HomeMy WebLinkAboutResolution #5559 - Authorizing Requests for Bids for the Purchase of 226 W. Spruce Street RESOLUTION NO. 5559 A RESOLUTION AUTHORIZING REQUESTS FOR BIDS FOR THE PURCHASE OF 226 W. SPRUCE STREET, CANTON, IL 61520 WHEREAS,the City of Canton, Fulton County, Illinois ("City"), is a non-home rule unit of government; WHEREAS, Section 11-76-2 of the Illinois Municipal Code (65 ILCS 5/11-76-2) provides, in part: An ordinance directing a sale, or a lease of real estate for any term in excess of 20 years, shall specify the location of the real estate,the use thereof,and such conditions with respect to further use of the real estate as the corporate authorities may deem necessary and desirable to the public interest. Before the corporate authorities of a city or village make a sale, by virtue of such an ordinance, notice of the proposal to sell shall be published once each week for 3 successive weeks in a daily or weekly paper published in the city or village, or if there is none, then in some paper published in the county in which the city or village is located. The first publication shall be not less than 30 days before the day provided in the notice for the opening of bids for the real estate. The notice shall contain an accurate description of the property, state the purpose for which it is used and at what meeting the bids will be considered and opened,and shall advertise for bids therefor.All such bids shall be opened only at a regular meeting of the corporate authorities. The corporate authorities may accept the high bid or any other bid determined to be in the best interest of the city or village by a vote of 3/4 of the corporate authorities then holding office, but by a majority vote of those holding office, they may reject any and all bids. The consideration for such a sale may include but need not be limited to the provision of off-street parking facilities by the purchaser, which parking facilities may be made part of the municipal parking system. Such consideration also may include the provision of other public facilities by the purchaser. WHEREAS, the City currently owns real estate commonly known as 226 W. Spruce Street, Canton, IL 61520; WHEREAS, the corporate authorities, by this Resolution, have determined that 226 W. Spruce Street, Canton, IL 61520 (the "Subject Property") is no longer necessary, appropriate, required for the use of, profitable to, or for the best interests of the City; WHEREAS,the corporate authorities have determined that it is in the best interests of the City to obtain bids from interested parties for the potential purchase of the Subject Property from the City. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF CANTON, FULTON COUNTY, ILLINOIS AS FOLLOWS: 1. The Legal Notice, substantially in the form as attached hereto as "Exhibit I", shall be published once each week for three (3) successive weeks in the Canton Daily Ledger. 2. The first publication of the Legal Notice shall be not less than 30 days before the day provided in such notice for the opening of bids for the Subject Property. 3. All person(s) submitting bids (the "Bidder") shall seal and submit their bids via personal delivery or by U.S. Mail to the City of Canton,ATTN: City Attorney,2 North Main Street, Canton, Illinois 61520. All bids will be opened at the regular meeting of the City Council on November 4, 2026 at 6:30 p.m. The bids will be opened during the meeting. 4. All bids to purchase all of the Subject Property shall include the following and be subject to the following conditions: a. Any party who is interested in acquiring the Subject Property shall submit a sealed bid for said acquisition on or before 5:00 P.M. on October 30,2026 via personal delivery or via U.S. Mail to the City of Canton, ATTN: City Attorney, 2 North Main Street, Canton, Illinois 61520. Bids shall not be submitted nor accepted via e-mail. b. All bids shall contain the offered price and proposed terms of acquisition. c. All bids shall include a proposed plan and timeline for demolition of the building(s) located on the Subject Property. The demolition of the building(s) shall occur no later than one hundred twenty (120)days after the closing of the sale of the Subject Property. d. All bids shall include a description of the planned use of the Subject Property after the building(s) located thereon have been demolished, which shall be for a residential use only (unless later otherwise approved by a majority of the corporate authorities of the City of Canton) and consistent with City zoning and land use ordinances for areas zoned Residential (R-2). e. The Subject Property is currently zoned Residential (R-2), as described in the City of Canton's Municipal Code. f. All bids shall include site plan(s), including those for the purchase of the Subject Property. g. All bids must include a projected timeline for the development and sale of the parcel. h. All bids remain subject to a final purchase agreement and approval by ordinance, which must be approved by a vote of% of the corporate authorities then holding office. i. All bids must contain a written acknowledgment from the Bidder that the Bidder acknowledges, voluntarily consents to and understands that: (1) the corporate authorities may accept the high bid or any other bid determined to be in the best interest of the City of Canton by a vote of % of the corporate authorities then holding office, but by a majority vote of those holding office, they may reject any and all bids; and (2) The City of Canton reserves the right to request alternative bids/proposals or to negotiate terms of the final purchase agreement after the deadline for the submission of bids has passed, to the extent permitted by Illinois law. 5. The corporate authorities may accept the high bid or any other bid determined to be in the best interest of the City of Canton by a vote of 3/4 of the corporate authorities then holding office, but by a majority vote of those holding office,they may reject any and all bids. The City shall further reserve the right to request alternative bids/proposals or to negotiate terms of the final purchase agreement after the deadline for the submission of bids has passed,to the extent permitted by Illinois law. 6. This Resolution shall be in full force and effective immediately upon its passage by the City Council of the City of Canton and approval by the Mayor thereof. Spruce Street, Canton, IL 61520 (the "Subject Property"), which is legally described below. The Illinois Municipal Code authorizes the City to convey the real estate when, in the opinion of the corporate authorities, the real estate is no longer necessary, appropriate, required for the use of, profitable to, or for the best interests of the City. The City has determined that the Subject Property is no longer necessary, appropriate, required for the use of, profitable to, or for the best interests of the City. The Illinois Municipal Code further provides that said conveyance may be made after approval of an ordinance by the corporate authorities and after a notice of the proposal to sell said real estate. Therefore, it is authorized by the Mayor and City Council of the City of Canton, as follows: 1.
