AN ORDINANCE PREPARED AND TRANSMITTED AND IT� PASSAGE RECOMMENDED BY THE BOARD OF LOCAL IMPROVEMENTS OF TI-� CITY GF CANTON, II,LINOIS, PROVIDING FOR THE LQCAL IMPROVEMENT OF CERTAIN PORTIONS OF EDMAR DRIVE IN THF CITY OF CANTON, II,LINOIS, FORMING A CONNECTED SYSTEM OF PAVEMENT AND DESIGNATED AS "C.ANTON PAVING IMPROVEMENT NUMBER 64 A. " � IT ORDAINED BY TH�; CITY C�tTNCIL �F TH;� CITY �F CANTON, ILLINOIS: Section 1. That a local improvement be and the same is hereby originated to be made by special assessment within the City of Canton, County of Fulton, and State of Illinois, to be known as "C.ANTON PAVING IMPROVEMENT NUMBER 64-A", the nature, character, locality, description and extent of which local im- provement is as follows: That the roadway of the �treet�, drives and courts herein after described to be improved by excavating, grading and pre- paring the subgrade to receive the hereinafter described pavement and curbing, by paving with a seven inch compacted gravel, crush- ed gravel or crushed stone base course, by priming the base cours with a bituminous material, by cover�ding the base course and prime coat with a two inch bituminous coat mixture, by curbing with Portland Cement Concrete curbs, by constructing h�cessar9 storm water inlets and connecting storm sewers, by constructing and making necessary ad�ustments to grade of existing manholes and valve vault covers, by constructing necessary concrete head- ers, by removing trees, such removal made necessary by the plac- ing of curbing, by removin� any existing catch basins and inlets. That the pavement hereinafter provided to be constructed on Edmar Drive shall be uniformly 34.0 feet in width as measured between front face of curbs from State Route ']8 East to end of Edmar Drive. That tree,� removal shall include excavation, tree removal brush and stump removal and backfilling. �that the pavement shall be constructed to a uniform thick ness of nin�e C9) inches. That the combination curb and gutter herein provided to be constructed shall be NirPteen (19) inches in wiritb and shall �xtend six (6) inches in height _abov� pavemer�t :.�ur�aae.: ;. . � That the curb headers herein provided to b e constructed shall be Six (6) inches in width an.d Eighteen (18) inches in hei�ht. That the removal of existing catch basins and inlets shall include ezcavation and backfilling. That all necessary excavation, grading, shaping and com- pacting of the subgrade preparatory to the placement of the�::,pave ment and curbing be done, which excavations and grading to includ the removal of all earth, oil surface, culvert pipes and other obstructions of whatever nature within the pavement and curbin� area, the removal of which is necessary for the conatruction of the proposed improvement# 2. That where abutting sidexalks and �rivewa�s do not meet the grades of the proposed curbs, said sidewalks shall be made to conform to the proposed improvement grade b� taking up the re- quired amount of such existin� sidewalk and replacing an e4ua1 � - kind and �quality of the same to conform to the proposed improve- ment grades and make a neat and servicable �unction. That the parkways along the line of the propoaed curbs shall be graded and smoothed to the top of the proposed curb grade on a back s1opl�not exceeding one vertic,�� to three horiz- ontal. In all other respects the construction shall conform to � the requirements as set forth in the pSTANDARD SPECIFICATION FOR ROAD AND BRIDGE CONSTRUCTION" , prepared by the Department of Pub- lic Works and Buildings of the State of Illinois and adopted by said Department ;January 2, 1958, and revisions and addition there to. That the .local cost of the impro�ement, in�l.uding all necessary labor, materials, machinery, �ools and .equ�,pment, for the local improvement, in said City of Canton, Illinois, is the sum of �22,370.00, which said estimate is itemized and is attach ed hereto and made a part of this Ordinance� by reference thereto That for a more detail description of the matters hPreto fore recited, reference is hereb�r made to the plans, profilea aad drawing hereto attached, which plans, profiles and drawings are hereby made e�cpress�ly a part of this Ordinance. That all the elevations and grades of the center line of the finished impr�vement, the top of the finished curbs, the storm water inlets , valves, manholes, a.nd necessary adjustment to grades shall conform to and be identical with the elevations and grades as shown b9 t�.e plans, specifications and profiles pre- pared b9 Crawford, Murph� and Tilly, Consultin� Engineers, of the City of Springfield, Illinois, and now on file in the office of the City Clerk of the City of Canton, Illinois, and made a part of this Ordinance by reference, as though set out herein in full, �" a copy of such plans, �pecifications, and profiles bein� attache "' hereto. That such grades and elevations are shown in such plans, specifications and profiles and are measured in feet and decimal parts thereof and are determined from a bench mark, the location of which is shown. on said plans, specifications and profiles. SECTION 2. DEFINITIONS. That whenever the words desired below are used in this Ordinance, or in the specifications here- to attached are made a part hereof, or in any proceedings rela- tive to the improvement herein provided for they shall have the following meanings: "State"' shall be interpreted to mean the Cit� of Canton, Illinois. "De�artment' �of Public Works and Buildings" shall be inte preted to mean the Board of Local Improvements of the City of Canton, Illinois. "Engineer" shall be interpreted to mean the engineer bm- ployed by the City of Canton, Illinois. .� . . ,• . 