ORDINANCE NO. 1679
ORDINANCE ANNEXING AND RE-ZONING CERTAIN TERRITORY TO THE
CITY OF CANTON, FULTON COUNTY, ILLINOIS.
WHEREAS, a Petition for Annexation and Re-Zoning, signed by the owner of
record, of all the land within the territory hereinafter described, was filed before the
Planning & Zoning Commission of the City of Canton, Illinois, requesting that said
territory be annexed to the City of Canton and rezoned; and,
WHEREAS, the real estate which is the subject matter of this Petition is legally
described in Exhibit A, which is attached hereto and made a part of this Ordinance by
reference, and is located at 2076 North Main Street, Canton, Illinois; and,
WHEREAS, Methodist Medical Center of Illinois is the owner of record of the
real estate to be annexed and re-zoned and there aze no other owners of record; and,
WHEREAS, the real estate to be annexed and re-zoned is not within the
corporate limits of any municipality, but is contiguous to the City of Canton, Illinois; and,
WHEREAS, the real estate to be annexed and re-zoned is part of the Copperas
Creek Fire Protection District, but is not a part of any Public Library District; and,
WHEREAS, proper notice of the proposal for Annexation and Re-zoning has
been given to the Trustees of the Copperas Creek Community Fire Protection District as
provided by law and an affidavit that service of notice has been made as provided by law
has been filed with the Fulton County Recorder of Deeds; and,
WHEREAS, all petitions, documents and other necessary legal requirements aze
in full compliance with the statutes of the State of Illinois; and,
WHEREAS, a public heazing was held before the Planning and Zoning
Commission of the City of Canton, Illinois on November 13, 2000 pursuant to proper
notice published in the Canton Daily Ledger; and,
WHEREAS, on November 13, 2000, the Planning and Zoning Commission of
the City of Canton, Illinois recommended to the City Council of the City of Canton,
Illinois that the real estate described in Exhibit A be annexed to the City of Canton,
Illinois in an R-4 Multiple Family Residential District) Zoning Classification, pursuant to
the provisions of 65 ILCS 5/7-1-8 ofthe Illinois Municipal Code; and,
~ WHEREAS, the real estate to be annexed and re-zoned has been used for many
years as a clinic building, is well suited for continued use as such and should be annexed
to the City of Canton in an R-4 (Multiple Family Residential District) Zoning
Classification; and,
WHEREAS, the highest and best use of the real estate to be annexed and re-
zoned is its present use; and,
WHEREAS, it is in the best interest of the City of Canton, Illinois that said
territory be annexed to the City of Canton, Illinois in an R-4 Zoning Classification.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF CANTON, Fulton County, Illinois as follows:
1. That the City Council finds as facts the recitals herein above set forth.
2. That the territory described in Exhibit A, which is attached hereto and made a
part of this Ordinance by reference, be and the same is hereby annexed to the
City of Canton, Illinois.
3. That this property shall be annexed in an R-4 (Multiple Family Residential
District) Zoning Classification.
4. That the Zoning Administrator of the City of Canton, Illinois is hereby
directed to make the appropriate changes to the zoning maps of the City of
Canton to reflect this annexation and re-zoning.
5. That the City Clerk of the City of Canton is hereby directed to record with the
Recorder of Deeds of Fulton County and to file with the County Clerk of
Fulton County a certified copy of this ordinance, together with an accurate
map of the annexed territory.
6. That this Ordinance shall be in full force and effect upon its passage by the
City Council of the City of Canton, Illinois and approval by the Mayor
thereof.
,. PASSED by the majority vote of the City Council of the City of Canton, Illinois
and approved by the Mayor thereof this 5th day of December, 2000 upon a roll call
vote as follows:

Tract Six (6) in the platted subdivision of the North Half of the Northeast
Quarter (NE '/4) of Section Fifteen (15), Township Seven (7) North, Range
Four (4) East of the Fourth Principal Meridian, excepting therefrom the
following described tract of land: Beginning at a point 91 feet East of the
Southwest corner of the North half of the Northeast Quarter of said
Section 15; thence West 91 feet to said Southwest corner; thence North
85.6 feet to an iron pin; thence North 87 59' East 657.95 feet on a line
running through the outlet and inlet of pond to a point on the West Right-
of-Way of Illinois Route 78; thence South along said right-of--way 110.00
feet more or less to an iron pin; thence West 150 feet to an iron pin; thence
continuing West 400 feet to the point of beginning. Also excepting all
parts of said real estate dedicated or used for public highways, situated in
the County of Fulton and State of Illinois.
