May 6th, 1980
A regular meeting of the Canton City Council was held on May 6th, 1980
in Council Chambers.
PLEDGE OF ALLEGIANCE OPENED THE MEETING FOLLOWED BY THE INVOCATION GIVEN
BY MAYOR CROUCH.

Mayor Crouch asked for roll call at 6:30 P.M. Present: Aldermen Kovachevich,
Mazza, Carl , Grant, Horr, Clarke, Danner, Motsinger, Churchill . Absent:
Aldermen Williams, Selfridge.
MINUTES OF APRIL 15TH, MEETING. Motion by Alderman Danner, second by Alder-
man Motsinger the minutes of April 15th meeting be accepted and placed on
file. Voice vote, motion carried.
MINUTES OF APRIL 22ND SPECIAL MEETING. Motion by Alderman Churchill , second
by Alderman Kovachevich the minutes of April 22nd meeting be accepted and
placed on file. Voice vote, motion carried.
MINUTES OF APRIL 29TH SPECIAL MEETING. Motion by Alderman Motsinger, second
Q by Alderman Grant the minutes of April 29th meeting be accepted and pliaced on
Q file. Voice vote, motion carried.
CONSOLIDATION OF ELECTIONS - MARGE EASLEY COUNTY CLERK. According to our
State Legislators the consolidation of elections are suppose to be much more
efficient, much less costly, and will develop a greater voter turnout. The
County will be taking over the cost of all elections, there will be a .3� tax
levy to pay for this.

Council Action.
Motion by Alderman Kovachevich, second by Alderman Williams that a resolution
be drafted to provide street lighting for Westwood Estates and Fairview Heights.
Voice vote, motion carried. V
Motion by Alderman Kovachevich, second by Alderman Williams , the first Tuesday
in November, the four parking spaces in front of the Gar Hall , between the
Fire Station and the entrance to the old Illinois Bell Telephone Building be
reserved for the purpose of voters. Voice vote, motion carried.
Recommend to the Legal & Ordinance Committee to clean up the wording in the
truck route ordinance.
MAYOR'S REPORT. Re-appointment of the Department Heads. Gordon Braun Director
of Public Works, Ray McKinney Supt, of Water Department, John Scarbrough Supt.
of Wastewater Treatment Plant, Don Story Chief of Police, James Grier Chief of
Fire, James Boyd Supt, of Street, Ray Hartle Maintenance Supt. Motion by
Alderman Carl , second by Alderman Motsinger, the appointments be confirmed.
Voice vote, motion carried.
Appointments to the Fire Code of Appeals. Carl Barthelemy Sr. , Robert Fouts,
C.A. Luft, Garvin Pusey, Bob Betzer. Motion by Alderman Danner, second by

carried.
Re-Appointment to the Zoning Board of Appeals, Jim ,Lloyd. Motion
by Alderman Mazza, second by Alderman Carl the appointment be con-
firmed. Voice vote, motion carried.
Appointments that need to be made by Alderman Kovachevich, Mazza, Mot-
singer, Carl , Horr, Clarke, to the Betterment Commission.
Re-Appointment to the Cemetary Board, Harold Wilson, Bruce Beal . Motion
by Alderman Grant, second by Alderman Clarke, the appointments be confirmed.
Voice vote, motion carried.
Re-Appointment to the Drug Abuse Council . Dr. Dennis Reter, Tom Wallace,
Tom Homer, Rev. Robert Crawford, Dr. Ben White, Phillip Murphy, Tom Wood,
Don Story, John O'Connell a student. Motion by Alderman Motsinger, second
by Alderman Mazza, the appointments be confirmed. Voice vote, motion carried.
Re-Appointment to the Fire &Police Commission, Dr. Harold Iwashita. Motion
by Alderman Danner, second by Alderman Churchill the appointment be confir-
med. Voice vote, motion carried.
Re-Appointment to the Library Committee, C.R.Danny Moore, Albert Millington,
George Hocker, Motion by Alderman Motsinger, second by Alderman Grant the
appointments be confirmed. Voice vote, motion carried.
Appointment to the Liquor Commission, John Clark, and the re-appointment of
Mike Ranallo. Motion by Alderman Mazza, second by Alderman 'Churchill , the
appointments be confirmed. Voice vote, motion carried. E
Appointment to be made of Carolyn Sue Endres as a volunteer fireman.
Motion by Alderman Carl , second by Alderman Motsinger, the appointment be
confirmed. Voice vote, motion carried.

Motion by Alderman Danner, second by Alderman Motsinger, the appointments be
confirmed. Voice vote, motion carried.
Mayor Crouch reported that in review of the CETA problem, they are out of funds
at this time.
Mayor Crouch appeared in Federal Court last week with the attorney who was retained
to represent the City of Canton, City Clerk, City Attorney,Police Chief, and Mayor,
and each of us individually, all of whom have been sued collectively by the
Unification Church. As they were asking for a preliminary injuction prohibiting
us from enforcing our ordinances. The position that we took before Judge Morgan
is, in this case, that we have never denied them there first amendment rights.
Which allows any church organization to solicit funds within the community. This
does not allow them to sale, it only allows them to solicit, it does not allow them
to be disorderly, so stated Mayor Crouch.
If any of you as Aldermen that would receive complaints, be sure to identify who
is making the complaint, report the complaint to the police dept. so it may be
identified.

