In attendance:
Mayor Kevin Meade, City Attorney Chrissie Peterson, City Clerk Diana Tucker, Liquor Commissioner Mike
Freeman, Zeynep Akgul
Mayor Meade called the meeting to order at 9:14am for the purpose of:
Discuss, consider and vote on a liquor application submitted by TJ's Diner and consider allegations
that Linn Lanes served alcohol to a minor.
Attorney Peterson stated that Alderman Nelson notarized the liquor license application, and he should
be informed that he should not notarize documents that will be coming before the city council.
TJ's Diner submitted a liquor application for a class B license. Attorney Peterson mentioned that the
first page of the application is marked for a class B license, but the second page of the application is
marked for a class A license fee. Zeynep Akgul explained that if a class A is available she would like to
have the class A license, but if a class A license was not available she would take a class B license.
Attorney Peterson explained that if a class B license was issued the majority of the sales would have to
be for food.
Nagel accounting has performed the bookkeeping duties for the business; however Zeynep explained
that she is not registered with the State of Illinois as a corporation at this time. Attorney Peterson
stated that the application shows the license request is to be in the corporation name; however the
corporation has not yet been established. A liquor license can't be issued for a corporation that does
not yet exist. The City would need to see the corporation papers that would come back from the
secretary of state.
Attorney Peterson asked who would provide the dram shop insurance. Zeynep stated that Country
Mutual would provide the insurance. Once the license is approved Zeynep would purchase the
insurance. Attorney Peterson stated that Country Mutual doesn't typically provide dram shop
insurance. Zeynep explained that the agent said he would find a company that would cover the dram
shop. The bond is issued thru RLI.
Attorney Peterson asked how the bond was issued to a company that is not yet incorporated. Zeynep
explained that the agent took care of the bond.
Attorney Peterson asked who the licensed bartenders would be. Zeynep explained that she would be
one of the licensed bartenders and she would hire one additional bartender. Attorney Peterson asked if
she was aware that she would need to have a registered bartenders license there at all times. Zeynep
stated that she was aware.
Attorney Peterson asked if leremy Funess was no longer the owner. Zeynep stated that he did not sell it
to her, but he just gave her the business. Zeynep is renting the business and will operate as a pizza,
Italian, wine/beer business--- but she is requesting a class B license.
Attorney Peterson asked if Zeynep plans on keeping the railings and outdoor seating in place. Zeynep
explained that she is aware that she will need city council permission. Attorney Peterson explained that
the business would not be allowed to have alcohol outside without a beer garden license. Zeynep
explained that she has not held a liquor license before. Zeynep has had liquor training in the past from a
different state.
Mayor Meade explained that once the corporation, bartender license, and dram shop insurance was
resolved the process would move forward for a class B license. Mayor Meade explained that once the
corporation papers, insurance and bartender's license are issued she can bring the information to the
Mayor's office and the request would still need to be presented to the city council for approval.
Linn Lanes Served alcohol to a minor.
Mayor Meade explained that Dave Fulton apologized for serving alcohol to a minor. Mayor Meade
recommends a$250.00 fine payable to the Canton School District or $500.00 to the city. Mindy
Meacham pleaded guilty as the bartender. She was given 1 year court supervision a$500.00 fine plus
court costs.
Motion and second were made by Mayor Meade/Mike Freeman to impose a$250.00 fine payable to
the Canton School District.
The motion carried.
