ORDINANCE NO. 3090
AN ORDINANCE RE- ZONING REAL ESTATE FROM R -4 MULTI - FAMILY RESIDENTIAL
DISTRICT TO B -3 CENTRAL BUSINESS DISTRICT.
WHEREAS, an application for rezoning was filed with the City Clerk of the City of
Canton by Graham Hospital Association, Inc., ( "Petitioner "), as owner of certain
real estate legally described hereinafter (the "Property "); said Property being
located within the corporate limits of the City of Canton and identified as 33
West Walnut Street, in Canton, Illinois, 61520. The Property is legally described as:
(see attached Exhibit A); and
WHEREAS, the present zoning of said Property is R -4, Multi- Family Residential
District, and it is requested by Petitioner that the zoning of all of said property be
changed to a zoning configuration of B -3, Central Business District, to allow for
the construction of a 28,000 sq. ft. addition to the current Graham Medical
Group Clinic thereon by Petitioner, and,
WHEREAS, a public hearing was held by the Planning and Zoning Commission of
the City of Canton (the "Commission ") on January 12, 2015, with no objections
being heard or written protests having been filed with the City Clerk or Petitioner,
and
WHEREAS, the Planning and Zoning Commission of the City of Canton, by
unanimous vote has approved all findings of facts supporting the rezoning
requested by Petitioner and recommended to the City Council of the City of
Canton that the Property be rezoned from R -4, to B -3, Central Business District,
pursuant to the statutes and ordinances made and provided; and
WHEREAS, it is in the best interest of the City of Canton that the Property be
rezoned from R -4, to B -3, Central Business District, as requested by Petitioner.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF CANTON, ILLINOIS AS
FOLLOWS:
1. That the City Council hereby finds as fact the matters set forth
hereinabove and hereby approves and incorporates by reference all findings of
fact approved by the Commission supporting the rezoning requested by
Petitioner.
2. That the Property described as follows be and the some is hereby
rezoned to B -3 Central Business District, authorizing Petitioner to use the Property
for the purpose envisioned by said zoning classification (see attached Exhibit A).
3. That the Zoning Administrator of the City of Canton is directed to
make the necessary changes to the zoning maps to properly reflect this
rezoning.
4. That Petitioner may record with the Fulton County Clerk, ex officio
Recorder of Deeds, a certified copy of this Ordinance.
5. That this Ordinance shall be in full force and effect upon its passage
by the City Council of the City of Canton and approval by its Mayor.
Passed by the City Council of the City of Canton, Fulton County, Illinois at a
regular meeting of said Council this 20th day of January, 2015, upon a roll call
vote as follows:

Part of the Southeast Quarter of Section 27, Township 7 North,
Range 4 East of the Fourth Principal Meridian, Fulton County,
Illinois, more particularly described as follows: Beginning
82.5 feet West and 270 feet South of the Northwest corner of Lot
51, of Jones Second Addition to the City of Canton, Fulton
County, Illinois, thence West from said point of beginning 58
feet, thence South 150 feet to the North line of West Walnut
Street, thence East 58 feet and thence North 150 feet to the
