HomeMy WebLinkAboutOrdinance #2099 - amending section 3-3-14-1 (video gaming machines) ORDINANCE NO 2099 AN ORDINANCE AMENDING SECTION 3-3-14-1 (VIDEO GAMING MACHINES) OF THE CANTON MUNICIPAL CODE WHEREAS, on July 13, 2009 the State of Illinois adopted the Video Gaming Act (230 ILCS 40); and WHEREAS, the law did not go into effect until the Illinois Gaming Board established a centralized communications system that connected the machines; and WHEREAS, the centralized communications system was deemed function on July 19, 2012 by the Illinois Gaming Board; and WHEREAS, the Illinois Gaming Board anticipates the system going online by the end of 2012; WHEREAS, the Video Gaming Act prohibits non-home-rule municipalities, such as Canton, from charging a fee in excess of $25.00 per terminal; and WHEREAS, the Canton municipal Code needs amended to bring the code into compliance with the Video Gaming Act; and WHEREAS, the City Council has made a similar determination. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, Fulton County, Illinois, as follows: 1. That the foregoing recitals of fact are found to be true. 2. That Section 3-3-14-1(B) is hereby amended as follows: (B) License Required: Every person, firm or corporation, operating its place of business or carrying on its activities at a location within the territorial limits of the city of Canton, Illinois, shall first obtain a license for each video gaming machine operated or active at such location. The annual license fee for each such machine shall be the sum of . A3 twenty five dollars 25.00 payable, by the owner of the gaming machines, annually in advance and no fee or portion thereof shall be refunded. The license shall be displayed on each machine at all times.
