AN ORDINANCE PREPARED AND TRANSMITTED AND ITS PASSAGE RECOI�II�fENDED
BY THE BOAR.D OF LOCAL IMI'ROVEMENTS OF THE CITY OF CANTON, ILLINOIS,
PROVIDING FOR THE LOCAL IMPROVEMENT OF CERTAIN PORTIONS OF WEST VINE
STREET IN THE CITY OF CANTON, ILLINOIS, FORMING A CONNECT�:D SYSTEM
OF PAVE�IEN'T AItiTD DESIGNA�'E➢ "CANTON PAVEMENT AND BRIDGE (OVER BIG
CREEK) IMPROVEMENT N0. 6$-B."
BE IT ORDAINED gY THE CITY COUNCIL OF THE CITY OF CANTON, ILLINOISt
Section 1. ESTABLISHMENT, ETC. That a local. improvement be and the same
hereby i� originated to be made by special assessment within the City of Canton�
Cotuity of �lton and State of Illinois, as provided by Article 9� Division 2,
of the Illinois Municipal Code, to be known as "Canton Pavement and Bridge
Improvement N9. 68-B" 3'he nature� charaater, location� gxtent, and estimated
cost of which local improvement is as follows, to-wit:
That the roadwey of the street hereinafter described be improved by the
construction of a 1-1/2 inch Bituminous Concrete Binder Courae and a 1 inch
Bituminous Concrete Surface over existing Concrete Pavement and proposed Port-
land Cement Concrete Base Course Widening and on new C�ravel or Crushed Stone
Base Course, Type A. Combination Curb and Crutter together with necessary drainage
struetures and appurtenanee. Also the construetion of s three (3) span (1 � 31"
and 2 � 2/�.") Reinforeed Conerete continuous Slab Bridge over Big Creek.
That the pavement herein provid.ed to be construeted on West Vine Street
shall be unifortnl.y 36.0 fest in width as measured betw*een front face of curbs
f'rom Main Street to West Cor�orate Limits.
In all respects the canstruation shall conform to the requirements as set
forth in the "Standard Specifications for Road and Bridge Construction" pre-
parsd by the Department of Public Works and Buildings o#' the State of Illinois
and adopted by �aid Department Januaxy 2, 195g, and re�tisions and add�.tions
thereto Khich are now on file in the offiee of the City Clerk of this City.

That the neceasary storm water inlets, storm sewers and appurtenances for
�.vement draina.ge be constructed along the �ines of the improvement.
That the removal of existing cateh basins and inlets shall fnelude ex-
cavatioz� and backfilling.
That all necessary exeava.tion� �rading� shaping and compactir�g of the sub-
grade preparatory to placement of the pavement and curbing be done� which ex-
cavation and grading to include the remaval of all earth, oil surface, walks,
culvert pipes and other obstructions of whatever na.ture within the pavement artd
eurbin� area, the removal of which is necessary for the construction of the
proposed improvement.
That where abutting sidew!e,lka do not meet the �rades of the proposed eurbs,
said aidewalks ahal.l be made to conform to the proposed improvement grade by
takin� up the requ3.red amoutat of such existing s3dewalk and replaeing an equal
kind and quality of same to conform to the proposed improvement grades and make
a neat and aerviceable �unction.
That the park�raya alon� the line of the proposed curbs sha11 be graded and
sinoothed to the top of the proposed curb gt•e�.de on a back slope not exceeding one
vertical to three horizontal.
That the total cost of the improvement, including all necessary labor�
materials� machinery� tools and equipment� for the I,ocal Improvement in the
said City of Canton� Illinoia, is the sum of �150,735.08, Which said estimate
is itemized arld is attached hereto and made a part of this Ord3.nance by refer-
ence thereto.
That a more detailed deseription of the matters heretofore recited� refer-
ence is hereby �de to the plans, profiles and drawings hereto attached, which
plana, profiles and drawin�s are hereby� made expressly a part of this Ordinsnee.

