HomeMy WebLinkAbout07-19-2012 ZBA minutes ZONING BOARD OF APPEALS July 19, 2012 HISTORIC DEPOT A meeting of the Canton Zoning Board of Appeals was held on Thursday, July 19, 2012, in the Council chambers of the Historic Depot located at 50 North 4th Avenue in Canton, Illinois. Chairman Kay Long called the meeting to order at 5:30 p.m. Roll call was taken. Present were Kay Long, Kathy Lock, Harold Jump, and Denise Colglazier. Maria Orwig was absent. Others present were petitioners, Clark & Shelly Hogon, Darren and Jeannie Breese & Planning & Zoning Director, John Kunski. A quorum was present and the meeting continued. Chairman Long asked for a Motion to approve the minutes from the June 7, 2012 meeting. The Motion was made by Kathy Lock and seconded by Harold Jump. Motion passed with a unanimous voice vote. Chairman Long read the petition from Clark and Shelley Hogon. The ZBA had continued the Hogon's request for a 5 foot variance for a carport that was brought to the June 7, 2012 meeting until a survey was completed determining the property line. The Hogon's have the completed survey and the carport is on their property. They have amended the petition to read a"4 foot variance" rather than the original request of 5 feet. John Kunski spoke with the owner of the neighboring property, Chris Harmon, and once he found out the survey results, was satisfied and said he had no problem with the carport as it stands. Harold Jump made a Motion to accept the 4 foot variance and Kathy Lock seconded. Roll call vote - All Ayes by voice vote. Motion carried. Petitioners granted a 4 foot variance. Chairman Long read the second petition from Darren and Jeannie Breese for property located at 249 W. Tamarack. The petitioners are asking for a 5 foot variance on the West yard to build a detached garage. John Kunski weighed in on the matter and said that they are actually asking for a 4 foot variance as petitioners were counting their overhang and it measures from the wall, not the overhang. The petition will be amended to reflect the change from 5 to 4 foot. John cautioned the Breese's on knowing where the lot lines actually are prior to putting the building up. Harold Jump looked at the property earlier and said it is not really obvious where the West line is and for their own protection they should probably get the property surveyed prior to erecting a building. John also inquired about the existing little shed/playhouse and asked if it would remain where it now sits and Darren answered that it would be moved 24 feet to the East. John told them that the total number of buildings on the property cannot exceed 40 % of the coverage of the lot. The deck, house, shed, garage would all be included. They will discuss further when they come in to fill out a building permit. 1 There were no additional questions and Harold Jump made a motion to accept the 4 foot variance on the West side of the property and Kay Long seconded it. Roll call vote resulted in a unanimous voice vote. Motion carried and petitioners were granted the 4 foot variance. Kay Long made a Motion to adjourn, seconded by Harold Jump. All Ayes.
