AN ORDINANCE RE-ZONING REAL ESTATE FROM R-4 MULTIPLE-FAMILY
RESIDENTIAL DISTRICT TO 8-3 CENTRAL BUSINESS DISTRICT.
WHEREAS, an application for Re-zoning was filed with the City Clerk of the City
of Canton by Graham Hospital Association ("Petitione-"), as owner of certain real
estate legally described hereinafter (the "Property'); said Property being located
within the corporate limits of the City of Canton and identified as 23 West Walnut
and 26 West Pine Street in Canton, Illinois. The Property is legally described as:
(see attached Exhibit A); and
WHEREAS, the present zoning of said Property is R-4 and is requested by
Petitioner that the zoning of said Property be changed from R-4 to 8-3, Central
Business District, to allow construction of buildings and a parking lot for
commercial operations thereon by the Petitioner; and
WHEREAS, a public hearing was held by the Planning and Zoning Commission
of the City of Canton (the "Commission') on September 8, 2008 with no
objections being heard or written protests having been filed with the City Clerk or
Petitioner; and
WHEREAS, the Planning and Zoning Commission of the City of Canton, by
unanimous vote has approved all findings of facts supporting the rezoning
requested by Petitioner and recommended to the City Council of the City of
Canton that the Property be re-zoned from R-4 to 8-3 Central Business District,
pursuant to the statutes and ordinances made and provided; and
WHEREAS, it is in the best interest of the City of Canton that the Property be re-
zoned from R-4 to 8-3 Central Business District, as requested by Petitioner.
NOW THEREFORE, BE /T ORDAINED BY THE CITY COUNCIL OF CANTON,
ILLINOIS AS FOLLOWS:
1. That the City Council hereby finds as fact the matters set forth
hereinabove and hereby approves and incorporates by reference all
findings of fact approved by the Commission supporting the re-zoning
requested by Petitioner.
2. That the Property described as follows be and the same is hereby re-
zoned to 8-3 Central Business District, authorizing Petitioner to use the
Property as parking and construction of buildings for commercial
operations (see attached Exhibit A).
3. That the Zoning Administrator of the Cify of Canton is directed to make the
necessary changes to the zoning maps to properly reflect this re-zoning.
4. That Petitioner may record with fhe Fulton County Clerk, ex officio
Recorder of Deeds, a certified copy of this Ordinance.
5. That this Ordinance shall be in full force and effect upon its passage by
the City Council of the City of Canton and approval by its Mayor and
further that said passage may be done without a second reading, it being
waived by the City Council.
Pass by the City Council of the City of Canton, Fulton County, Illinois at a regular
meeting of said Council this 16th day of September, 2008 upon a roll call
vote as follows:
AYES: Aldermen Schenck, Berardi, Sarff, Nidiffer, Ihnes,
Strandberg, Lewis.
NAYS: None .
ABSENT: Alderman West.

EXHIBIT A
A part of the Southeast Quarter (SE %) of Section Twenty-seven (27), Township
Seven (7) North, Range Four (4) East of the Fourth Principal Meridian, described
as follows: Beginning at fhe Northwest corner of Lot Fifty-one (51) in Jones
Second Addition to Canton, Illinois, thence South 227 feef, thence West 5 rods,
more or less, to the East line of the property owned by W. E. Shallenberger on
July 8, 1940, thence North 227 feet, thence East to the place of beginning, all
situated in Fulton County, Illinois.

Canton, Fulton County, Illinois, that is 227 feet South of the Northwest corner of
Lot Fifty-one (51) in said Jones Second Addition, thence South along the said
West line of said Jones Second Addition and/or said line extended South to a
point that is 24 rods South of the said Northwest corner of said Lot Fifty-one (51)
in said Jones Second Addition, thence West 5 rods, thence North to a point that
is directly West of the point of beginning, thence East 5 rods to the point of
beginning; all situated in the City of Canton, Fulton County, Illinois.
TRACT 11: Apart of the Southeast Quarter of Section Twenty-seven (27) in
Township Seven (7) North, Range Four (4) East of the Fourth Principal Meridian,
Fulton County, Illinois, described as follows:
Commencing at a point 24 rods South of the Northwest comer of Lot Fifty-one
(51) in Jones Second Addition to the City of Canton, Fulton County, Illinois, and
running thence South to the North line of West Walnut Street, thence West along
the North line of West Walnut Street 5 rods, thence North to a point directly West
of the point of beginning, thence East to the point of beginning; all situated in the
Cify of Canton, Fulton County, Illinois.
