ORDINANCE NO. 4551
AN ORDINANCE APPOINTING ESTABLISHING THE OFFICE OF DEPUTY
TREASURER, APPOINTING ANDREW FAHRENBRUCH AS DEPUTY TREASURER,
AND AUTHORIZING THE DEPUTY TREASURER
AS A SIGNATORY IN LIMITED CIRCUMSTANCES
WHEREAS, the City of Canton, Illinois ("City") is an Illinois non-home rule municipality
with a population greater than 10,000 people;
WHEREAS, pursuant to 65 ILCS 5/3.1-30-5-(a), the mayor, by and with the advice and
consent of the city council or the board of trustees, may appoint(1) a treasurer(if the treasurer is not
an elected position in the municipality),(2)a collector,(3)a comptroller,(4)a marshal,(5)an attorney
or a corporation counsel, (6)one or more purchasing agents and deputies, (7)the number of auxiliary
police officers determined necessary by the corporate authorities, (8) police matrons, (9) a
commissioner of public works, (10) a budget director or a budget officer, and (11) other officers
necessary to carry into effect the powers conferred upon municipalities;
WHEREAS,the Mayor has appointed Andrew Fahrenbruch as Deputy City Treasurer so that
he can assist the City Treasurer in the performance of her duties and to carry out the powers conferred
upon municipalities for purposes of the Office of City Treasurer in the City Treasurer's absence;
WHEREAS, the City Council has advised and consented to the Mayor's appointment of
Andrew Fahrenbruch as Deputy City Treasurer through May 4, 2027.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Canton,
Illinois, the following:
1. That the Recitals set forth above, and all facts and statements contained therein, are found
to be true and correct and are hereby incorporated and adopted as part of this Ordinance;
2. ANDREW FAHRENBRUCH is hereby appointed as Deputy City Treasurer of the City
of Canton, to perform the duties of assisting the City Treasurer with her duties as City
Treasurer as prescribed by Illinois law and the ordinances of the City of Canton,to perform
the duties of City Treasurer in the event the City Treasurer is incapacitated or temporarily
unable to perform her duties (as determined by the Mayor and/or City Treasurer), and to
perform such other duties as may be assigned from time-to-time by the Mayor and/or City
Treasurer, effective upon him taking of the Oath of Office as required by Illinois law.
3. The Deputy City Treasurer shall file a renewed Oath of Office with the City Treasurer's
Office and, as applicable,post a renewed bond equivalent to that of the City Treasurer, as
required by applicable law.
4. The appointment of ANDREW FAHRENBRUCH as Deputy City Treasurer and the office
of Deputy City Treasurer shall expire at 11:59 p.m. on May 4, 2027 or the appointment of
a successor Deputy City Treasurer (with the advice and consent of the City Council),
whichever is earlier,unless extended by subsequent appointment of the Mayor and advice
and consent of the City Council or the appointment is terminated sooner by the Mayor for
any reason.
5. ANDREW FAHRENBRUCH is currently an employee of the City and serves as an
assistant to the City Treasurer, and the Deputy City Treasurer's duties assigned to him by
this Ordinance shall be in addition to those duties assigned to him as an assistant to the
City Treasurer.
6. ANDREW FAHRENBRUCH, as Deputy City Treasurer, during any time the City
Treasurer is temporarily unable to perform her duties,is authorized to sign documentation
on behalf of the City Treasurer provided either written direction has been given by the
City Treasurer to ANDREW FAHRENBRUCH, as Deputy City Treasurer, to exercise
such power or the Mayor has determined that the City Treasurer is temporarily or
permanently incapacitated to perform her duties. When ANDREW FAHRENBRUCH, as
Deputy City Treasurer, is signing any document on behalf of the City Treasurer, he shall
sign the name of the City Treasurer followed with the word `By" and his own name and
the words "Deputy City Treasurer." Upon execution by the Deputy City Treasurer, any
such document shall also be signed by the Mayor. Upon execution by the Deputy City
Treasurer and the Mayor as herein provided, such signing shall have the same effect as if
the document had been signed by the City Treasurer in person. For the avoidance of doubt,
ANDREW FAHRENBRUCH, as Deputy City Treasurer, is only authorized to sign
documentation if the City Treasurer is unable to do so.
7. Any Ordinances in conflict with this Ordinance are hereby repealed or otherwise
superseded.
8. This Ordinance shall be in full force and effect immediately upon its passage by the City
Council of the City of Canton, Fulton County, Illinois.
