ORDINANCE NO. 4533
AN ORDINANCE AUTHORIZING CONTRIBUTION OF $50,000.00 OF
HOTEL/MOTEL FUNDS TO SPOON RIVER PARTNERSHIP FOR ECONOMIC
DEVELOPMENT FOR MARKETING AND TOURISM PURPOSES AND FOR EVENTS
AT THE OPERA HOUSE PLAZA
WHEREAS,the City of Canton, Fulton County, Illinois ("City"), is a non-home rule unit of
government;
WHEREAS, the City collects a municipal operators' occupation tax ("Hotel/Motel Tax")
pursuant to 65 ILCS 5/8-3-14 and Title 3, Chapter 23 of the Canton Municipal Code;
WHEREAS, the Illinois Municipal Code provides, "Except as otherwise provided in this
Division,the amounts collected by any municipality pursuant to [65 ILCS 5/8-3-14] shall be expended
by the municipality solely to promote tourism and conventions within that municipality or otherwise
to attract nonresident overnight visitors to the municipality."(65 ILCS 5/8-3-14);
WHEREAS,the City recently improved City-owned real property located at or about 45 East
Side Square, Canton, Illinois 61520 and commonly known as the "Opera House Plaza" with a stage
and area for entertaining the public;
WHEREAS,the corporate authorities desire that the Opera House Plaza be utilized for events
that promote tourism within the City and to attract nonresident overnight visitors to the City;
WHEREAS, the Canton History and Arts Alliance (the "Alliance") intends on hosting
numerous concerts at the Opera House Plaza during calendar year 2026 that will promote tourism
within the City and to attract nonresident overnight visitors to the City;
WHEREAS,the Alliance is in need of financial assistance to hire or otherwise pay bands and
other entertainers that will promote tourism within the City and to attract nonresident overnight visitors
to the City; and,
WHEREAS,the corporate authorities have determined that it would be in the best interests of
the citizens of canton, and in order to promote tourism within the City and to attract nonresident
overnight visitors to the City, to provide a contribution to the Spoon River Partnership for Economic
Development in order to assist the Alliance with providing bands and entertainment.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CANTON,FULTON COUNTY, ILLINOIS AS FOLLOWS:
1. The City of Canton hereby finds as fact the recitals set forth above and are incorporated herein
as though fully set forth;
2. The City Treasurer,upon approval of the Mayor, is hereby authorized to contribute up to Fifty
Thousand and No/100 Dollars($50,000.00)total from the City's Hotel/Motel Tax Fund to the
Spoon River Partnership for Economic Development,provided the funds are utilized to assist
the Alliance and/or the Spoon River Partnership for Economic Development with providing

bands/entertainment that will promote tourism within the City and/or otherwise attract
nonresident overnight visitors to the City.
3. Alternatively, upon approval of the Mayor, disbursements, up to Fifty Thousand and No/100
Dollars ($50,000.00) total from the City's Hotel/Motel Tax Fund, may made directly to the
band/entertainer (or their related entity) rather than to the Spoon River Partnership for
Economic Development,provided the use of the Hotel/Motel Tax funds will promote tourism
within the City and/or otherwise attract nonresident overnight visitors to the City.
4. All disbursements pursuant to this Ordinance shall be in the sole discretion of the Mayor and
the Mayor reserves the right to require the Alliance and/or Spoon River Partnership for
Economic Development to provide sufficient evidence that the funds are being used consistent
with this Ordinance and may require other acknowledgments/agreements by the Alliance
and/or Spoon River Partnership for Economic Development.
5. This Ordinance shall be in full force and effective immediately upon its passage by the City
Council of the City of Canton and approval by the Mayor thereof.
