ORDINANCE NO. 1693' /~
AN ORDINANCE AMENDING SECTIONS 8.5, 8.6 AND 8.7 AND ADDING 8.8
OF THE CITY OF CANTON PERSONNEL POLICY
WHEREAS, the City of Canton is a municipality as defined by Article VII of the
Illinois Constitution; and
WHEREAS, this Ordinance is enacted pursuant to the power of the City Council
of the City of Canton to determine and fix the salary and other compensation including
fringe benefits of all appointive officials and employees of the municipality; and,
WHEREAS, the City of Canton is given statutory authority to regulate any
matter expressly within its' authorized powers; and,
WHEREAS, the City Council of the City of Canton, Fulton County, Illinois has
reviewed and determined that it is necessary, desirable and in the best interest of the City
of Canton to amend Sections 8.5, 8.6 and 8.7 of the City of Canton Personnel Policy; and,
WHEREAS, the City Council of the City of Canton, Fulton County, Illinois has
reviewed and determined that it is necessary, desirable and in the best interest of the City
of Canton to add a Salary Continuation provision to the Personnel Policy of the City of
Canton; and,
WHEREAS, the City Council of the City of Canton has determined that the
Salary Continuation shall become Section 8.8 of the City of Canton Personnel Policy.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF CANTON, Fulton County, Illinois as follows:
1. Sections 8.5, 8.6 and 8.7 of the City of Canton Personnel Policy are
hereby amended to read in their entirety as follows:
Section 8.5 Retired Employee and Elected Officials - 25 Years of City Service
In the case of elected officials (i.e., mayors), employees and department
heads (hereinafter retirees), who have twenty five (25) yeazs of service and
who, regardless of age, have become entitled to a pension under the
provisions of the Police and Firemen's Pension Fund or have become
entitled to benefits under the IMRF retirement provisions, the employer
shall pay the entire amount of the applicable premium of such insurance
until the retiree and his or her spouse have attained the age of 65 yeazs.
Premium payment shall be for the retiree, retiree's spouse and dependent
children. Retired employees, elected officials or department heads, who
become re-employed where insurance coverage is provided by the new
employer shall be excluded from this provision. Upon attaining the age of
sixty-five (65) years, or such other age as Congress may subsequently
determine, this coverage shall terminate and the retired employee, elected
official or department head shall make application to Medicare or to its
successor program. If available, the retired employee, elected official or
department head shall, however, have the option of purchasing Medicare
supplement .insurance at his/her expense through the City's group
insurance carrier.
Section 8.6 Retired Employees and Elected Officials - 20 Yeazs of City Service
In the case of elected officials (i.e., mayors), employees and department
heads (hereinafter retirees) who have twenty (20) yeazs of service and who
reach their respective age of fifty (50) yeazs and who have become entitled
to a pension under the provisions of the Police and Firemen's Pension
Fund or has reached fifty-five (55) years of age and who aze entitled to
benefits under the IMRF retirement provisions, the employer shall pay the
entire amount of the applicable premium of such insurance until the
retirees and his or her spouse have attained the age of 65 years. Premium
payment shall be for the retiree, retiree's spouse and dependent children.

Section 8.7 Retired Employee or Elected Official -Less than 20 Years of City Service
Any employee, elected official (i.e. mayor) or department head who retires
(hereinafter retiree) and is eligible to receive a pension under the
provisions of the Police and Fireman's Pension Fund or have become

entitled to benefits under the IMRF retirement provisions, and has reached
the age of fifty-five (55) years of age and has less than 20 yeass of service,
the City will pay a proportionate amount of applicable employee premium
based on years of service (x/20). If any employee, elected official or
department head, retires eligible for IMRF benefits or eligible for a
pension under the Police and Firemen's Pension Fund, is 60 yeass of age,
and has less than 20 years of service, then the City will pay the full
amount of the employees applicable healthcaze premium. Retirees who
become re-employed where insurance coverage is provided by the new
employer shall be excluded from this provision. Upon attaining his age of
sixty-five (65) years, or such other age as Congress may subsequently
determine, this coverage shall terminate and the retiree shall make
application to Medicare or to its successor program. If available, the
retiree shall, however, have the option of purchasing Medicare supplement
insurance at his expense through the city's group insurance carrier.
The employer shall not pay any portion of the applicable premium for
dependents for participating retirees not covered by a collective bazgaining
agreement if such retirees have less than twenty (20) years of service with
the City of Canton.
2. Section 8.8 be added to the City of Canton Personnel Policy and
read in its entirety as follows:
Section 8.8 Salazy Continuation
If the Administrative Assistant, any Department Head, Zoning
Administrator or Department Head Assistant (hereinafter referred to
collectively as "appointed officials"), whose positions are appointed by the
Mayor, shall have their position eliminated or shall be removed from their
position other than for a conviction of a disqualifying crime, then the
appointed official shall receive six-months of their normal salary or
compensation at the rate they were receiving when their appointment was
terminated. This salary continuation shall also include the continuation of
insurance coverage and life insurance but shall not include the continued
accrual of vacation, sick leave, personal days or holidays. The City shall
deduct normal tax withholdings and benefit contribution payments during
the salary continuation period.
3. If any section, paragraph, clause or provision of this Ordinance shall be
held invalid, the invalidity thereof shall not effect any of the other provisions of this
Ordinance.

4. All Ordinances in conflict herewith are hereby repealed to the extent of
such conflict.
5. That this Ordinance shall be in full force and effect immediately upon its
passage by the City Council of the City of Canton, Illinois and approval by the Mayor
thereof, and the Personnel Policy of the City of Canton be amended to reflect same.