That all elevation$ and grades of the center line of the fin3shed improv�-
ment, the top of the fi.nished curb� the storm water inlets, valve ma.nholea� and
necessary ad�ustmen� to gra.des shall conform to and be identiaal with the eleva-
tione and grades as shown by the plans, specifications and profiles bearing
date of September 1, 1965, revised November 1 , 1967� prepared by Crawford,
Murphg and Ti11y, Consulting Engineers, of the City of Springfield� Illinois�
and now on file in the office of the City Clerk of the City of Canton, I1linois�
and made a part of this Ordinance by reference as though �et out herein in full�
a copy of such plans, specifica�tions and profiles being attached hereto. That
9uch grades and elevations are shown in said plans, apecifications and prof3lee
being attached hereto. That such grades and elevations are shown in said ple.ns,
specifications and profiles and are measured in feet and decimal parts thereof
and are determined from a bench mark� the location of which is shown on said
plans, apecifications and prof3les.
Section 2. DEFINITIONS. That whenever the worda defined below are uaed
in the Ordinance or in the specifications hereto attached and made a part hereof,
or in any proceedings relative to the 3mprovement herein provided for� they shall
have the following meanings:
"State" shall be interpreted to mean the City of Canton, Illinois;
"Department of Public Works and Buildinga" sha11 be interpreted to mean
the Board of Local Improvements of the City of Canton, Illinois;
"Engineer�' shall be interpreted to mean the engineer employed by the
City of Canton, Illinois;
"State Treasurer of Illinois" shall be interpreted to mean the Gity
Treasurer of Canton, Illinois;
"Contractor" ahall be interpreted to mean the person, firm or cor-
poration to whom the work or contract for this improvement is awarded
and the a�ents, ass3gns and employees thereof.
Section 3. APPROVAL OF PLANS, ETC. That the ma.ps, plans and specificationa
for this improvement� hereto attached, and hereinbefore referred to are hereby

approved and made a part of this Ordinance the same as if ineorporated 3.n this
Ord3nance 3n fu11. In case of conflict with the parts of said specifica,tiona
and special provis3ons, �he special provisions shall control.
Section 4. SUPERVISION. That all the aforesaid local 3mprovement shall
be under the supervision and direetion of the Board of Local Improvementa of
the City of Canton, Illinois.
5eetion 5. RECOt�'Il�IENDATION APPROVED. That the Recommendation of the Board
of Local Improvements of the City of Canton, Illinois, recommending and providing
for the aforesaid local improvement, together with the Estimate of the Cost thereof,
as made and 3tsm�.zed by and over the signature of the Engineer of said Board� both
attached hereto, be and the same are herebti� approved� and made a part hereof the
same as if they were inearporated herein in full.
Section 6. ASSESSMENT, ETC. That said Local Improvement ahall be made and
the cost of said looal improvement being the suzn of �150,735.0$, as shown by the
estimate of the Engineer of said City of Canton, Tllinois� attached hereto and
made a part hereof� including the sum of �,532.17 being the amount included
in the estimate of said engineer as the cost of making� levying and collecting
the asaessment therefore, the court costs, attorneyg' fees and the lawf'u1. expenses
attending the sa�e, shall be paid by speeial assessmenty to be levied upon the
eontiguous property specifically to be benefited to the amount that the sams may
be legally as�essed therefore in accordance with the provisions of an Aat of
the General Assembly of the State of Illinois, entitled "Illinois Municipal Code"�
Article 9, D3viaion 2� approved N1a,y 29� 1961 , in force July 1 , 1961 , and acts
amendatory thereto (S'�ni.th-Hurd Sta.tutes of Illinois, 1967� Ch. 24., Sections
9-2-1 to 9-2-1/,.1+, bo�h inclusive). That the said sum of �8,532.1'7 shall be ap-
plied towa,rds the paying the lawful expenses of making, levying and eollecting
the said assessments and the court costs, attorneys' fees and lawful expenses
attending the same�as provided by law.

