AN ORDINANCE RE-ZONING REAL ESTATE FROM R-4 to B-2 GENERAL
COMMERCIAL DISTRICT.
WHEREAS, an application for Re-zoning was filed with the City Clerk of the City of
Canton by Chris W. Walters ("Petitioner"), as owner of certain real estate legally
described hereinafter (the "Property"); said Property being located within the corporate
limits of the City of Canton; legally described as,
A part of Lot Number One Hundred Twenty-three (123) in Swan's Second
Addition to Canton, Fulton County, Illinois, described as follows:
Commencing at a point on the south line of said Lot 123, 76 feet West of
the Southeast corner of said Lot 123, which said point is also 88.95 feet
West of an iron pin focated at the Northwest intersection of East Locust
Street and North Second Avenue; running thence West along the South
line of said Lot 123 a distance of 62 feet to the West Face of a concrete
wall now located on said Lot 123; thence North along the West Face of
said wall 106.5 feet; thence East 62 feet to a point 106.5 feet due North of
the place beginning; thence South 106.5 feet to the place of beginning;
All situated in the County of Fulton and State of Illinois.
WHEREAS, the present zoning of said Property is R-4 and was requested by Petitioner
that the zoning of said Property be changed from R-4 to B-2, General Commercial
District, to allow commercial operations thereon.
WHEREAS, a public hearing was held by the Planning and Zoning Commission of the
City of Canton (the "Commission") on April 14, 2014, with no objections being heard or
written protests having been filed with the City Clerk or Petitioner; and
WHEREAS, the Planning and Zoning Commission of the City of Canton has approved
all findings of fact supporting the re-zoning requested by Petitioner and recommended
to the City Council of the City of Canton that Property be re-zoned from R-4 to B-2
General Commercial District, pursuant to the statutes and ordinances made and
provided; and,
WHEREAS, it is in the best interest of the City of Canton that the property be re-zoned
from R-4 to B-2 General Commercial District, as requested by Petitioner.
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF CANTON,
ILLINOIS AS FOLLOWS;
1. That the City Council hereby finds as fact the matters set forth herein above and
herby approves and incorporates by reference all findings of fact approved by the
Commission supporting the re-zoning requested by Petitioner.
2. That the property described as above be and the same is hereby re-zoned to B-2
General Commercial District, authorizing Petitioner to use Property for
commercial operations.
3. That the Zoning Administrator of the City of Canton is directed to make the
necessary changes to the zoning maps to properly reflect this re-zoning.
4. That Petitioner may record the Fulton County Clerk, ex officio Recorder of
Deeds, a certified copy of this ordinance.
5. That this ordinance shall be in full force and effect upon its passage by the City
Council of the City of Canton and approval by its Mayor.
Passed by the City Council of the City of Canton, Fulton County, Illinois at a regular
meeting of said council this 15t" day of April, 2014 upon a roll call vote as follows:
