ORDINANCE NO. 1390
AN ORDINANCE GRANTING A SPECIAL. USE PERMIT TO JOHN AND MARSHA
BERRY TO USE A SUBSECTION OF PROPERTY AS A PART-TIME BEAUTY
SALON AT 833 NORTH 8TH AVENUE, CANTON, ILLINOIS.
WHEREAS, a Petition for Special Use Permit signed by John
and Marsha Berry, the owners of the real property hereinafter
described, was filed before the Planning and Zoning Commission
of the City of Canton, Illinois, requesting that a special use
permit be granted to carry on a home occupation for the purpose
of a part-time Beauty Salon; and
WHEREAS, the real property which is the subject of this
petition is located at 833 North 8th Avenue, Canton, Illinois,
and is legally described as follows:
Lot Number Twenty-Nine (29) in Prospect Heights
Subdivision of the N.W. Quarter of Section
Number Twenty-Six (26) in Township 7 North,
Range 4 East of the Fourth Principal Meridian,
situated in the City of Canton, State of Illinois;
and
WHEREAS, John and Marsha Berry are the owners of record
of said real property and there are no other owners of record;
and
WHEREAS, said real property is wholly situated within the
corporate limits of the City of Canton, Illinois and is presently
zoned R-2, single-family residential district; and
WHEREAS, all petitions, documents and other necessary legal
requirements are in full compliance with the statutes of the
State of Illinois and ordinances of the City of Canton, Illinois;
and
WHEREAS, a public hearing was held before the Planning
and Zoning Commission of the City of Canton, Illinois on March
15, 1993, pursuant to proper notice published in the Canton
Daily Ledger; and
WHEREAS, no objectors appeared at said public hearing before
the Planning and Zoning Commission of the City of Canton,
Illinois; and
WHEREAS, on March 15, 1993, the Planning and Zoning
Commission of the City of Canton, Illinois unanimously recommended
to the City Council of the City of Canton, Illinois that a special
use permit be granted to John and Marsha Berry to carry on a
home occupation for the purpose of a Beauty Salon; and
WHEREAS, it is in the best interest of the City of Canton,
Illinois that said special use permit be granted.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CANTON, FULTON COUNTY, ILLINOIS, AS FOLLOWS:
1. That the City Council finds as facts the recitals
hereinabove set forth.
2. That a special use permit be, and the same is hereby,
issued to John and Marsha Berry to carry on a home occupation
for the purpose of having a beauty salon at 833 North 8th Avenue,
Canton, Illinois, which real property is legally described as
follows:
Lot Number Twenty-Nine (29) in Prospect Heights
Subdivision of the N.W. Quarter of Section
Number Twenty-Six (26) in Township 7 North,
Range 4 East of the Fourth Principal Meridian,
situated in the City of Canton, State of
Illinois; and
said home occupation shall be carried on exclusively by the
inhabitants of the dwelling on the above described real property.
3. That this special use permit shall be personal to John
and Marsha Berry at the above stated address only. Any cessation
of such use by John and Marsha Berry at said address shall
automatically terminate this special use permit. This special
use permit is not transferable by John and Marsha Berry and
shall not be valid at any other address.
4. That the records of the City of Canton, Illinois,
appropriate documents, maps and related regulations be, and
the same are hereby, amended to reflect the foregoing special
use permit.

5. That this ordinance shall be in full force and effect
upon its passage by the City Council of the City of Canton,
Illinois and approval by the Mayor thereof.
PASSED by a majority vote of the City Council of the City
of Canton, Fulton County, Illinois and APPROVED by the Mayor
thereof at a regular meeting of the City Council on the
16th day of _ March 1993, upon a roll call vote as
follows:
AYE S• Aldermen Molleck, Coay, Sarff, Bohler, Meade, Chapman, May.
NAYS : None.
ABSENT : Alderman Steck.
