Box 478 Canton, IL 61520 RETURN T0: City of Canton 2 North Main Street Canton, IL 61520 ORDINANCE NO. 19 4 6 An Ordinance re-zoning certain property of Jerry C. Hand and Doris E. Hand, in a B-2 zoning configuration. WHEREAS, the property described on Exhibit A, which is attached hereto and made a part hereof by reference ("Hand Property', is located within the corporate limits of the City of Canton, Fulton County, Illinois; and WHEREAS, the Hand Property is currently zoned R-2, single family, under the Canton City Code; and WHEREAS, Jerry C. Hand and Doris E. Hand are the owners of the Hand Property and have petitioned the City Council of the City of Canton, Illinois that the property be re-zoned to a B-2 zoning configuration in order to accommodate the expansion of the property and the ongoing use of the property as a used car sales facility; and MSW-REAL ESTATE Hand Rezoning Ordinance Sb9.9.08G E B. REV.9.9.08 R EV.9.25.08 1 WHEREAS, the surrounding neighborhood consists primarily of commercial uses and the re-zoning of the Hand Properly would be consistent with the commercial uses in this area; and WHEREAS, the Hand Property has been used as a commercial property, namely a used car sales facility, for at least 36 years and, prior to that time, was used as a commercial facility as well and the Hand Property is a legal non-conforming use and has been a legal non-conforming use for a long period of time in a commercial use configuration; and WHEREAS, on September 8, 2008, the Planning & Zoning Commission of the City of Canton met, pursuant to notice as required by law, and held a public hearing concerning the Petitioners' request to re-zone the Hand Property in a B-2 zoning configuration and at said meeting, there were no objectors present, either in person or by petition, who voiced objection to the allowance of B-2 use on the Hand Property and after said public hearing, the Planning & Zoning Commission unanimously recommended to the City Council of the City of Canton, Illinois, the re-zoning of the Hand Property to a B-2 zoning configuration; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, ILLINOIS, A MUNICIPAL CORPORATION: 1. That the Hand Property, as described on Exhibit A, shall be and the same is hereby re-zoned to a B-2 zoning configuration. 2 MSW-REAL ESTATE Hand Rezoning Ordinance sb9.9.08G EB. That the corporate authorities of the City of Canton, Illinois, and their respective officers and agents shall be and they are hereby authorized to amend the zoning maps of the City of Canton, Illinois, to so reflect the re-zoning of the Hand Property to a B-2 zoning configuration. 3. That a copy of this Ordinance shall be filed with the appropriate authorities of the County of Fulton and State of Illinois, by the City of Canton, to reflect the re-zoning of the Hand Property, all as made and provided for by law. 4. That the Mayor of the City of Canton, Illinois, shall be and he is hereby authorized to affix his signature as the Mayor of said City to this Ordinance and the City Clerk of the City of Canton, Illinois, shall be and she is hereby authorized to attest such signature thereto.
