ORDINANCE NO. 4552
AN ORDINANCE AUTHORIZING PURCHASE AND FINANCING OF
LADDER/TOWER TRUCK FOR CANTON FIRE DEPARTMENT AND WAIVING
COMPETITIVE BIDDING REQUIREMENTS IN RELATION TO SAME
WHEREAS, the City of Canton, Fulton County, Illinois ("City"), is a non-home rule unit of
government;
WHEREAS,the City is in need of a newer ladder/tower truck to be used for public purposes,
particularly in the City's fire department;
WHEREAS,the City Council of the City of Canton has determined that it is necessary and in
the best interests of the City to purchase one (1) ladder/tower truck and other options/accessories
(collectively, the"Fire Truck");
WHEREAS, the Fire Truck needed by the City is unique, and due to the market for such
equipment, it is imperative that the City be able to move quickly to procure such equipment for the
City's use;
WHEREAS,the Fire Truck will likely be procured from another governmental agency and/or
will be equipment previously owned by an entity other than the City itself,
WHEREAS,to the extent any competitive bidding requirements apply pursuant to applicable
law, the City Council finds it to clearly be in the best interest to waive any said requirements and
proceed with purchasing the Fire Truck.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CANTON, FULTON COUNTY, ILLINOIS AS FOLLOWS:
1. The City of Canton hereby finds as fact the recitals set forth above and are incorporated herein
as though fully set forth.
2. To the extent any competitive bidding requirements apply pursuant to applicable law, such
competitive bidding requirements are hereby waived in the best interests of the City.
3. The Mayor, or his designee, is hereby authorized to purchase a Fire Truck for a purchase price
of no more than $900,000.00(plus customary taxes,titles, and fees as may be applicable), but
only after the Fire Truck has been satisfactorily inspected by the Fire Chief or his designee.
4. The Mayor, or his designee, is hereby authorized to execute and deliver any and all purchase
agreements, purchase orders, or other documents necessary to purchase the Fire Truck as set
forth above, provided that all payments shall be made within twenty (20)years.
5. The Mayor, or his designee, is hereby authorized to obtain a loan to finance up to $450,000.00
of the purchase price.
6. If no purchase order or agreement to otherwise purchase the Fire Truck is executed by the
Mayor(or his designee)on or before April 30,2027,this Ordinance shall expire and be deemed
null and void.
7. This Ordinance shall be in full force and effective immediately upon its passage by the City
Council of the City of Canton and approval by the Mayor thereof.

BACKGROUND: With trying to find a Ladder/Tower Truck in the used market
being a harder find now days. This pre approval would allow us to act quickly
to hold other departments off in the expected purchase of a found truck. This
used market Has become ultra-competitive for Ladder/Tower trucks with more
buyers then trucks to be sold. The ability for having pre approval for finances
will help us tremendously in the ability to find a truck.
