ORDINANCE N0.1454
AN ORDINANCE AMENDING WATER AND SEWER SYSTEM RATES INVOLVING
REMEDIATION WATER
WHEREAS, gas stations and other owners of underground
storage tanks are required to remediate groundwater contamination
found to be in excess of the State of Illinois clean-up
objectives; and,
WHEREAS, it is necessary to have a method of disposing of
said contaminated groundwater; and,
WHEREAS, the acceptance of such wastewaters by the City
involves additional monitoring and care; and,
WHEREAS, the current city ordinances do not provide for
acceptance of contaminated groundwater.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COIINCIL COIINCIL OF
THE CITY OF CANTON, Fulton County as follows:
1. That Section 8-10-5 of the City Code of Canton, Illinois
is amended by adding the following subsection thereto:
"(K) Dischargers of remediation water as limited in Section
8-19-31(m) shall pay a charge to be called a "Remediation
Water Charge" of three cents ($.03) per allon for each
gallon of such wastewaters delivered and~or discharged to
the City under the provisions of this ordinance. Such
charges shall be in lieu of flow, BOD, and TSS charges as
established herein. The doubling of wastewater treatment
bills for outside sources (not within the City limits) shall
be applicable to the above charges.
Charges for sampling and analyses under-taken by the City for
inspection shall be borne by the party requesting the
discharge."
2. That Section 8-19-19 is amended by adding the following:
"An existing service sewer may be used for remediation water
if upon examination by the City, it meets all requirements
of the ordinance."
3. That Section 8-19-22 be deleted and the following
substituted in its place:
"No person(s) shall make connection of roof downspouts,
exterior foundation drains, area way drains or other
sources of surface runoff or groundwater, except
remediation waters meeting all requirements as set forth in
Section 8-19-31(m) of this code, to a building sewer or
building drain which in turn is connected directly or
indirectly to a public sanitary sewer.
!.. That Section 8-19-26 is amended to read as follows:
"8-19-26: The discharge from plumbing fixtures, only, shall
be connected to -the public sanitary sewers of the City,
except for remediation waters. For the purposes of this
Chapter, the term "plumbing fixtures" shall be construed in
accordance with the Illinois State Plumbing Code, and shall
specifically include basement floor drains.
The connection of footing tile, area drains, surface water
inlets, downspouts, yard or field drains or any other
drainage facility which receives ground water seepage,
except for remediation waters, or collected surface water
the public sanitary sewer system is hereby prohibited."
5. That Section 8-19-28 is amended by adding the words
"except groundwater remediation water" immediately preceding the
words "... to any sanitary sewer."
6. That Section 8-19-30 is amended by adding to
subparagraph (A) the following:
"Remediation waters from leaking underground storage tanks
or surface spills may be allowed provided that the same do
not exceed the limits of Section 8-19-31 (m)•"
7. That Section 8-19-31 is amended by adding subparagraph M
as follows:
"(m) Any groundwater or surface water which is collected in
an effort to remediate groundwater which has been

contaminated with petroleum hydrocarbons which will exceed
the following limitations.
1. Benzene 0.5
2. Toluene 0.5
3. Ethyle Benzene 0.5
4. Xylene 0.5
5. n-Hexane 0.5
6. 1,2 Dichlorobenzene 0.5
7. 1,3 Dichlorobenzene 0.5
8. 1,4 Dichlorobenzene 0.5

In addition to the above limits, the discharge must not be
hazardous as defined by the hazardous waste characterization
analysis for constituents as listed under 35 IAC Part 721, subpart
C. The analysis results must be submitted. The waste must not
contain or exceed the following limits.
12. Flashpoint < 140 degrees F
13. pH limited above
14. No reactive chemicals capable of producing toxic gases.
15. Must ass the Toxic Characteristics Leaching Procedure
(TCLP~.
Also, any discharge system shall include, at a minimum, an
oil water separator. This requirement may be waived by the
Wastewater Treatment Superintendent if other devices such as
skimmer pumps, settling basins, or surge tanks are in use.
The applicant should note that an indemnification statement
relieving the City of all liability for the operation and
discharges of the groundwater remediation system is required. The
indemnification statement shall be included with the permit
application."
8. That Section 8-19-36 is amended by adding thereto the
following paragraph:
"The City is not required to accept any remediation waters
if samples have not been tested or if the testing reflects
levels not acceptable under Section 8-19-31 (m)."
9. That this ordinance shall be in full force and effect
immediately upon its passage by the City Council of the City of
Canton and approved by the Mayor thereof.
PASSED this 7t-h day of March, 1995 upon a roll call vote
as follows:
