HomeMy WebLinkAboutOrdinance #1478~ .^- .. x ORDINANCE N0. 1478 AN ORDINANCE AMENDING TITLE 8, CHAPTER 19, SECTION 31 OF THE CANTON MITNICIPAL CODE RELATING TO REMEDIATION WATER WHEREAS, the Legal and Ordinance Committee has determined that it is necessary and in the best interest of the City of Canton to amend Title 8, Chapter 19, Section 31 (m); and, WFIEREAS, the Canton City Council has made a similar determination. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COIINCIL OF THE CITY OF CANTON, Fulton County, Illinois as follows: 1. That the Canton City Council hereby finds the foregoing recitals to be fact. 2. That Title 8, Chapter 19, Section 31 (m) of the Canton Municipal Code is hereby amended to read as follows: "8-19-31 (m): Any groundwater or surface water which is collected in an effort to remediate groundwater which has been contaminated with petroleum hydrocarbons which will exceed the following limitations. 1. Benzene 0.5 2. Toluene 0.5 3. Ethyle Benzene 0.5 4. Xylene 0.5 5. n-Hexane 0.5 6. 1,2 Dichlorobenzene 0.5 7. 1,3 Dichlorobenzene 0.5 8. 1,4 Dichlorobenzene 0.5 9. Lead 5.81 10. pH betwe 11. Total of items 1 thru 8 ppm ppm ppm ppm ppm Ppm ppm ppm ppm en 5 and 11 4.0 ppm In addition to the above limits, the discharge must not be hazardous as defined by the hazardous waste characterization analysis for constituents as listed under 35 IAC Part 721, subpart C. The analysis results must be submitted. The waste must not contain or exceed the following limits. 12. Flashpoint < 140 degrees F 13. pH limited above 14. No reactive chemicals capable of producing toxic gases. 15. Must ass the Toxic Characteristics Leaching Procedure (TCLP~. ... Also, any discharge system shall include, at a minimum, an oil water separator. This requirement may be waived by the Wastewater Treatment Superintendent if other devices such as skimmer pumps, settling basins, or surge tanks are in use. The applicant should note that an indemnification statement relieving the City of all liability for the operation and discharges of the groundwater remediation system is required. The indemnification statement shall be included with the permit application." 3. That this Ordinance shall be in full force and effect immediately upon its passage by the City Council of the City of Canton and approved by the Mayor thereof. PASSED by the City Council of the City of Canton, Fulton County, Illinois at a regular meeting this lst day of August , 1995 upon a roll call vote as follows: AYES: Aldermen May, Shores, Meade, Bohler, Phillips, Sarff, Hartford, Molleck.
