Ordinance No. 1457
An ordinance annexing certain property of Bret K and Deborah S. Weaver
at Rural Route One in the City of Canton, Illinois.
WHEREAS, it appeazs to the City Council of the City of Canton, Illinois, that the
territory hereinafter described is not located within the corporate limits of said City of
Canton, Illinois; and
IT FURTHER APPEARING to said City Council that a Petition for Annexation
has been filed by the Petitioners, Bret K Weaver and Deborah S. Weaver, to annex the
property hereinafter described to an AG-1 zoning configuration; and
IT FURTHER APPEARING to said City Council that a public hearing was
conducted by the Planning and Zoning Commission of the City of Canton, Illinois, in
accordance with the laws of this State and the ordinances of the City of Canton, Illinois,
on the 13th day of Mazch, 1995, and said Planning and Zoning Commission made
recommendation with regard to the annexation of the property hereinafter described;
THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CANTON, ILLINOIS:
Section 1. That the territory described as follows:
Beginning at the Northeast corner of the South 30 rods of the North Half
of the Southeast Quarter of Section 33, thence South 87 degrees 56
minutes 25 seconds West 462 feet along said North line to the place of
beginning for the tract to be described; thence continue South 87
degrees 56 minutes 25 seconds West along said North line a distance of
600 feet, thence South 0 degrees 52 minutes 30 seconds West a
distance of 175 feet, thence North 87 degrees 56 minutes 25 seconds
East a distance of 600 feet, thence North 0 degrees 52 minutes 30
seconds West a distance of 175 feet to the point of beginning for said
described tract containing 2.41 acres more or less. Said tract situated in
the Northeast corner of the following described tract owned by Bret K
and Deborah S. Weaver:
The South 30 rods of the North Half of the Southeast Quarter of Section
33, except the West 2 rods thereof, and the East Half of the North Half of
the South Half of the Southeast Quarter of said Section 33, INCLUDING
an easement for gas, electricity, water, sewer, and telephone over the
West 25 feet of the parcel hereinafter described as Exception No. 1, all
in Township 7 North, Range 4 East of the Fourth Principal Meridian,
EXCEPTING from the above described tract the following:
EXCEPTION NO. 1: Commencing at a stone at the Southwest corner of
the Southeast Quarter of said Section 33, thence North 00 degrees 19
minutes 06 seconds East along the West line of the Southeast Quarter
of said Section 33, a distance of 1817.22 feet to the Northwest corner of
the South 30 rods of the North Half of the Southeast quarter of said
Section 33, thence North 89 degrees 22 minutes 49 seconds East along
the North line of the South 30 rods of the North Half of the Southeast
Quarter of said Section 33 a distance of 33.00 feet to an iron rod, said
iron rod being the place of beginning for the tract to be described; thence
continuing North 89 degrees 22 minutes 49 seconds East along said
North line 450.00 feet to an iron rod, thence South 00 degrees 19
minutes 06 seconds West 115.00 feet to an iron rod, thence South 89
degrees 22 minutes 49 seconds West 450.00 feet to an iron rod on the
East line of the West 2 rods of the Southeast Quarter of said Section 33,
thence North 00 degrees 19 minutes 06 seconds East along the East
line of the West 2 rods of the Southeast Quarter of said Section 33 a
distance of 115.00 feet to the place of beginning, containing 1.19 acres,
more or less, together with and subject to all easements of records.
EXCEPTION NO. 2: Beginning at the Northeast corner of the East Half
of the North Half of the South Half of the Southeast Quarter of said
Section 33, thence South 0 degrees 52 minutes 20 seconds East 662.30
feet to an iron pin at the Southeast corner of the East Half of the North
Half of the South Half of the Southeast Quarter of said Section 33,
thence South 87 degrees 38 minutes 02 seconds West 722.00 feet
along the South line of said East Half of the North Half of the South Half
of said Southeast Quarter, thence North 0 degrees 52 minutes 20
seconds West 500.00 feet, thence North 87 degrees 38 minutes 02
seconds East 260.00 feet, thence North 0 degrees 52 minutes 30
seconds West 659.75 feet to a point on the North line of the South 30
rods of the North Half of the Southeast Quarter, thence North 87
degrees 56 minutes 25 seconds East 462.00 feet along said North line to
the Northeast corner of the South 30 rods of the North Half of the
Southeast Quarter, thence South 0 degrees 52 minutes 20 seconds East
495.00 feet to the point of beginning, containing 15.27 acres, more or
less, situated in Fulton County, Illinois.
be and the same is hereby annexed to the City of Canton, Illinois, zoned in an AG-1
configuration according to the City Code of the City of Canton, Illinois.
Section 2. That the City Engineer is directed to prepare an appropriate annexation
plat and the City Zoning Administrator is hereby instructed and ordered to reflect said
configuration on the zoning map of the City of Canton, Illinois, as required by this
Ordinance.
Section 3. That the Ordinance shall be in full force and effect immediately upon its
passage by a majority vote of the aldermen holding office in the City of Canton, Fulton
County, Illinois, at a regular meeting this 4th day of April, 1995, upon a roll call vote as
follows:
