AN ORUINANCE �;STABLISHING SALt�RIES AND YtZOVIDING FOR CERTAII3 BENEFITS FOR
CERTAIN EMFLUYEES CF THE CITY OF CANTON, ILLINOIS �'OH THE FISCAL YEAR
COMMENCING MAY, 1975•

WHEREAS, it is thought by the cor�orate authorities of the City of
Canton, Illinois that an Ordinance setting forth not only rates of pay
for certain employees of said City but which also outlines and defines
certain other benefits for such employees and which, as well, enunciates
the policy and outlook of said City with respsct to such employees would be
of benef.it to all concerned; and,
WHERE!�S, and further, it is the intent of said corporate authorities,
hereby promulgated, that there shall be dignity and reasonable stability
in relation and attitude towards all employees of said City,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CANTON, ILLINGIS, AS FOLLOGdS:
Section 1. That this Ordinance may be referred to as the "Employment
Ordinance'� of the City of Canton, Illinois.
Section 2. That the followin� words or phrases, as used herein, shall
have the following meanin�s, to-wit:
a. "Employer" shall mean the City of Canton, Illinois.
b. "Employee" shall mean a person, other than appointed or elected
official or department head, who does work for or renders services to the
employer and who is paid therefor at weekly intervals.
c. "Department head'� shall raean either the Fire Chief, the Police
Chief, the Superintendent of the City Water Works, the Superintendent of
the Waste Water Treatment Plant; the Superintendent of Streets and Alleys,
or the Plumbing Inspector, as the context requires; and shall also have
r�ference to several or all of them when used in the plural, as the context
requires.
d. "Full Time Employee" shall mean and have reference to an
employee of the employer who re$ularly works a minimum of 40 hours per
week in a particular work category established by the employer and which
has subsisted as such a work cate�ory utilizing the services of an em,��loyee
for a minimum of 40 hours per week for each week of the preceding fiscal
year of the employer and wherein the need for continuous like services is
anticipated in the foreseeable future.

e. "Part-time Employee'� shall mean and have reference to an
employee of the employer who regularly works a minimum of 34 hours (but
not as many as 40 hours) per week in a particular work category established
by the em�loyer and which h-�s subsisted as such a work cate�ory utilizin�
the services of an employee for a minimum of 34 hours (but not as many as
40 hours) per week for each week of the preceding fiscal year of the employer
and wherein the need for continuous like services is anticipated in the
foreseeable future.
f. "Temporary Employee" shall mean an employee whose services
in any work category established by the employer are expected to be of short
duration and wherein the need therefor is casual or intermittent.
g. "Seniorty" or variations of this word shall have reference to
the continuous service of a full time em�?loyee within the DeNartment of his
employment unless otherwise specifically defined.
h. "Service" or variations of this word shall have reference to
the continuous service of a full time em�loyee, whether within the Depart-
ment of his current employment or nc,t, unless otherwise specifically defined.
i. "Probation Period" or variations of these words shall mean
and have reference to that 6-month p�riod of employment immediately
following the initial employment of any employee of the employer execpting
of tem�orary employees or employees who are members of either the Fire or
Police Departments of the City; with respect to any employee who is a
member of either the Fire or Police Department of the City they shall mean
and have reference to that one-year period of employment immediately follow-
ing the initial employment of such employee as a member of either of these
Departments (as a Fireman or Policeman, as the case may be.) Any applic-
able t�robation period shall have as its incident and sha11 be considered
a period of test or trial for the employee in his relations to his work
and to his employer durin� which time the em�loyee may be discharged by the
employer without stated reason or cause.
j. "Regular Pay" (or salary) shall mean the basic weekly salary
plus all money additives thereto which shall be applicable to any full
time employee as hereinafter provided; or, if the context requires, it shall
mean the b�sic weekly salary of a Department Head or the weekly pay ��ro-
vided for a particular appointive position.

Section 3. FULL TIME EMPLOYEES.
a. The following provisions are applicable to all full time
employees: A basic weekly salary, b3sed on 40 hours actually worked,
shall be paid to each full time em:nloyee in the amount of $190.53 per week.