3. "State Treasurer of Illinois" shall be interpreted to mean the City Treasurer of Canton, Illinois. "Contractor" shall be interpreted tv mean the person, firm or corporation to whom the work for this improvement is awarded and the agents, assigns and employees thereof. Section 3. .APPROVAL OF PLANS ETC. That the maps, plans, and specifications for this improvement, hereto attached, and hereinbefore referred to, are hereby approved and made a part of this Ordinance the same as if incprporated in this Ordinance in full. In. case of conflict with the parts of said specifications and special provisions, the special provisions shall control. Section 4. SUPERVISION. That all the aforesaid local i - provements shall be made under the supervision and direction of the Board of I,ocal Improvementa of the City of Canton, Illinois. Section 5. RECOMMENDATIONS APPROVED. That the recom- mendations of the Board of Local Improvements of the City of Can toa, Illinois, recommendin� and providin� for the aforesaid loca improvement, together with the Estimate of the Cost thereof, as made and itemized by and over the signature of the Engineer of said Board, both attached hereto, be and the same are approved, and made a pa rt hereof the same as if they were incorporated herein in full. Section 6. ASSESSMENT ETC. That the said Local Zm�rove ment shall be made and the cost of said local improvement being the sum of �22,370.00, as shown by the estimate of the Engineer of aaid City of Canton, Illinois, attached hereto and made a part hereof, includin� the sum of �1,109.16, bein� the amount in cluded in the estimate of said Engineer as the cost of making, levying and collecting the assessments thereof, the Court Costs, Attorney fees and the lawful e�enses attending the same, and including the sum of �2,774.88, being the amount included in the estimate of said engineer as the costs of engineering, inspeetio , and supervision, shall be paid by special assessment, to be levi d upon the contiguous property specifically to be benefited to th� amount the same may be le�ally asseased therefore in accordance with the provisions of an Act of the General Assembly of the . State of Illinois, as provided by Article 9, Division 2, of the Cities and Villages Act, approved May 29, 1961. That the sum of �1,109.16 shall be applied toward the lawful expenses of making, levying, and collecting said assessments an.d the court costs, attorne fees and lawful expenses attending the same ; and the sum of �2,774.88 shall be applied toward paying the costs of en- gineering, inspection and supervision incident to said improve- ments, all as provided b� the Act of the Ganeral Assembly of the State of Illinois. Section 7. INSTALLMENTS. That the aggregate amount herein ordered �o be assessed a�ainst the property of each lat, piece, tract or parcel to be assessed, and the amount to be ass- essed if any, against the City of Canton, Illinois, as and for public benefit, shall be divided in ten (10) annual installments so that all installments shall be equal in amount except that al fractional amounts shall be added to the first installment,so as to leave the remaining installments of the a�gre ate equal in amount and each multiple of One Hundred (�100.00� Dollars ; said first installment shall be due and payable on the 2nd. day of January next after the date of the first voucher issued on ac- dount of work done on said improvement , and the second iastall- ment one �ear after, and so on annually un.til all said install- � ; � • . .. . . 4. ments are paid, and all of said installments shall bear interest �+t the rate of Five Per Centum C59b) per annum, from the date of 8ixty (60) days after date of issuance of first voucher on ac- eount of work done on said impronement. And it is hereby made the duty of the Board of Local Improvements to file in the offic of the Clerk of the Court in which said assessment is canfirmed a certificate signed b9 the Secretary of the Board of Local Im- provements of the first voucher and the amount thereof within thirty days after the issuance thereof. Section 8. BONDS. That for the purpose of anticipating the collection of the second and succeeding installments of said special assessment of said local improve�ment, bonds shall be is- sued payable out of the aforesaid installments, bearing interest at the rate of Five Per Centum C5g6) , payable annually, and said Bonds shall be signed by the Mayor, President of the Board of Local Improvements of the City of Canton, Illinois, attested and countersi�ned by the City Clerk of said City, un.der the corpor- ate seal of said City of Canton, I1linois, and said bonds shall be issued in the sum of One Hundred Dollars ($100.00) each or some multiple thereof, and shall be dated and draw interest from the date of issuing the same ; said bonds shall be issued in ac- cordance with and in all respects pursuant to the provisions and requirements of the Act of the General Assembly of the State of Illinois, as provided by Article 9, Division 2, of the Cities and Villages Act, approved May 29, 1961. Section 9. PROCEDURE. That the Mayor of the City of Canton, Illinois, on behalf of the Cit is hereby directed and instructed to file a Petition in the��Court of Canton, I11- � inois, in the name of the City of Canton, Illinois, prayang that steps be taken to levy a special assessment for the said improve ment in accordance with the provisions of this Ordinance and in the manner prescribed by law. Section 10. GENERA.L PROVISIONS. That all actions taken in and based on this Ordinance is and shall be under and pursuan t to the terms and provisions of an Act of the General Assembly of the State of Illa.nois, as provided by Article 9, Division 2, of -�- the Cities and ��.I�.aE.�es ��L� approved May 29, 1961. Section 11. REPEAL. T�a� :;aJ;�. Jrdinan.ces and parts of Ordinan.ces in� an� wa9 conflicting with this Ordiaances be, and the same are hereby repealed. Section 12. WHEN EFFECTIVE. This Ordinance sha11 be in full force and effect from and after its passage and approval according tb law.
