AN ORDINANCE PROVIDING FOR AND APPROVING
THE SECOND AMENDMENT TO THE
CANTON 1- DOWNTOWN/5TH AVENUE TIF DISTRICT
REDEVELOPMENT PROJECT AREA, PI.AN AND PROJECTS
WHEREAS, the City of Canton, Fulton County, Illinois ("City") by its duly elected Mayor and City
Council hereto approved a Redevelopment Plan and Proj ects; designated a Redevelopment Proj ect Area
(as shown in Exhibit A and legally described in Exhibit B); and adopted Tax Increment Financing
pursuant to Illinois Revised Statutes Chapter 24, Division 11-74.4-1 et. .req. (now 65 ILCS 5/11-74.4-1)
known as the "Canton International Harvester (IH) Site Project Area Tax Increment Financing District"
on the 6~' day of July, A.D., 2004; and
WHEREAS, the City by its duly elected Mayor and City Council and pursuant to the Tax
Increment Allocation Redevelopment Act, 65 ILCS 5/11-74.4 et. .req., (the "Act"), approved the First
Amendment to the Canton International Harvester (IH) Site Project Area Tax Increment Financing
District by Ordinance No. 2052 on the 22°d day of November, A.D., 2011 thereby adding public and
private TIF eligible project costs and renaming the TIF District as the "Catttot~ 1- Doumtot~m/5`h
Avenue TIFDistrict'; and
WHEREAS, the City desires to amend the Redevelopment Project Area, Plan and Projects
("Second Amendment") foY the Canton 1- Downtown/5`h Avenue TIF District puYSUant to the Act,
by reducing the size of the Redevelopment Project Area; and
WHEREAS, the City does not wish to add any new additional projects or costs to the
Redevelopment Plan and Projects at this time; and
WHEREAS, the Redevelopment Project Area is hereby amended to remove land as described in
Exhibit C(Parcel.r Removed from Canton 1- Dolvnto~vn/Sth Avenue TIF Di.rtrict ) from the Canton 1-
Downtown/5`~ Avenue TIF District, thereby reducing the size of the Redevelopment Project Area (as
shown in Exhibit D and legally described in Exhibit E); and
WHEREAS, the proposed Second Amendment does not affect the generalland uses established
pursuant to the Redevelopment Plan; substanrially change the nature of the Redevelopment Projects;
increase the total estimated Redevelopment Project Costs set out in the Redevelopment Plan; add
additional Redevelopment Project Costs to the itemized list of redevelopment project costs set out in
the Redevelopment Plan; or involve the displacement of any households or inhabited residenrial units
in the Redevelopment Project Area; and
WHEREAS, the proposed Second Amendment is consistent with the Plan and Projects as
previously Amended and has been reviewed by the Mayor and the City Council is generally informed
of this Second Amendment.

NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF
THE CITY OF CANTON, FULTON COUNTY, ILLINOIS:
1. T'he recitals set forth in the preamble to this Ordinance are hereby incorporated by refeYence
as if fully set forth herein.
2. The original Canton 1- Downtown/5`~ Avenue TIF District Redevelopment Project Area as
shown on the Boundary Map (Exhibit A) and legally described in Exhibit B is hereby
amended to remove land as described in Exhibit C, thereby reducing the size of the Canton
1- Downtown/5`~' Avenue TIF District Redevelopment Project Area.
3. The Canton 1- Downtown/5`'' Avenue TIF District Redevelopment Project Area, as
Amended by this Second Amendment, is shown on the Amended Boundary Map (Exhibit
D) and legally described in Exhibit E(Amended Legal De.rcription).
4. The Canton 1- Downtown/5`~ Avenue TIF District Redevelopment Plan, Projects and Area
as Amended shall be completed no later than December 31 S` of the year in which the payment
to County Treasurer is to be made with respect to ad valorem taxes levied in the twenty-third
(23`d) calendar year after the year in which the Ordinance approving the Canton 1-
Downtown/5`'' Avenue TIF District Redevelopment Plan, Projects and Area was originally
adopted.
5. This Ordinance shall be in full force and effect from and after its passage and approval as
provided by law and shall take effect upon its passage as required by law.
6. All ordinances and parts of ordinances in conflict herewith are repealed.
PASSED, APPROVED AND ADOPTED by the Mayor and Ciry Council of the City of Canton,
Fulton County, Illinois, on the 6`~ day of February, A.D., 2012, and deposited and filed in the Office of
the City Clerk of said City on that date.
