HomeMy WebLinkAboutOrdinance #2085 - rezoning property on Main Street from an AG zoning classification to a B2 zoning classification ORDINANCE N0: 2012- 2 d~5 AN ORDINANCE REZONING PROPERTY ON MAIN STREET FROM AN AG ZONING CLASSIFICATION TO A B2 ZONING CLASSIFICATION WHEREAS IPAVA STATE BANK filed a petition with the City Clerk for the re-zoning of the real property described below said property being within the corporate limits of the City of Canton, Illinois and WHEREAS IPAVA STATE purchased the real property described below from CANTON DEVELOPMENT COMPANY on or about October 15, 2010, and WHEREAS the current zoning classification of the property is AG and it is the petitioner's intent for the property to change to a B-2 zoning classification and; WHEREAS after proper notice a public hearing on said Petition was conducted by the Planning and Zoning Commission of the City of Canton on Apri19, 2012, and WHEREAS on April 9, 2012, the Planning and Zoning Commission recommended to the City Council that the real property described below be re-zoned pursuant to 65 ILCS 5/11-13-1 et seq and WHEREAS it is in the best interest of the City of Canton Illinois that said property be re- zoned within the City of Canton to meet future business growth and fit within the City's comprehensive plan NOW THEREFORE BE IT ORDAINED by the City Council of the City of Canton Illinois as follows 1. That the Canton City Council hereby finds as facts the assertions set forth above; 2. That the described real property be and is hereby re-zoned from AG to B-2 as follows: A part of the Southeast Quarter of Section 15, Township 7 North, Range 4 East of the Fourth Principal Meridian, Fulton County, Illinois, more particularly described as follows: Commencing at a mag nail found at the southeast corner of said Section 15; thence South 89 degrees 10 minutes 47 seconds East, 628.53 feet (Bearings refer to the Illinois Coordinate System, West Zone, NAD 1983) along the south line of said Section 15 to the west line of FAP Route 22 (Illinois Route 78); thence North 15 degrees 51 minutes 21 seconds West, 43.71 feet along said west line of FAProute 22; thence continuing along said west line 208.12 feet along a curve to the left, whose radius is 4692.38 feet and the chord of said curve bears North 02 degrees 41 minutes 42 seconds East 208.11 feet to an iron rod; thence North 89 degrees 10 minutes 48 seconds East, 264.75 feet to an iron rod at the northwest corner of the Walter D. 2 Barra and Billie G. Barra property as described in Document No. 1034847, Fulton County Recorder's Office; thence South 00 degrees 35 minutes 06 seconds West, 250.00 feet to the southeast corner of said Barra property; thence South 89 degrees 10 minutes 47 seconds West, 260.04 feet along said south line of Section 15 to the Point of Beginning, containing 1.535 acres more or less. Part of PIN#09-08-15-400-018 3. That IPAVA STATE BANK will pay to the City of Canton the fees required to file a certified copy of this Ordinance with the Fulton County Clerk and Recorder of Deeds no later than ninety 90 days from the date of this Ordinance. 4. Upon proof of filing of a certified copy ofthis Ordinance the Zoning Administrator is directed to make the appropriate map amendments to the City of Canton to reflect said re-zoning. 5. That this Ordinance shall be in full force and effect upon its passage by the City Council of the City of Canton and approval by its Mayor.
