BE IT ORDASNLD BY TH� CITY CCUNCIL OF TH�: CITY OF C�LNTGN,
IZLINOIS, That
{
Section 1. Any tree or part thereof, whether living or `
dead, infected with or attacked by ceratocystis ulmi (the Ducth
Elm disease) , or any other disease , and any tree which has beeome
hazardous to life or property because of age or ne�lect of the
awner thereof, is hereby declared to be a nuisance, and it shell
be unlawful to permit any such tree or part thereof to remain in
the City.
Section 2. The Chief of' Police of the City of Canton or
som� other police officer desi�nated by him are hereby authorized
to inspect and examine any tree in the City of Canton to determine
wheth�;r or not it is infected by the Dutch Elm disease or is in a
hazardous condition, as in this Ordinance is Set forth. Upon dis—
coverin� that any such tree is so infected or is in a hazaradous
condi�ion�', as aforesaid , the owner or occupant of the premises
shall be notified of this fact.
Section 3. It shall be the duty of the owner or accupan�
of any land upon which such diseased or hazGradous tree exists
to take action within ten (10) d�ys �fter such not�ce to 'rembve
and burn said tree , as aforesaid, ar�d �hall, within thirty days
of said notice have such diseased or �nFected tree removed and
burned.
Section 4. ti�here the o7•�ner or occupant of the pr�mises
concerned does not properly dispose of such infected or h<�zardous
- tree , as herein this Ordinarice is set forth, after such notic� ,
or wherP tl��� owner or occuparlt canr_ot be located, the Chief of
Police of th� City of Canton, or any oth�r police officer desig—
natAd by him, are hereby authorized to remnve and destroy such
tree or trees , en�a�;ing sucn s�rvices from thF� Cit,y of Canton and
its employ�es as maST be necessary to properly remove and destroy
such tree or trees, at tr,,e e�ense of the �arty or parties per-
mittin� same.
Section 5. riny ��erson, firm or corparation violating any
provisions of this ordinance shall be fined not less than five
dollars ($5.Q0) nor more than two hundred dollars (�200.00) for
each offense ; ard a separate offense shall be deemed committed
_ on cach day a diseased or infccted tree or hazaradous tree or
any portion. th�reof remains on the premises more than thirty days
after notice has been �;iven in accordance with the provisions of this
Ordinance.
Section 6. This ordinance shall be in effect ten days
aft�er its passage by the City Council, approval by the Mayor
and publication accordin� to law.
