AN ORDINANCE GRANTING A SPECIAL USE PERMIT FOR
TRANSFORMING THE BASEMENT INTO LIVING QUARTERS,
LOCATED AT 1055 WEST LOCUST STREET, CANTON, ILLINOIS
TO RICHARD BERRY (FORMERLY MID CENTURY TELEPHONE
BUILDING.)
WHEREAS, it appears to the City Council of the City of Canton,
Fulton County, Illinois, that the territory hereinafter described is located
within the corporate limits of the City of Canton; and,
WHEREAS, a petition was filed by Richard Berry to the Planning &
Zoning Commission of said City requesting a special use; and,
WHEREAS, no objectors appeared at said hearings and said
commission did thereupon make favorable findings of fact and did
recommend to the Canton City Council that said special use to transform the
basement into living quarters at 1055 West Locust Street, Canton, Illinois.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COUNCIL OF THE CITY OF CANTON, FULTON COUNTY,
ILLINOIS A5 FOLLOWS:
1. That the City Council of the City of Canton, Fulton County,
Illinois, hereby finds the foregoing recitals to be fact.
2. That a special use permit for living quarters be issued to Richard
Berry, 1055 W. Locust Street, Canton, Illinois, affecting real
property being legally described as follows:
3. That the record of the City of Canton, appropriated documents,
maps and related regulations be and the same hereby are, amended
to reflect the foregoing special use permit granted herein.
4. Apart of the Southwest Quarter (SWl/4) of the Northwest Quarter
(NWl/4) of Section Twenty-eight (28). Township Seven (7) North,
Range Four (4) East of the Fourth Principal Meridian, a more
detailed description is as follows:
From a stone in the Northwest Corner, Section 28, Township and
Range aforesaid, running thence South Odegree50' West 2602.7 feet;
thence South 89degree54'East 1111.6 feet to the point of beginning.
From the point of beginning thence North 1 degree 28' East 310.0
feet; thence South 89degree 54' East 211.0 feet; thence South 1 degree
28' West 310.0 feet; thence North 89degree 54' West 211.0 feet to the
point of beginning.
PASSED by the City Council of the City of Canton, Fulton County, Illinois,
at a regular meeting this 16th day of September , 2008 upon a roll call
vote as follows:
AYES: Schenck, Berardi, Sarff, Nidiffer, Ihnes, Strandberg,
Lewis.
NAYS: None .
ABSENT: Alderman West.
