A RESOLUTION DIRECTING DEMOLITION OF IMPROVEMENTS TO REAL
PROPERTY LOCATED AT 45 & 53 EAST SIDE SQUARE, CANTON, ILLINOIS
WHEREAS, that by reason of recommendations of the Fulton County Health
Department and Phillips and Associates, Inc. it has been made to appear that the
improvements at 45 & 53 East Side Square, Canton, Illinois, and more specifically
described as follows:
PARCEL 1:
Part of Lot 10 of Jones' First Addition to the City of Canton, situated in
Fulton County, Illinois, described as follows: Beginning at the Northwest
corner of said Lot 10, running thence East 182 feet to the East line of said
Lot, thence South 20 feet, thence West 104 feet, thence South 17 feet 4 %Z
inches, thence West 78 feet to the West line of said Lot 10, thence North
37 feet 4 '/2 inches to the place of beginning.
PARCEL 2:
Part of Lot 10 of Jones' First Addition to the City of Canton, situated in
Fulton County, Illinois, described as follows: Beginning at the Southwest
corner of said Lot 10, running thence East 78 feet, thence North 37 feet 4
inches, thence West 78 feet, thence South 37 feet 4 %2 inches to the
place of beginning.
PARCEL 3:
Apart of Lot 10 in Jones' First Addition to the City of Canton, situated in
Fulton County, Illinois, described as follows:
Beginning at the Southeast corner of said Lot 10, running thence North 70
feet and 9 inches, thence West 104 feet, thence South 17 feet and 4 %2
inches, thence West to the West line of said Lot, thence South 16 feet,
thence East 78 feet, thence South 37 feet and 4 %s inches to the South line
of said Lot, and thence East to the Place of Beginning,
is in a dangerous and unsafe condition and that said real estate is owned by Fulton Square
Food Center, Inc., c/o Leonard Lascoe and Capitol Recreation, Inc., c/o Eric Mathews.
WHEREAS, 65 ILLS 5/11-31-1 et seq., Illinois Compiled Statutes empowers
municipalities to demolish, repair and cause the demolition or repair of dangerous and
unsafe buildings; and further empowers municipalities to apply to the Circuit Court for an
Order to demolish, obtain a personal judgment for costs of demolition and the legal
action, and obtain a lien on said premises and to foreclose on same; and,
WHEREAS, the 15 day statutory notice has previously been given by City staff
pursuant to prior instructions.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Canton, Fulton County, Illinois that the building(s) located on the premises described
above is hereby declared to be dangerous and unsafe within the meaning of the Statutes
set forth in 65 ILCS 5/11-31-1 et seq., Illinois Compiled Statutes; and,
BE IT FURTHER RESOLVED that the Canton City Attorney be and he is
hereby authorized and directed to apply on behalf of the City of Canton to the Circuit
Court of the Ninth Judicial Circuit of Fulton County, Illinois, for an Order authorizing the
City to demolish said building, to obtain judgment for the costs of every kind, and to
attach a lien thereto and to foreclose the same.
PASSED by the City Council of the City of Canton, Fulton County, Illinois at a
regular meeting this 4th day of January, 2000, upon a roll call vote as follows:
AYES: Aldermen Molleck, Hartford, Sarff, Phillips, Nidiffer,
Meade, Shores, May.
NAYS: None .
ABSENT: None.