REPORT OF THE LIQUOR COMMISSION. On April 29th the commission reviewed two
applications for Liquor Licenses. The first being a license request from Notting-
ham Castle for a club license. The liquor commission recommends the approval
of this license.
Motion by Alderman Danner, second by Alderman Clarke the appointment be approved.
Discussion. Voice vote, motion carried. The license to be issued upon payment of
fee.
A request for a new license, and the request was reviewed by the liquor commission,
and it is for the Corporation of Convenient Food Mart, for a package liquor store.
This will be in a building to be constructed on 11th avenue. After review, the
liquor commission finds the license conforms to the requirements of our ordinance,
and recommends approval of same.
Motion by Alderman Mazza, second by Alderman Grant, the application be approved.

(� Grant, Mazza, Williams. NAYS: Aldermen Churchill , Motsinger, Danner, Ho�rr, Carl ,
Kovachevich. 4 ayes 6 nays 1 absent. Motion defeated.
(29 Motion by Alderman Danner, second by Alderman Mazza, the City Clerk be instructed
Q to advertise for bids for the Canton Country Club Project, and the Hud Project
Q on the S.E. section of town within the Community Development Block Grant. Voice
vote, motion carried. Bids to be returned by May 20th on the Canton Country Club
Project, and June 3rd for the Hud Project.

Motion carried. Ordinance being # 767.
ORDINANCE - ESTABLISHING A SPECIAL SERVICE AREA # 2. Second reading, read by
title only. Motion by Alderman Danner, second by Alderman Churchill , the ordi-
nance be placed on its passage. Roll call . AYES: Aldermen Churchill , Motsinger,
Danner, Clarke, Horr, Grant, Carl-, Mazza, Williams, Kovachevich. NAYS : None.
Motion carried. 10 ayes 0 nays 1 absent. Ordinance being # 768.
Alderman Williams asked if we were going to have a Gabby Sunday? City Engineer
Gordon Braun reported that last year's Fulton County Landfill bill was $3,500.00.
And it takes one week of man hours to clean up Gabby Sunday for a total of 320
hours. Motion by Alderman Williams, second by Alderman Horr this item be sent to
Street & Traffic Committee for review. Voice vote, motion carried.
NEW BUSINESS:
RESOLUTION - M.F.T. Read by title only. Motion by Alderman Danner, second by
Alderman Mazza, the resolution be adopted. Discussion. Roll call. AYES:
Aldermen Kovachevich, Williams, Mazza, Carl , Grant, Horr, Clarke, Danner, Motsi:nger,
Churchill . NAYS: None. Motion carried. 10 ayes 0 nays 1 absent. Resolution
being # 835.
ORDINANCE - VERA SPIVA - PETITION TO ANNEX. Read by title only, first reading.
Discussion.
ORDINANCE - ESTABLISHING SPECIAL SERVICE AREA # 3A. The City Attorney John McCarthy
reported that the following ordinances from 3A thru 3U are all the same, with the
exception of, the number, legal description and the amount of the bond. 3U is an
outlot, it could not be deleted, it is not a lot for sale.

ORDINANCE - ESTABLISHING SPECIAL SERVICE AREA # 6. Read by title only, first
reading. Discussion. This is the Canton Country Club area project. The amount
Lof the bond is $110,000.00
ORDINANCE - AMENDING TITLE 1 , CHAPTER 6, SECTION 3 OF THE CANTON MUNICIPAL
CODE CONCERNING THE REGULAR MEETINGS OF THE CANTON CITY COUNCIL. First reading,
read by title only. The only difference is the word "primary. "
ORDINANCE - REPEALING TITLE 1 , CHAPTER 14 OF THE CANTON MUNICIPAL CODE CONCERNING
CITY SCALES. First reading, read by title only.
BUDGET REVIEW. Mayor Crouch asked for the Councils indulgence and let him finish
with what he has and submit it to each one of the Aldermen, and we can then have a
brief Special Meeting. Motion by Alderman Wi.11i.ams, second by Alderman Motsinger,
that we follow Mayor Crouch's recommendation. Voice vote, motion carried.

Alderman *Carl asked that if the quotes on the City insurance could be back on June 1st?
According to the City 'Attorney the contract we now have provides that termination can
be any month. So June 1st is the date for the quotes on the insurance.
" If any member of council would like a copy of the executive minutes, you may pick
one up in the office of the City Clerk, as they will not be given to you unless you
request it.
ADJOURNMENT. Motion by Alderman Motsinger, second by Alderman Clarke to adjourn.
Voice vote, motion carried. Council adjourned at 8:50 P.M.