The sum of $2.00 per week shall be added to the basic weekly salary of each
such employee commencing with the first 40 hours worked by such an employee
following completion of any applicable period of probation for service
within the department. A further sum of �2.00 per week shall be added to
said basic weekly salary commencing with the first 40 hours worked by
such an employee following ccmpletion of four years service within the depart-
ment.
b. The following provisions shall be applicable to particularized
full time employees and in addition to the provisions of the preceding
paragraph.
1. POLICE DEPARTMENT:
1. ADDITIONS TO BASIC WEEKLY SALARY: To the basic weekly
salary of the senior patrolman (other than the Sergeant in charge) on each
shift ss�all be added and paid the further weekly sum of $4.00. To the basic
weekly salary of each Police Sergeant shall be added and paid the further
weekly sum of y�21.06. To the basic weekly salary of each full time em�loyee
who is a member of the Police Department and subject to the rules and
regulations of the Fire and Police Commis+sion of this City shall be added
and paid the further weekly sum of �4.00.
2. CLOTHING ALLOWANCE: Each Police Officer, including
the Police Chief and Traffic Control Officer, shall be allowed and paid
a Clothing Allowance in the yearly sum of �225.00. Each full t.ime r4eter
Maid shall be allowed and paid a clothing allowance in the yearly sum of
$150.00. The sums herein pronided for clothin� allowance shall be paid in
advance at the commencement of the fiscal year of the City, or as near
thereto as prr�cticable.
11. FIRE DEPARTMENT:
1. ADDITIONS TO BASIC WEEKLY SALARY: To the basic weekly
salary of each Fire Truck Driver (each of whom is to be the senior em�loyee
on any particular shift) shall be added and paid the further weekly sum of
$4.00. To the basic weekly salary of each Assistant Fire Chief shall be
added and paid the further weekly �um of �21.06. To the basic weekly
salary of each full time employee who is a member of the Fire Department
and subject to the rules and regulations of the Fire and Police (�`ommission
of this City shall be added and paid the further weekly sum of �4.00.
To the basic weekly salary of each Lieutenant who is
regularly stationed at any sub-fire station of this City shall be added and
paid the further weekly sum of �12.53. To the basic weekly salary of each
Fire Truck Driver (each of whom is to be the senior employee on any
particular shift) who is regularly stationed at any sub-fire s'cation of this
City shall be added and paid the further weekly sum of �4.00.
2. CLOTHING ALLOWANCE: Each Fireman, including the Fire
Chief, shall be allowed and paid a Clothing Allowance in the yearly sum
of $155.00. The sums herein provided for clothing allowance shall be paid
in advance at the commencement of the fiscal year of the City or as near
thereto as practicable.
111. ASSIST�NT TO DEPARTMENT HEADS: Department Heads exceptin�
of the Fire and Police Departments and the �lumbing Inspector, may designate
a full time employee as an Assistant. S�ch an Assistant, in addition to
his basic weekly salary, shall be paid and receive an additional �4.00 per
week, provided, however, in the event the Department IIead is unavailable
and off d�_:ty for a continuous period of five calendar days, such Assistant,
upon certification by the Department Head, shall thereafter and during the
subsquent absence of the Department Head be ;:>aid the salary of the Department
Hedd and in lieu of the salary and money benefits he otherwise would have
been paid as hereinabove provided.
Section 4. I'ART-TIME EMrLOYEES. The followin� provisions are
applicable to all part-time employees: A weekly salary, from time to time
based on the total number of hours actually worked in a particular week,
shall be computed and paid at the rate of '�4.76 per hour to each �art-time
employee. Fbr the purposes of computing vacatioa pay, holiday pay and
sick pay the '�re�ular pay" of a part time employee shall be computed as a
weekly salary based on 3� hours of work at the hourly rate hereinabove
pronided.
Part-time employees who qualify as provided with respect to others
set forth in Section 8 of this Ordinance shall receive a nacation period
as therein provided. In such instance they shall receive their regular
pay (as above provided) for each week thereof.
Part-time employees shall be paid and receive a holiday pay as
provided in Section 9 of this Ordinance, provided, however, the pay therefor
shall coasist of 6.8 hours of regular pay (i.e. 6.8 hours computed at the
hourly rate abone provided.)
Part-time employees shall be entitled to and shall receive a sick
pay as provided in Section 11 of this Ordinance, provided, however the
maximum sick pay to be paid on account of any single fiscal year shall be
S�l�m�e 6.8 hour days computed at the hourly rate above provided.
"s�� Section 5. TEMPORARY EMPZOYEES. A temporary employee shall be paid
and receive an hourly wage of not less than �2.50 per hour nor arore than
�4.00 per hour for each hour actually worked in any applicable week.
The hourly rate to be paid such an employee shall be as from time to time
determined by the applicable Department Head, Committee Chairman and the
Mayor.
Section 6. DEPARTMENT HEADS: The basic weekly salary of each
Department Head, to be paid weekly,is the sum of $254.34. This City recognizes,
howener, that Department Heads, by reason of mana�erial responsibilities
and duties transcend those of other employees, may sometimes be required
not only to perform services over ccntinuous periods of time considerably
in excess of 40 hours in any one week, but scmetimes may be required or
expected to perform services on holidays, at odd times, on daqs off, during
nacation periods, or at various other and unexpected times and under emergency
or unusual conditions. Accordin�ly, and within reason, it shall be the �oiicy
of tYiis City that such demands for services by Department Heads shall be
recognized by the corporate authorities of this City and that reasonable
adjustments and consessions therefor, both in money payments and as otherwise
may be fair and suitable in particularized instances, shall from time to
time be con�idered and made, provided, however, that any such ad�ustments
shall be in the sole discretion of the corporate authorities of this City
and� further, that nothin� herein contained shall be construed as an
inducement, promise or obli�ation running from the employer to any Depart-
ment Head.
In the interpretation of the para�raph immediately preceeding it is
hereby declared specifically and with emphasis that the spirit and prin-
ciples of all ��rovisions of this City haeing to do with vacation pay�
holiday pay, night time bonus �nd sick pay, to�reth�r with the concept
of reasonable and periodic time off from the demands of duty and employ-
ment, applies to Department Heads.
Accordingly, in the im��lementation and application of the provisions
of the two paragraphs, immediately preceeding it shall be the DUTY of each
Department Head to make weekly report of the circumstances of his employment
(whether by him deemed unusual or not) to the Chairman of the approp-
riate Committee of this City, charged with immediate concern for and over the
Department of his employment, who is hereby authorized and directed to
make such immediate adjustments of salary and conditions of employment as
may be consonant with the intention and sp:irit of said para�raphs, provided,

Section 7. A�'POINTIVF POSITIONS. The following positions or offices
shall be filled by appointment of the Mayor, with concurrence of the City
Council, and the annual salary to be paid to the appointee for each such
position or office (to be paid in 52 equal weekly installments) shall be
as indicated: One Radio Operator, �9088.79; one Radio Operator, $9088.79;
one Radio Operator, �9088.79; one part time Radio Operator, �2044.07; one
Radio Operator-File Clerk, �9088.']9; one Assistant File Clerk, $738g.10;
one Care Taker (Police Department) $2185.34; one City Attorney (part time) ,
$8911.40; deputy City Clerk not to exceed �4247.72; one Secretary to the Mayor,
�8195.00; one Maintenance Supervisor, �12,557•36; one Buildin�s Custodian,
�7864.32; one Meter Maid, �7864.32; one Meter Maid $7864,32; one Traffic
Control Officer, $9600.18; and, one Water De�artment Cashier, �9488.85.
To the weekly salary of each of the three Radio Operators
(other than part time Radio Operator) , that of the Radio Operator-File
Clerk and that of the Traffic Control Officer, shall be added and paid
the further weekly sum of `�5.00.
Each of the three Radio Operators (other than part time Radio
Operator) and the Radio Operator-File Clerk shall be allowed and paid
a clothin� allowance in the yearly sum of $100.00. The sums herein pro-
vided for clothing allowance shall be paid in advance at the commencement
of the fiscal year of the City or as near thereto as prac�icab3:e.

To the weekly salary of each employee filling an appointive
position who regularly works 40 nours each week shall be added and paid the
further weekly sum of $2.00 commencing with the first 40 hours worked by
such an employee following ccmpletion of his l�,robation period. A further sum
of $2.00 per week shall be added to the weekly salary and paid to such an
employee commencing with the first 40 hours worked following completion of
four years of continuous service as such an employee.
Section 8. VACATION PAY: Each full time employee, oFficial
officer, Departarent Head (including persons filling an appointive position) oP
the City of Canton, Illinois� who qualifies therefor as hereinafter provided,
shall receive a vacation period, consisting of one or more weeks, as here-
inafter provided, with 40 hours refular ,,ay for each such week and as may be
applicable to any such person, provided, however, that such person shall not
perform his regular work or render his re�ular services for the City during
any such vacation period or part thereof. The vacation period or periods,
hereinafter set forth, shall accrue by way of entitlement only after contin-
uous service to the employer for the entire lesser period in each instance
named. Further, for the purpose of computing vacation entitlement, continu-
ous service with the employer (as distinguished from sernice within a Depart-
ment) shall be counted. The vacation period hereby provided for such service
of not less than one, nor more than three calendar years, shall be two
weeks; for not less than three years, nor more than ten years, three weeks;
for not less than ten years, nor more than fifteen years, four weeks; and,
for any period in excess of fifteen years, five weeks. Vacation periods
a►ay not be accumulated and must be used during the fiscal year of the City
during which the entitlement arises unless otherwise expressly provided by the
corporate authorities at a regular meeting.
Section 9. HOLIDAY PAY. Each full time employee, official,
officer, Department Head (including persons £illing an appointive position)
of the Cit9 of Canton, Illinois shall be paid and receive a "Holiday Pap"
consisting of, each instance, eight hours re$ular pay applicable to each such
persoa, for eaeh of the following seven holidayx to-wit: New Years Day;
Memorial Day; Fourth of July; Labor Day; Veterans Day; Thanks;iving Day;
and, Christmas Day; provided, however, that such employee, official or officer
be employed by the City both before and after the az�plicable holiday for which
payment is herein provided. In the event any such employee, official or
officer actually works an ei�ht-hour period on any of the holidays herein
named as a part of his .regular work week, such person shall be paid and

receive a yet additional pay therefor consisting, in each instance, of eight
hours regular pay applicable to each such person. The calendar day on which
each such holiday falls and for which payment is to be made as herein pnv-
ided shall be as provided by law, or in the absence thereof, by custom.
For the purpose of clarification, the intent of the foregoing
is that each such employee shall receive h:_s re;ular pay for each named
holiday if not worked. Triple, if worked. Department Hea�s, however, shall
not work except in emergency or necessitous circumstances which cannot be
circumvented.
Section 10. NIGHT TIME BONUS. Each full time employee, official,
officer or Department Head of this City, excepting of inembers of the Fire
Department, who works a regular ei�ht-hour night shift as a part of his
regular work week, shall receive and be paid an additional increase in his
basic weekly salary in the amount of one-fifth of two per centum thereof for
such ei�ht-hour ni�ht shift actually worked. For the purpose of this Section
the term "night Shift" shall mean any regular ei�ht -hour period actually
worked between the hours of three o'clock in the afternoon of any day and
eight �' clock in the mornin� of the day thereafter immediately succeeding.
Section 11. SICK PAY. Each full time employee, official, officer,
Department Head (including persons who work in full time appointive positions) ,
shall be entitled toand shall be paid, during the fiscal ,year of the em:�loyer,
a sick pay. Time off taken for personal reasons shall be construed to be
within the meaning of and encompassed by the term "sick �ay". The maximum
sick pay to be paid by the employer to any employee on account of any single
fiscal year of the �mployer shall be: Six 8-hour days of re�ular pay (i.e.
six-fifths of the basic weekly salary, based on 40 hours actually worked,
plus additivies, in the case of full time employees; six-fifths of the basic
weekly salary of Department Heads; or, six-fifths the weekly sal�+ry of full
time appointive positions (to�ether with additivies if applicable) . In the
event this sick pay is not paid to the individual during the current fiscal
year on account of actual illness or actual personal time off for personal
reasons, the same shall be paid at the commencement of the ensuin� fiscal
year of the employer or as near thereto as practicable.
Computation of sick pay for an employee newly hired as a full time
employee, whether for the fir.st time or after a break in service with the
City, shall be computed with reference to the fiscal year of the City. Thus,
the sick pay entitlement of such an employee shall consist of that percent of
the maximum sick pay (hereinabov� provided) which his length of service in
the fiscal year of his hiring bears to the entire length of such fiscal year.
Em1�loyees of the Fire and Police Department who are under the
control of the Fire and Police Commission of the City shall be entitled to
and receive one additional sick day to that hereinabove provided, subject,
howener to the following limitations: This sick day may be utilized only
after the six dafs hereinabove provided have been used and shall be without
pay. Further, in the event an employee utilizing such day is called for
emer$ency duty on such day, he shall be paid for such emergency duty at
his straight time rate.
The sick pay hereinabove provided shall be paid only after
presentment to the Clerk and Treasurer of this City of a voucher or certif-
icate of verification si?ned b�- the applic�ble Department Head and counter-
signed by the applicable Committee Chairman manifesting the entitlement of the
particular employee to the sick pay claimed. A Department Head shall si$n
his own noucher and on his own behalf and this, as to him, shall be sufficient
when countersigned by the Committee Chairman.
Section 12. INSURANCE. The employer shall pay for and on behalf
of its �articipating employees, including elected and appointed Officers
and em�loyees, all applicable premiums under the �roup insurance pro�ram
presently in force between the employer and the existin� �ro .p insurer; in
addition thereto, the employer shall pay for and on behalf of such particip-
ating employees who� may hereafter become retired and who is entitled to
monthly benefits under a pension plan of the employer, commencing at his age
of �years, all applicable premiums of his under said group insurance
plan, pronided, however, such an employee, if first hired after May 2, 19?Z,
must have retired with a minimum of 15 years service with the City, and
provided, further, however, the amount so $aid for and on behalf of any such
retired employee shall not exceed �25.00 per month.
Section 13. NEW EMPLOYEES-YHYSICAL EXAMINATION. All persons
seeking employment with the City, other than elected or appointive personnel,
not otherwise required to �ake a physical exsmination, who, by reason of their
anticipated employment, would be qualified to participate in the insurance
pro�ram of this City, shall, prior to and as a condition of employment,
at their own expense, take and pass such ph�rsical examination a� may from
time to time be prescribed by the insurance carrier of this City or, if none,
as shall be prescribed by the corporate authorities of this City.
Section 14. COST Gr� LIVING ALLOWANCE. Each employee of this City,
excepting of elected officials and temporary employees, shall receive and be
paid a cost of livin� allowance computed on and with respect to the weekly
salary of each such employee and the same shall be taken in account in the
computation of vacation pay, holiday ��a,y, sick pay, or any specialty payment
right, including overtime . The amount �f the cost of living allowance shall
be determined and re-determined on the basis of the Consumer Price Index for
Urban Wage Earners and Clerical Workers (Includinb Single Workers) published
by the Bureau of Labor Statistics, United States Department of Labor,
referred to herein as the "Index'; �ontinuance of the cost of living allowance
shall be contingent upon the availability of the Index in _i.ts present form.
Determination and application of the cost of livin� allowance shall be made
in the following manner, at the followin$ times, and for application in the
following way:
MAn�NER OF DETERriINATION: The cost of livin� index shall be .12¢
per hour as of May 1, 19?5. The cost of livin� allowance shall consist of
1Q per hour added to the regular aver•age hourly wame of each quslifying
employee for each three-tenths of one percent rise in the cost of living
index which occurs over the reference index mentioned above.
TIME OF DETERMINATION: The cost of living allowance shall be
determined by the corporate authorities at the be$innin� of each quarter
(or as near thereto as practicable) of the fiscal year of the City excepting
of the first.
TIME CF PAYMENT OF COST OF LIVING ALLOWANCE: The cost of living
allowance, as determined, shall be paid for at the quarters of the fiscal
year of the city, in each instance commencin� as early in the ay�plicable
quarter as practicable.
Section 15. INTERPRETATION: This Ordinance represents the le;risl-
ative determination of the corporate authorities of the City of Canton
Illinois and is not contractual in its impact and the interpretation hereof,
in the event of ambiguities or questions of application, accordingly, shall
be in the sole discretion of such authorities.

Section 16. EF�'�CTIVE DATE. The provisions hereof shall be and
become effective on the first Monday in May, 1975-
