HomeMy WebLinkAboutOrdinance #2094 - rezoning certain property ORDINANCE NO. 2094 AN ORDINANCE RE-ZONING CERTAIN PROPERTY 1N THE CITY OF CANTON, FULTON COUNTY, ILLINOIS. WHEREAS, a Petition for Re-Zoning, signed by the owners of record of the real estate hereinafter described, was filed before the Planning and Zoning Commission of the City of Canton, Illinois, requesting that said real estate be re-zoned from R-4 (Multiple-Family Residential District) to a PUD (Planned Unit Development) zoning classification; and WHEREAS, the real estate which is the subject of this Petition is located at the Northwest Corner of Lakeland Park Drive and Illinois State Route 78 (North Main Street), in the City of Canton, Fulton County, Illinois and is legally described as follows: A part of the Southeast Quarter of Section 15, Township 7 North, Range 4 East of the Fourth Principal Meridian, Fulton County, Illinois, further described as follows: Commencing at the southwest corner of the Southeast Quarter of said Section 15, thence North 89°10'49" East (bearings referenced to the Illinois State Plane Coordinate System, NAD 83 West Zone) along the south line of said Southeast Quarter 126.25 feet; thence North 00°49' 11" West 30.00 feet to a point in the north right of way line of Lakeland Park Drive, said point being the Point of Beginning of the parcel to be described: From the Point of Beginning, thence continuing North 00°49' 11" West 125.07 feet; thence North 89°10'49" East 44.82 feet; thence North 58°50'23" East 18.41 feet; thence North 03°29'09" East 21.36 feet; thence North 02°33'24" West 45.66 feet; thence North 08°35'03" East 26.92 feet; thence North 39°45'27" East 51.30 feet; thence North 54°36'36" East 81.96 feet; thence North 71°20'33" East 16.01 feet; thence South 88°16'00" East 29.80 feet; thence North 43°26'25" East 26.43 feet; thence North 04°19'00" East 35.40 feet; thence North 36°08'38" East 140.26 feet; thence North 68°03'44" East 40.73 feet; thence North 49°55'48" East 24.77 feet to a point in the westerly Right of way line of FAP Route 22 (Illinois Route 78); thence South 03°48'36" East along said right of way line 48.99 feet; thence South 14°43'44" East along said right of way line 163.87 feet; thence along a curve to the right an arc length of 287.11 feet, said curve having a radius of 4602.38 feet and a chord bearing South 02°10'45" West 287.06 feet; thence South 76°53' 15" West along said right of way line 88.61 feet to a point where said right of way line intersects said north right of way line of Lakeland Park Drive; thence South 89°10'49" West along said north right of way line 314.67 feet to the Point of Beginning. Said Parcel containing 3.115 acres, more or less. 1 WHEREAS, Thomas H. Herbst is the owner of record of the real estate to be re-zoned and Craig J. Holthaus is the contract purchaser of the real estate to be re-zoned and there are no other owners of record; and WHEREAS, the real estate to be re-zoned is within the corporate limits of the City of Canton, Illinois; and WHEREAS, all petitions, documents and other necessary legal requirements are in full compliance with the statutes of the State of Illinois and the ordinances of the City of Canton, Illinois and proper notice of the filing of the Petition for Re-Zoning was given as provided by law; and WHEREAS, a public hearing was held before the Planning and Zoning Commission of the City of Canton, Illinois on July 9, 2012, pursuant to proper notice published in The Daily Ledger, a secular newspaper having a general circulation in the City of Canton, County of Fulton and State of Illinois; and WHEREAS, on July 9, 2012, the Planning and Zoning Commission of the City of Canton, Illinois recommended to the City Council of the City of Canton, Illinois that the real estate described above be re-zoned from R-4 (Multiple-Family Residential District) to a PUD (Planned Unit Development) zoning classification; and WHEREAS, the surrounding neighborhood consists of agriculture, business and residential uses, and the re-zoning of the real estate described above to a PUD (Planned Unit Development) would be consistent with the current uses in the area; and WHEREAS, the highest and best use of the real estate described above is for multiple- family residential purposes; and WHEREAS, it is in the best interest of the City of Canton, lllinois that said real estate be re-zoned from R-4 (Multiple-Family Residential District) to a PUD (Planned Unit Development) zoning classification. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Canton, Fulton County, Illinois, as follows: 1. That the City Council finds as facts the recitals hereinabove set forth. 2. That the real estate described above be re-zoned from R-4 (Multiple-Family Residential District) to a PUD (Planned Unit Development) zoning classification. 3. That the Zoning Administrator of the City of Canton, Illinois is hereby directed to make the appropriate changes to the zoning maps of the City of Canton to reflect this re-zoning. 2 4. That this Ordinance shall be in full force and effect immediately upon its passage by the City Council of the City of Canton, Illinois and approval by the Mayor thereof.
