POLICE REPORT
Chief McDowell highlighted some of the information from the police report.
9-15-2013—The Arson at Swise Towing was solved within a few hours. The police department
worked with the fire department arson investigators to solve the crime. Commendation letter
was sent for firefighter Hanlin.
9-15-2013- Your police department, later the same day investigated a domestic situation
involving a firearm. No injuries occurred and the arrest was made.

ANNUAL REQUEST FOR SANTA PARADE/SANTA HOUSE- RESOLUTION FOR CLOSURE OF STATE
MAINTAINED ROADWAY.
A request was submitted for the annual Santa Parade to be held on November 30, 2013 at
10:00am. The Santa House will be set up from November 18, 2103 to December 28, 2013
Motion and second were made by Aldermen Pickel/Lovell to send the request to Council for
consideration.
The motion carried by voice vote and was unanimous.

DISCUSSION ON AN ORDINANCE CREATING A SEPARATE CLASS OF LIQUOR LICENSE FOR THE
SALE OF PACKAGED BEER AND WINE.
Motion to amend the Canton Municipal Code Title 3, Chapter 8, Section 4 adding a class H
(packaged beer and wine) that would authorize the retail sale for beer and wine in packages for
consumption off premises to businesses whose primary source of sales is anything other than
alcoholic beverages. Along with this would be a subclass HH supplemental license. The license
must be obtained for the offering of tastings on the premises of the licensee for free samples of
beverages sold by the licensee. The said license must be applied for and obtained annually.
This would limit any offering for tastings to not exceed two ounces. This must apply with all
liquor laws for the State of Illinois.
Motion and second were made by Aldermen Pickel/Lovell to send to Council for consideration.

Further discussion took place regarding the various classes of liquor license. Alderman Justin
Nelson expressed a concern about restaurants or other businesses applying for this new class of
license and then being able to sell packaged liquors.
Attorney Rabel reminded the Council that all requests for liquor licenses are sent to the liquor
commission. The commission has the authority to deny a request if they desire.
Motion and second were made by Aldermen Pickel/Lovell to amend the Canton Municipal Code
Title 3, Section 8, Chapter 7 for hours of sale. The motion is to include the Class H license in
this section for the hours of sale.

Motion and second were made by Aldermen Pickel/Ellis to amend the Canton Municipal Code
Title 3, Section 8, Chapter 8—License fee to add an annual license fee for six day class H
packaged beer and wine license shall be $1020.00. The seven day annual license fee would be
an additional $100.00.

to include the fee for this class for a wine tasting license. The annual fee will be $150.00 for a 6
day wine tasting license

RALPH SEDGWICK'S PETITION FOR RE-ZONING OF PROPERTY ON NORTH MAIN AND CYPRESS
FROM AG-1/PUD TO A B-2 ZONING CLASSIFICATION
Ralph Sedgwick filed a petition for re-zoning of property on North Main and Cypress from ag-
1/PUD to a B-2 zoning classification. Ralph plans to put a crematorium and funeral home on
the property. The planning and zoning commission recommends that the Council direct the
City Attorney to draft an ordinance regarding building code fine amounts.

STREETS &GARBAGE
ALDERMAN DAVE PICKEL, CHAIRMAN
Public Works Director Bill Terry announced that the leaf program will start on October 28, 2013.
The program will start with the Monday's garbage route and will continue with the regular
garbage pickup. The program will continue until snow begins to fall.

DISCUSS CONSIDER AND VOTE ON A DRAFT AGREEMENT BETWEEN THE CITY OF CANTON
AND TRUE VALUE
City Engineer Keith Plavec explained that the recovery agreement was approved at the last
Council meeting between Olive Branch Lodge and the City of Canton.
City Engineer Keith Plavec said that the previous City Attorney Chrissie Peterson had a file for
True Value with the following items highlighted.
* Terms (7 years beginning January 1, 2013 and ending January 1, 2020. This is
concurrent with the Odd Fellows Lease.
* Rental (Carter's shall pay the City of Canton fixed rental in the amount of $10.00 per
year
* Taxes (If taxes become due and payable during the lease then who is paying their taxes
The City or Carter's—the tax bill is currently$323.54 for the un-improved lot.
* Carter agrees not to make any alterations, additions or improvements in the premises
without written consent of the City.
Keith Plavec explained that this item needs to be moved along. The insurance on the lot would
need to be resolved. The rate of $10.00 per year would need to be agreed upon. Further
discussion took place regarding either raising the cost of the annual rent or having them pay
the property taxes.
Motion and second were made by Aldermen Pickel/Lovell to allow the annual lease of $10.00
per year. The lessee would be required to pay the property taxes. The insurance paperwork is
to be put into effect immediately.

UPDATE TO CANTON LAKE CAMPGROUND AND PLAYGROUND EQUIPMENT
Keith Plavec explained that the playground equipment was delivered this fall. The park district
would rather help install the equipment this week. There are several holes that will need to be
dug, so as long as the weather allows they will begin installing it later this week. The shelter
will be shipped on October 25, 2013. The intention is to install the shelter this fall. The
contractor will install the shelter.
PUBLIC WORKS, WATER&SEWER
ALDERMAN GERALD ELLIS, CHAIRMAN
APPLICATION FOR PAYMENT NO 4 FROM OTTO BAUM COMPANY IN THE AMOUNT OF
$69,112.71 FOR THE TRUE VALUE GARDEN CENTER IMPROVEMENTS
Motion and second were made by Aldermen Ellis/Lovell to send to Council for consideration
from the TIF funds.

INVOICE 0012214-IN FROM IRC, INC. IN THE AMOUNT OF $73,179.56 FOR 2013 MFT SEAL
COAT PROJECT
Keith Plavec explained that this includes work at Greenwood Cemetery. A few streets (oil and
chip) took place this year. The City will continue to look for cost effective solutions to maintain
City streets.

DISCUSSION OF FRESH FIRE CHURCH WATER BILL
Alderman Dave Pickel said he spoke to Pastor Vickie Riley about the past due water bill for
Fresh Fire Church. She would agree to change the water rates to in-town rates for future
billing. The past due amount would be reduced and they would agree to annex and keep the
bill current plus pay$150.00 additional each month. Pastor Vickie Riley just wanted a chance to
pay it off. If they get behind or miss a payment Council could vote to shut the water off.
Community Service Director Jason Strandberg did not recommend putting them on in-town
rates. Technically they should be paying the out of town rates. The previous administration
made the recommendation to change it to the in town rates.
Any agreement made would require the actual owner to be a party on.
Motion and second were made by Aldermen Pickel/Lovell to allow the extra payment of
$150.00 per month at no interest until the past due balance is satisfied in full. The rate will be
reduced to the in-town rate. The property will be annexed into the City.

THE ANNEXATION OF THIS PROPERTY WILL BE PUT ON THE NEXT LEGAL AND ORDINANCE
AGENDA
DISCUSS "NO PARKING" ON ASH STREET BETWEEN 15TH AND 16TH AVENUE
Keith Plavec explained that the crossing guard has noticed a few near misses with kids crossing
the traffic between 15th and 16th Avenue. The crossing guard gave a report to Chief McDowell.
This area was observed to see how the traffic flows. No parking would be allowed on the east
end...teachers typically park in this area. The principal is going to talk to the teachers about
parking in the actual parking lots. The proposal is to make no parking on the south side of Ash
between 15th to 16th. A few spaces would be blocked off at 40 feet of both sides of the
entrance. This was agreed upon by the police department, the principle, and the
superintendent along with City Engineer Keith Plavec and Public Works Director Bill Terry.

JUNIPER STREET STORM SEWER IMPROVEMENTS
Two bids were previously sent out for the Juniper Street Storm Sewer Improvements and the
recommendation was to reject the bids. Keith Plavec would like to look at the City crew for
some help and re-bid the project out in January or February. This would allow contractors to
get to it when the weather is better. This will be sent to the Council next week to formally
reject the bids.
