The Meeting of January 12, 2015 was called to order by Chairman Jim Hartford at
5:30 p.m.
Roll call was taken: 14 members with 9 attending - Quorum present
Members Present - Jim Hartford, Kathy Lock, Phil Fleming, Kay Long, Craig West,
David Headley, Alan Dilts, Kent Janssen and Justin Nelson.
Members not present - Roy Hopper, James Elson Sr., Maria Orwig, Dave Pickel
and Ed Patton.
Others Present - Planning & Zoning Director, John Kunski and petitioner's Tammy
Hensley(for David Neidig), Bernard Hartle and Martha Delzell. Bob Senneff and
Trigve Meade represented the Graham Hospital Association.
Chairman Hartford called for a motion to approve the minutes from the meeting
of December 8, 2014. Motion made by Alan Dilts and seconded by Kathy Lock.
Motion carried with a unanimous voice vote.
Chairman Hartford read the petition, Case 15 -001, filed by the Graham Hospital
Association for re- zoning of property located at 33 West Walnut from an R -4 to a
B -3. They plan to add on a new facility to the existing Graham Medical Group
Clinic.
Trigve Meade spoke on behalf of the Graham Hospital Association and showed
on the handout the proposed addition to the West side of the building, which will
house doctor's offices and rehabilitation facilities. Mr. Meade stated that
Graham Hospital is a major part of the community and provides excellent health
care services for the citizens of Canton and this would be a continuation of their
services. He noted one correction on the petition, which stated the addition
would be 2800 square feet, when in fact, it is 28,000 square feet. Mr. Senneff
stated that the addition would be about seven million dollars.
Chairman Hartford asked if there were any questions and there were none.
Chairman Hartford asked what the commission's pleasure would be in the
Finding of Fact's; to do individually or all together? Kent Janssen made A Motion
to do the Finding of Fact's all together with consent to all, seconded by Phil
Fleming and Motion carried with a unanimous voice vote.
Kent Janssen then made A Motion to accept the petitioner's request for re-
zoning and was seconded by David Headley. Motion carried with unanimous
voice vote.
A Motion to send the recommendation for re- zoning to Council was made by
Justin Nelson and seconded by Alan Dilts. Motion carried with unanimous voice
vote.
Chairman Hartford read the next item on the agenda for a 20 foot variance on
the rear yard of property located at 521 Baxter Ct. by David Neidig. Petitioner
would like to build a detached garage. David's mother, Tammy Hensley spoke
on his behalf and explained that David was going to put a garage up several
years ago and was unable at the time to do so. Because the property butts up
against an alley, it is a required 25 foot setback from the property line. Tammy
kept saying that it was 25 foot from the fence. John reiterated to Tammy, to
make sure she understood, that the 25 feet is off the property line, not where the
fence is. Kent Janssen said, the fact that other property owners fences and
garages seem to fall in the some line and that if she kept to that it should be
okay. Alan Dilts made A Motion to accept the variance and was seconded by
David Headley. Motion carried with a unanimous voice vote and the variance
was granted.
The third item was a petition for a 9 foot variance from Bernie Hartle for property
located at 50 Willow Court. Petitioner would like to build an addition on an
existing garage. No questions were asked and A Motion to accept the 9 foot
variance was made by Justin Nelson and seconded by Kay Long. Motion
carried with a unanimous voice vote.
John Kunski told the commission that he was still working on the language for the
cell tower ordinance and he would have it for them at the next meeting.
A Motion to adjourn was made by Justin Nelson with a second from David
Headley. Motion carried with a unanimous voice vote.
The meeting adjourned at 5:45pm
