AN ORDINANCE RE-ZONING REAL ESTATE FROM B-1 LOCAL COMMERCIAL
DISTRICT TO B-2 GENERAL COMMERCIAL DISTRICT.
WHEREAS, an application for Re-zoning was filed with the City Clerk of the
City of Canton by John W. and Gloria D. Davis Land Trust # 1("Petitioner"J,
as owner of certain real estate legally described hereinafter (the
"Property"J; said Property being located within the corporate limits of the
City of Canton and identified as Alder Road, in Canton, Illinois, 61520. The
Property is legally described as: (see attached Exhibit AJ; and
WHEREAS, the present zoning of said Property is B-1, Local Commercial
Districfi, and is requested by Petitioner that the zoning of said Property be
changed to a zoning configuration of B-2, General Commercial District, to
allow for the construction of a storage facility thereon by Petitioner, and;
WHEREAS, a public hearing was held by the Planning and Zoning
Commission of the City of Canton (the "Commission"J on April 9, 2012,
with no objections being heard or writfien protests having been filed with
the City Clerk or Petitioner, and
WHEREAS, the Planning and Zoning Commission of the City of Canton, by
unanimous vote has approved all findings of facts supporting the rezoning
reqvested by Petitioner and recommended to the City Council of the Cifiy
of Canton that the Property be re-zoned from B-1 to 8-2, General
Commercial District, pursuant to the statutes and ordinances made and
provided; and
WHEREAS, it is in the best interest of the City of Canton that the Property
be re-zoned from B-1 to B-2 General Commercial District, as requested by
Petitioner.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF CANTON,
ILLINOIS AS FOLLOWS:
1. That the City Covncil hereby finds as fact the matters set forth
hereinabove and hereby approves and incorporates by
reference all findings of fact approved by the Commission
supporting the re-zoning requested by Petitioner.

2. That the Property described as follows be and the same is
hereby re-zoned to B-2 General Commercial District,
authorizing Petitioner to use the Property for the purposes
envisioned by said zoning classification (see attached Exhibit
,e,~.
3. That the Zoning Administrator of the City of Canton is directed
to make the necessary changes to the zoning maps to
properly reflect this re-zoning.
4. That Petitioner may record with the Fulton County Clerk, ex
officio Recorder of Deeds, a certified copy of this Ordinance.
5. That this Ordinance shall be in fvll force and effect upon its
passage by the City Council of the City of Canton and
approval by its Mayor.
Pass by the City Council of the City of Canton, Fulton County, Illinois at a
regvlar meeting of said Council this 15th day of May, 2012 upon a roll call
vote as follows:

Commencing at the Sovtheast corner of Section Ten (10J, town and
range aforesaid, thence West 743.0 feet to the point of beginning; thence
West 225.00 feet; thence in a Northerly direction 660.00 feet; thence East
242.6 feet; thence South 660.00 feet to the point of beginning, Fulton
County, Illinois.
Subject to all easements and rights-of-way of record; drainage
assessments, drainage taxes, water rentals and water taxes, if any; and
subject to the 201 1 and 2012 taxes due and payable in 2012 and 2013