Seetion 7. INSTALLMENTS. fihat the aggre.�a.te amount herein ordered to be
asseased against the property and each lot, piece, traat or parcel to be assessed,
and the amount to be asaessed, if any, against the City of Canton, Illinois, as
and for public benefit, shall be divided into ten (10) annual insta,llments ao
that alI installments shall be equal in amount except that all fra.ctional amounts
�hall be added to the first installment so as to leave the rema.iMing installments
of the aggregate equal in amount and each a multiple of one Hundred Dollars (�100.00);
�aid first installment shall be due and payable on the seoond (2nd) day of January
next after the date of the first voucher issued on aecount of work done on said
improvement� and the second installment one year after� and so on annually until
all of the aa3d installments are paid, and all of said installments sha11 bear
interest at the rate of five per centum (5�) per annum, from the date of the first
voucher issued on account of work done on said izaprovement. And it is hereby made
the duty of t�he Board of Local Improvements to file in the office of the Clerk of
the Court in which said asseeament is confirmed a certificate aigned by it� secre-
tary of the date of said first voucher and the amount thereof within thirty (30)
days after the isaua.nce thereof.
Section 8. BOND5. That for the purpose of anticipating the collection of
the second and suaceeding installments of said apecial assessment for said loca,l
improvement� bonds shall be 3ssued payable out of the aforesaid installmenta�
bear3.ng intereat at the ra,te of five per centum �(5�) per annum, payable annually,
and said bonds shall be si�ned by the Mayor, President of the Board of Loc:a]. Zn�
provements, of the Qity of Canton, Illinois� attested and countersigned by the
City Clerk of said City, under the corporate seal of the said C3ty of Canton,
I113no3s� and said bonds shall be issued in the aurns of one hundred dollars (�100.00)
each� or some multiple thereof, and ghe,ll be dated and draw interest from the date

of the issuing the sam�e, except when issued in exchange for vouchers heretofore
isaued in payment of work, then said bands shall bear interest from the same date
as the voucher for whieh they were exchanged or the date to which interest was
last paid on said vouaher. Intereat coupons attaehed to the bonds shall bear
faosiatile signatux�es of the same officers who aigned the bonds and shall be pa.y-
able at the office of the City Treasurer. Said bonds shall be iasuefl in accord-
ance with and in all reapects pursuant to the provisions and requirements of an
Aet of the Ge�eral Assembly of the State of Illinois, entitled "Illinoia Municipal
Code"� Article 9, Division �, approved May 29, 1961, in force July 1 , 1961, and
all aats a�endatory thereto. (Smith-Hurd Statutes of Illinoia, 1967, Ch. 24,
Sections 9-2-1, to 9-2-14�i., both inclusive).
Seetion 9. PROCEDURE. That the Mayor of the City of Cantan, Illinois, on
behalf of the said City is hereby directed and instructed to file a Petition in
the Cireuit Court of the Ninth Judicial Circuit of Illinois, Fulton County� In
the name of the City of Canton, Illinois, praying that stepe may be taken to levy
a special assessment for the said improvement in accardance with the g�ovisions
of this Ordinance and in the mattner prescribed by law.
Section 1b. GENERAL PROVISIflNS. That all actions taken in and based an
this Ordinanee is and ahall be under and pursuant to the terms and provisions of
an Act of the General Assembly of the Sta,te of Illinois entitled "Illinois Munici-
pal Code" Article 9, �3,viaion 2, Sections 9-2-1 to 9-2-1/.,�., both inclusive� ap-
proved May 29, 1961, in force July 1, 1961 , and al1 �dditions and acts amendatory
thereto. (Smith-Hurd Statutes of Illinois, 1967� Ch. ?..4., Sections 9-2-1 to
9-2-144, both inclusive.)
Seetion 11. REPEAL. That all ordinances and parts of Ordinances 3.n any
way conflicting uith this Ordinanee� be� and the same are hereby repealed.

Section 12. WHEN EFFECTIVE. This Ordinance shall be in full force and
effeat from and after its passage by the City Council and approval by the l+�a.yor
aecording to 1aw.
PASSED by the City Council of the City of Canton, Illinois, and signed and
approved by the Mayor of said C3ty and deposited in the office of the Clerk of
