April 13, 2015
The Meeting of April 13, 2015 was called to order by Chairman Jim Hartford at
5:35 p.m.
Roll call was taken: 13 members with 9 attending - Quorum present
Members Present - Jim Hartford, Kathy Lock, Phil Fleming, Roy Hopper, James
Elson Sr., Ed Patton, Alan Dilts, Maria Orwig and Dave Pickel.
Members not present- Kay Long, Craig West, Kent Janssen and Justin Nelson.
Others Present- Planning & Zoning Director, John Kunski, Chris Harmon and
Miranda Hendricks.
Chairman Hartford called for a motion to approve the minutes from the meeting
of March 9, 2015. Motion made by Roy Hopper and seconded by Alan Dilts.
Motion carried with a unanimous voice vote.
Chairman Hartford read the petition, Case 15-007, filed by Max T Kumer Family
Trust for a 9.18 foot variance on the lot width of property located at 585 Ray
Street. The current zoning is R-2 and petitioner wants to build a home on the
property.
Max Kumer was not present and John Kunski spoke on his behalf. John said that
the required lot size needs to be 60 feet and Max lacked 9.18 feet to construct a
home.
Chairman Hartford asked if there were any questions and there were none.
Chairman Hartford asked what the commission's pleasure would be in the
Finding of Fact's; to do individually or all together? Dave Pickel made A Motion
to do the Finding of Fact's all together with consent to all, seconded by Phil
Fleming and Motion carried with a unanimous voice vote.
Chairman Hartford read the next item on the agenda, Case # 15-008, for an 8
foot variance on the front to build a porch on property located at 460 West Vine
by Ben Hendricks. Petitioner's wife Miranda said that they wanted to build a
porch. Ed Patton made A Motion to accept the Finding of Facts all together
with consent to all and was seconded by Kathy Lock. Motion carried with a
unanimous voice vote and the variance was granted.
Chris Harmon spoke at the Citizens Opportunity to address the Commission
regarding setbacks for fences next to driveways. The current ordinance states
that a driveway can be constructed up to the property line but a fence has to
be 1 foot off the property line to allow for people exiting the vehicle. Mr. Harmon
thinks it needs to be changed.
Mr. Harmon owns several rental houses in Canton and has not had good
experiences dealing with this issue. One of his neighbors recently enlarged his
drive and added gravel. Chris wants to put a fence up and in order to do that
must be 1 foot off the property line and maintain the area. He does not think
that it is fair that he has to basically give up his property when it should be the
other way around.
John explained the ordinance and told Chris that even if the language
changed, it would not benefit him, as the properties he has complaints on would
be grandfathered in. John said that at this time the city does not require a
permit for driveways and there is no way to oversee that. It is a matter of which
comes first, the drive or the fence. He told Chris to think about bringing the
changes he would like to see and get with him and City Attorney, Nancy Rabel
and they would draft some language and bring back to the JPZC for further
review and possible recommendation to council.
A Motion to adjourn was made by James Elson Sr. with a second from Dave
Pickel. Motion carried with a unanimous voice vote.
The meeting adjourned at 5:55pm
