HomeMy WebLinkAboutOrdinance #3022 - amending title 1 (administration) adding chapter 24 (budget director) ~ ORDINANCE NO. 3022 ORDINANCE AMENDING TITLE 1(ADMINISTRATION) OF THE CANTON CITY MUNICIPAL CODE BY ADDING CHAPTER 24 (BUDGET DIRECTOR) TO THE CANTON MUNICIPAL CODE WHEREAS, the City has adopted the Budget System of Financial Planning and Management in accordance with 65 ILCS 5/8-2-9.1 et seq for preparation of the City's Annual Budget, and in so doing wants to create a"Budget Director" to exercise the authority granted by the state statute for this purpose, and; WHEREAS, the Negotiations, Grievance, and Personnel Committee has reviewed the proposed amendment and concur that they are necessary and in the best interest of the administration of the City of Canton, its employees and citizens, and; WHEREAS, the City Council has made a similar determination. NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, Fuiton County, Illinois, as follows: 1. That a new Chapter 24 (Budget DirectorJ is added to 7itle 1 (AdministrationJ of the Canton Municipal Code and is to read as follows: CHAPTER 24 BUDGET DIRECTOR 1-24-1: O~ce Created, Appointmenf, Term, and Quali~cations: A. There is hereby created an office of Budget Director. The Budget Director shall be appointed by the Mayor with the advice and consent of the City Council. The Budget Director shall be chosen on the basis of executive, administrative, and educational qualifications with special emphasis on the actual experience in, or knowledge of, accepted practice with respect to the office hereinafter set forth. B. The Budget Director shall have the same qualifications as the City Treasurer. C. To create a feeling of greater personai responsibility and to exhibit to the citizenry a sense of concern for the welfare of the City, fihe City Budget Director shall reside in the City during his/her tenure as the Budget Director. Neither the Mayor nor any member of the City Council shall receive such appointment during their term of office. 1-24-2: Ocrth; Bond: Any person filling and discharging the duties of the office hereby created shall, before entering upon the duties of such office, take and subscribe the oath prescribed by law for City Officials and shall execute a Bond to the City in accordance as provided in 65 ILCS 5/3.1-10-25 and 5/3.1-1 D-30 with surety to be approved by the Council, condition for faithfvl performance of the duties of his/her office. The Bond amount shall be in an amount as fixed by the City Covncil from time to time. 1-24-3: Powers And Duties: A. The Budget Director shall be responsible to the Mayor for the proper administration of all the budget affairs of the City. In discharging this responsibility the Budget Director shall conform to and follow the duties as prescribed in 65 ILCS 5/8-2-9.1 throvgh 5/8-2-9.9 of the Illinois Revised Statutes as amended from time to time including but not limited to the following: 1. Permit and encourage and establish the use of efficient pianning, budgeting, auditing, reporfing, accounting, and other fiscal management procedures in all municipal deparfments, commissions, and boards. 2. Compile an Annual Budget in accordance with Section 8-2-9.3. 3. Examine all books and records of all municipal deparfments, commissions, and boards which relate to monies received by the municipality, municipal deparfments, commissions, and boards, and paid out by the municipality, municipal departments, commissions, and boards, debts and accovnts receivable, amounts owed by or to the municipality, municipal deparfments, commissions and boards. 4. Obtain such additional information from the municipality, municipal deparfments, commissions, and boards as may be useful to the budget officer for purposes of compiling a municipal budget, such information to be furnished by the municipality, municipal deparfments, commissions, and boards in the form required by the budget officer. Any deparfment, commission or board which refuses to make such information as is reqvested of it available to the budget officer shall not be permitted to make expenditures under any subseqvent budget for the municipality until such municipal deparfment, commission, or board shall comply in full with the request of the budget officer. 5. Establish and maintain such procedures as to insure that no expenditures are made by the municipality, municipal departments, commissions, or board except as authorized by the budget. 1-24-4: Removal and Resignation The City Budget Director may be suspended or discharged by the Mayor in consultation with the City Council in accordance with state statute and according to the terms and conditions of the employment contract, if any. The City Budget Director may also resign from the position upon giving thirfy (30J days prior written notice to the Mayor. 1-24-5: Compensation The City Budget Director shall receive such compensation as the Mayor and City Council shall fix from time to time. The Mayor may, with subsequent ratification by the City Covncil, enter into an Employment Contract, which specifies in writing the level of compensation of the City Budget Director, fringe benefits, including the level of supporf for the City Budget Director's continuing professional education, agreements for separation pay upon termination of employment, other appropriate agreements describing the working relationship between the City Budget Director and the elected officials and the Mayor and Council's performance expectations for the City Budget Director. This agreement may be reviewed and revised by mutval agreement of the parfies at periodic intervals. 1-24-6: Conflict of Interesf Prohibited The City Budget Director shall not derive any personal benefit, directly or indirectly, from any contractual work or business of the City or from the sale of any arficle from the City or from the purchase of properfy therefrom. 1-24-7: Assistants The office hereby created shall be allowed such assistants and other clerks and subordinate help as the necessities of the office may require, and the City Covncil by Ordinance or Resolution shall from time to time authorize.
