce the amount of taxes needed, to meet the budget. As a concerned taxpayer, like many others on reduced incomes, we find it most difficult to contend with any further ins creases in taxes, state mandated or not. Therefore I wish to go on record as being against this increase. John Barclay. The regular meeting of council reconvened at 7:04 P.M. COMMITTEE REPAORTS: Public Safety & Traffic. Council Action Motion by Alderman Horr, second by Alderman Larsen removing parking on third avenue for Howard Place to Locust Street be referred to Legal & Ordinance Com- mittee. Voice vote, motion carried. Informational : Petitions were given to the city clerk concerning the need to install stop signs at the corner of South Tst avenue & E. Oak Street. Petition being #533. This is to be discussed at the next Public Safety meeting. Street & Garbage. Council Action None. Lake, Buildings and Grounds. Council Action None. Informational : Ray Hartle maintenance supt. reported that the wiring in the city attorney's office is in bad shape. Ray will take this to the committee. 299 CONTINUED SEPTEMBER 7TH, 1982 Public Works, Water & Sewer. Council Action None. COMMUNICATIONS FROM CLIFF SAGASER - CITY ENGINEER. Janitorial bids were discussed, and the city received 18 bids. Some bidders were not recommended by the police department. Motion by Alderman Carl , second by Alderman Kova- chevich, the janitorial bids be referred to the Finance Committee and the committee be given the authority to hire. Voice vote, motion carried. Smoking on the sewer project has been finished for awhile. Can't proceed till the tv crews come back in October. The tv crew can't complete their job in its entirety until we clean the Vine Street sewer. It will take three men full - time to clean the sewer. Cliff wants to hire two people on a temporary basis, and will use the assistant under Cliff O'Brien. Mayor Edwards wants the sewer cleaned in its entirety. Problem referred to Negotiations, Personnel Committee. The square will have prime put on it tomorrow. Overlay will be done the next day. Cliff complimented Peoria Asphalt on the performance of their work. Q Q Hud work will commence on September 13th, they will begin on 11th avenue. Alderman Sarff brought up the problem that two of the streets in his ward that had had rejuvenator applied to them has caused problems for the citizens. He has received numerous complaints, and so had Cliff Sagaser City Engineer. Cliff mentioned that the streets won't show a benefit from this until next spring. COMMUNICATIONS FROM MAYOR EDWARDS. Motion by Alderman Grant, second by Alderman Sarff, the appointment of Aleta Passini 165 E. Birch to the Betterment Commission, she is Alderman Sarff's appointment, be confirmed. Voice vote, motion carried. FULTON SQUARE MERCHANTS. Gary Roudebush representative of the Fulton Square Mall , spoke for some of the merchants about vandalism, litter, broken beer bottles, urinating on walls, lights broken, volcano rock thrown against the doors. He was asking that the utilization of the parking lot be diminished. Spurgeon's manager and the Penney's manager spoke about the problems and would greatly appreciate anything the council could do. The merchants felt that the ch}efof police was doing a good job, they didn 't want their complaints to seem like they were against him. Bob Molleck Chief of Police related that they don't have the manpower to police the area at nilght.He checked out license plates and 40% of them are from surround- ing communities. Motion by Alderman Sarff, second by Alderman Kovachevich, to give the chief of police permission to close Fulton Square parking lot after the business' s close for the night, except under special permission and also Jones Park. The city attorney reported that he has some answers. Jim said that you have no authority to clear anyone off of the lot. You have to pass an ordinance putting a curfew on it, and that is Jim's recommendation. Most of the problems the council has, have already been addressed by some sort of ordinance or state statutes which can be enforced on a one on one situation. The city attorney recommends you take the problems to the Legal & Ordinance Committee. Mayor Edwards asked the chief of police for some help in patrolling the Fulton Square lot until and ordinance can be passed. Motion and second withdrawn. Motion by Alderman Sarff, second by Alderman Kovachevich, this matter be referred to the Legal & Ordinance Committee and the chief of police to contact the city attorney and draft an ordinance. Discussion. Larry Dutton has )postdd "no trepassing signs" at the E. side treatment plant and wanted to know if that's legal . City attorney assured him it was. Voice vote, motion carried. OLD BUSINESS: ORDINANCE - DIRECTING THE ACQUISITTON OF CERTAIN REAL PROPERTY. Second reading, 300 CONTINUED. SEPTEMBER 7TH, 1982 read by title. An amendment has been made to this ordinance according to Jim Malm- gren City Attorney. The amendment is on page 11 . All of section five has been amended. NEW BUSINESS: RESOLUTION - REQUESTING PERMISSION OF IDOT TO CLOSE ILLINOIS ROUTE 9 & 78 ON LOCUST STREET AT 1ST AVENUE ON OCTOBER 29TH FROM 3:30 P.M. to 4:30 P.M. Eirst_. reading, read by title. ORDINANCE - ADOPTING REGULATIONS FOR THE CONSTRUCTION, SUBSTANTIAL IMPROVEMENT, SUBDIVISION OF LAND PLACEMENT OF MOBILE HOMES OR OTHER DEVELOPMENT IN RELATION TO FLOOD HAZARD AREAS. First reading, read by title. This ordinance was brought to the mayor by the Western Illinois Regional Council . ORDINANCE - APPROVING A CONTRACT FOR SALE OF LAND FOR PRIVATE DEVELOPMENT. First reading, read in its entirety. Motion by Alderman Carl , second by Alder- man Hammond, on page 3 the amount of $31 ,800.00 be inserted and also the following on page 3 second paragraph-Nor, shall Bar-V-Enterprise convey any interest.tin 301 CONTINUED SEPTEMBER 7TH, 1982 said premises to any tax exempt entity within the meaning of Chapter 120, Illinois Revised Statutes. Voice vote, motion carried. Motion by Alderman Carl , second by Alderman Larsen on page 9 the amount of $2,000.00 and the words per annum be added. Voice vote, motion carried. Discussion. The sum of $31 ,800.00 Bar-V-Enterprise will pay to the City of Canton if they sell or transfer the property in 5 years. The amount of $2,000.00 is the real ' estate taxes which would guarantee to us, would be paid. A sum below which Bar-V-Enterprise would agree not to protest the taxes. Alderman Carl asked if it prohibits the sale in 5 years to a non-taxing body? Jim assured hin. ii-t didn't, and inserted the paragraph "Nor, shall Bar-V-Enterprise."
