HomeMy WebLinkAboutResolution #3987 - intergovernmental agreement with fulton county as to the operation and maintenance of the animal shelter t 1 1~~ i RESOLUTION NO 3987 A RESOLUTION APPROVING AN INTERGOVERNMENTAL AGREEMENT BETWEEN THE THE CITY OF CANTON AND THE COUNTY OF FULTON AS TO THE OPERATION AND MAINTENANCE OF THE ANIMAL SHELTER AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER SAID AGREEMENT ON BEHALF OF THE CITY OF CANTON, ILLINOIS. WHEREAS, the Legal and Ordinance Committee of the City of Canton has determined that it is necessary and in the best interest of the City of Canton to enter into an agreement with Fulton County for the operation and maintenance of the Animal Shelter, as set forth in Exhibit "A" attached hereto and incorporated herein; and WHEREAS, the City Council of the City of Canton has made a sirnilar determination. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE ' CITY OF CANTON, ILLINOIS, AS FOLLOWS: 1. That the agreement attached hereto and incorporated herein as Exhibit "A" is hereby approved by the Canton City Council. 2. That the Mayor and City Clerk of the City of Canton, Illinois are hereby authorized and directed to execute said Agreement on behalf of the City of Canton. 3. That this Resolution shall be in full force and effect immediately upon its passage by the City Council of the City of Canton, Illinois and approval by the Mayor thereof. PASSED by the City Council of the City of Canton, Illinois at a regular meeting this 19th day of June, 2012 upon a roll call vote as follows: AYES: Aldermen Pickel, Hartford, Schenck, Pasley, West, ~'ritz, Ellis NAYS: None ABSENT: Alderman Nelson APPROVED: _ ' .,7 ~f.";7 . ~ Kevin R. eade, Mayor ATT T: Dia a avley, Ci y Clerk J' ~ INTERGOVERNMENTAL AGREEMENT This Agreement is entered into by and between the County of Fulton, a unit of local government (hereinafter called "COLTNTY") and the City of Canton, a municipal corporation (hereinafter called "CITY") pursuant to the authority of the Intergovernmental Cooperation Act cited as 5 Illinois Compiled Statutes 220/1 et.seq. The parties agree to the following: 1. That the CITY AND COiINTY previously closed their own individual animal shelters and are currently using the animal shelter provided and owned by the Fulton County Humane society. 2. That the COIINTY has a lease with the Fulton County Humane Society to operate the animal shelter at no cost to the Fulton County Humane Society. 3. That the CITY will be allowed to deposit animals at the COUNTY animal shelter that have been picked up by the CITY animal control officer. 4. That the CITY AND COLJNTY shall each be separately responsible for the wages and expenses of their animal control employees. 5. That the CITY AND COUNTY agrees to share certain costs of the animal control facility as well as certain revenues. These costs and revenues are attached and made a part of this Agreement as Appendix A. The COLJNTY shall provide the CITY on or before February lst of each year a detailed list of expenditures and revenues from the animal control facility as well as the calculation of the percentage of animals deposited in the animal control facility by the CITY for the previous twelve month period beginning December lst through November 30th. The CITY shall pay that percentage of the shared costs and shall receive that percentage of the shared revenues. It is anticipated that the costs shall exceed the revenues each year therefore the revenues will be deducted from the costs and the CITY shall pay its share of the difference based upon the animal percentage to the COLJNTY within sixty (60) days after receiving a statement from the COiJNTY for the same. 6. The parties agree that should any costs or revenues that are not listed on Appendix A occur, including, but not limited to construction or leasehold improvement projects, both the CITY AND COLJNTY will meet and discuss whether or not said costs and/or revenues should be part of the shared costs or shared revenues in the future. 7. CITY AND COLTNTY agrees that this Agreement has an effective date of June 19, 2012. CITY A1~TD COUNTY agree that this Agreement shall be in ferce for a period of T'wd years and shall be automatically renewed for a one year term thereafter unless either party, in writing, notifies the other party that it wishes to terminate this Agreement. Said notice of termination must be given at least ninety (90) days prior to the expiration of this Agreement. The COLTNTY as part of the day to day operating costs and as Lessee of the animal shelter shall carry insurance on a"comprehensive replacement costs form" with a face amount , ~ , ti equal to 100% of the replacement value of the leased premises with a standard co-insurance endorsement of not less than 90%, and a deductible of no more than $25,000.00 against loss or damage resulting from fire and other insurable casualties issued by insurance company or recognized risk pool reasonably satisfactory to the CITY. The property insurance shall: a) Cover and insure all buildings and improvements in the animal shelter; b) Name as insured's or additional insured's the CITY OF CANTON; and c) Not be able to be cancelled or materially changed unless the CITY has given written notice of such cancellation at least 15 days in advance. The COUNTY shall deliver a certificate of insurance to the CITY that evidences the existence of the insurance required hereunder. The COLTNTY reserves the right to self-insure or provide coverage under a so called blanket policy, and in that event any loss incurred, which is not otherwise covered, shall be a direct obligation of the COLJNTY. It will read: Each party will maintain general liability insurance to cover that parties' employees and/or members of the public while those employees and/or members of the public are on the premises of the animal shelter. Employees of the CITY AND COLTNTY shall l~e covered by their respective employer under their respective workers' compensation insurance policy. 9. That both CITY AND COLTNTY have had approval from its respective elected bodies to execute this Agreement. IN WIT SS hereof th ies have executed this Agreement as of the 19 day of June, 2012. Animal control facility shared costs: Property and Liability insurance Kennel assistant's salary, FICA, IMRF, Workers' Comp. and overtime Administrator (veterinarian) Office supplies Utilities including electric, water, gas, garbage, telephone, internet (not currently available) Maintain, repair & replace the interior of the building, including the HVAC system and any existing leasehold improvements constructed by the COLTNTY. Animal loss claims Medications Animal disposal Feed supplies Mowing Snow removal Driveway & parking lot maintenance, but not capital expenses Revenues to be shared: Dog pick up and pound fees . ; STATE OF ILLINOIS ) FULTON COUNTY BOARD ) SS COUNTY OF FULTON ) SESSION, A.D. JULY lOth, 2012 RESOLUTION - WHEREAS, the Fulton County Board previously approved the terms of an intergovernmental agreement with the City of Canton on shared costs of the Animal Control facility, and; WHEREAS, the City of Canton has approved entering into said Shared Animal Control Facility Intergovernmental Agreement. NOW THEREFORE, BE IT RESOLVED: by the Fulton County Board that the County Board Chairman is authorized to sign the attached Intergovernmental Agreement for Shared Animal Control Facility with the City of Canton.
