AN ORDINANCE REGART)ING .AI3ANUONED, UNCLA�NZCD, INOPENAPI� and UNATTEIVDED VEHICLES:
BE IT ONI7AINED BY T��: CITY COUNCIL OF' TH� CITY U�' CANTON, ILLINOIS:
Section 1. D�:�'INITIONS. The following definitions shall apply in the
interpretation and enfox�cemQnt of this Ordinance:
(1) "Person't shall mean any person� firm� partnership, a.ssociation,
Corporat3on, company, or organization of any kind.
(2) "Vehicle" shall mean a machine propelled by power other than
human power designed to travel along the ground by use of wheels,
treads, runners, or slides and tranaport persons or property or
pul.l machinery and sha:11 include, without limitation, automobile,
truck, trailer, motorcycle, tractor, buggy and wagon.
(3) "Street or highway" shall met�.n the entire width between the
boundary lines of every way publicly ma.intained when any part
thereof is open to the use of the public for purposes of ve-
hicular travel.
(4) '}Property" shall mean any real property within the City which
is not a street or highway.
(5) "Inopera.ble motor vehicle't shall mean any motor vehicle from whieht
for a period of at least 6 m�onths, the engine, wheels or other
parts have been removed, or on which the engine, wheels or other
parts have been altered� dama.ged, or otherwise so treated that
the vehicle is incapable of bein� driven under its o�.rn motor power.
(6) '�Inopersble motor vehicle" shall not include a motor vehicle which
has been rendered temporarily incapable of being d riven under its
own power in order to perform ordinary service or repair operations
nor to any motor vehicles that are kept within a building when not
in use, to historic vehicles over 25 years of age, or to a motor
vehicle on the premises af a place of business engaged in wrecking
or junkin� of motar vehicles.
(7) "Abandoned vehicle'R sh�.11 mean any vehicle which is left at any
place for such time and under such circumstarices as to cause such
vehicle reasonab`ly to appear to have been abandoned.
Section 2s ABAIV'DOP�NT 0�' �EHICI.�k�S. IVo person shall abandon any vehicle
within the City and no person shal.l leave any vehicle at any place within the
City for such time and under such circumstances as to cause such vehicl� reason-
ably to appear to have been aba.ndoned.

person shall leave any partially dismantled, non-oper�ting, wrecked, or junked
vehicle on any street or highway in the City.
Seetion 4. TNOPERABLE V�',HIGLES DECLAF�;D Ta E� A NUISANCE. Inoperable
motor vehicles� as defined herein, whether on public or private property, ars
hereby declared to be �. nuisance.

Seetion 5. A11 persons are required to dz.spose of any inoperable motor
vehicles under their control upon written notice received from the corporate
authorit3.es or from the Chief of Police or any member of his department desig-
nated by him comm�anding such disposition of said inoperable motor vehicle.
Section 6. IMP�UNDING. The Chief of Police or any member of his Aepart-
mant designated by him is hereby authorized to remove or have removed any
vehicle left at any place within the City which reasonably appears to be in
violation of this Ordinance or which reasonably appears to be lost, stolen or
unclaim�ed� or which is an inoperable vehicle as defined herein. Such vehicle
shall be impounded until lawfully claimed or disposed of in accordance with
Chapter 1�A, Illinois Vehicular La.w� 1957, as amended.
Section 7. SEPARABTLITY OF PROVISCQN. If any provision, section, sub-
section� sentence� clause or phrase of this Urdinance shall for any reason be
adjudged or declared by any Court of competent jurisdiction to be unconstitu-
tional or 3nvalid, such judgment oi• decision shal]. not affect the validity of
the rema.ining portions of this Ordinance� but shall be confined in its operations
to the provisions� seet3on, subdiva.sion, subsectiox�, sentence, elause or phrase
which shall have been adjuclged or declared to be unconstitutional or invalid in
such �ud�ment or decision; and it is hereby expressly declared that evexy other
provision, section, subsection, subdivision, sentence, clause or phrase thereof
would have besn ena,eted irrespective of the enactment of the validity of the
portion thereof deelared to be unconstitutional or invalid.
Sect�on 8. PENALTI�:S. Any person violatin� any of the provisions of
this Ordinance shall be deemed guilty of a misdemeanor and upon conviction
thereof shall be fined in an amount not exceecling �500.00. Each day such viola-
tion is committed or permitted �o continue shall constitute a separate offense
and shall be punishable as such hereunder.
Section 9. EFFECTIVE DAT�;. This Ordinance shall be in force and effeat
ten days after its passage by the City Council, approval by the Mayor and pub-
lication according to 1aw.
