AN ORDINANCE RE-ZONING REAL ESTATE FROM AG-1/PUD to B-2 GENERAL
COMMERCIAL DISTRICT.
WHEREAS, an application for Re-zoning was filed with the City Clerk of the City of Canton by
Ralph P. Sedgwick ("Petitioner"), as owner of certain real estate legally described hereinafter
(the "Property"); said Property being located within the corporate limits of the City of Canton;
legally described as,
(1) Tract 1: A part of the Southeast Quarter of Section 15, Township 7 North, Range 4 East
of the Fourth Principal Meridian, Fulton County, Illinois, more particularly described as
follows:
Beginning at a concrete marker at the southwest corner of Lot 24 in Golf View Villas -
Section One Subdivision, recorded as Document No. 0818730 in Slide 405, Fulton
County Recorder's Office; thence North 89 degrees 19 minutes OS seconds East, 352.73
feet (Bearings refer to the Illinois Coordinate System, West Zone, NAD 1983) along the
south line of said Golf View Villas - Section One Subdivision; thence South 00 degrees
40 minutes 55 seconds East, 460.50 feet; thence South 89 degrees 19 minutes OS seconds
West, 472.11 feet to the west line of FAP Route 22 (Illinois Route 78); thence North 02
degrees 14 minutes 43 seconds West, 20.55 feet along said west line; thence continuing
along said west line 527.98 feet along a curve to the right, whose radius is 5633.62 feet
and the chord of said curve bears North 00 degrees 26 minutes 23 seconds East, 527.78
feet; thence North 46 degrees 10 minutes 02 seconds East, 3.32 feet continuing along said
west line to projection of the south line of Cypress Road as shown on said Golf View
Villas - Section One Subdivision plat; thence North 89 degrees 19 minutes 04 seconds
East, 107.18 feet along said projection to the northwest corner of said Lot 24 in Golf
View Villas - Section One Subdivision; thence South 00 degrees 40 minutes 55 seconds
East, 90.00 feet to the Point of Beginning, containing 5.231 acres more or less.
Tract 2: Lots 21, 22 and 23, GOLF VIEW VILLAS - SECTION ONE, a planned unit
development, being a subdivision of part of the Southeast Quarter of Section 15,
Township 7 North, Range 4 East of the Fourth Principal Meridian, Fulton County,
Illinois.
(2) LOT 24 GOLF VIEW VILLAS - SECTION ONE, a planned unit development, being a
subdivision of part of the Southeast Quarter of Section 15, Township 7 North, Range 4
East of the Fourth Principal Meridian, Fulton County, Illinois.
WHEREAS, the present zoning of said Property is AG-1/PUD and was requested by Petitioner
that the zoning of said Property be changed from AG-1/PUD to B-2, General Commercial
District, to allow construction of buildings and parking for commercial operations thereon.
WHEREAS, a public hearing was held by the Planning and Zoning Commission of the City of
Canton (the "Commission") on October 14, 2013, with no objections being heard or written
protests having been filed with the City Clerk or Petitioner; and
WHEREAS, the Planning and Zoning Commission of the City of Canton has approved all
findings of fact supporting the rezoning requested by Petitioner and recommended to the City
Council of the City of Canton that the Property be re-zoned from AG-1/PUD to B-2 General
Commercial District, pursuant to the statutes and ordinances made and provided; and
WHEREAS, it is in the best interest of the City of Canton that the property be re-zoned from
AG-1/PUD to B-2 General Commercial District, as requested by Petitioner.
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF CANTON,
ILLINOIS AS FOLLOWS;
1. That the City Council hereby finds as fact the matters set forth herein above and hereby
approves and incorporates by reference all findings of fact approved by the Commission
supporting the re-zoning requested by Petitioner.
2. That the property described as above be and the same is hereby re-zoned to B-2 General
Commercial District, authorizing Petitioner to use the Property as parking and
construction of buildings for commercial operations.
3. That the Zoning Administrator of the City of Canton is directed to make the necessary
changes to the zoning maps to properly reflect this re-zoning.
4. That Petitioner may record the Fulton County Clerk, ex officio Recorder of Deeds, a
certified copy of this ordinance.
5. That this ordinance shall be in full force and effect upon its passage by the City Council
of the City of Canton and approval by its Mayor.
