HomeMy WebLinkAboutResolution #3966 - imposing a municipal bond fee RESOLUTION NO 3966 A RESOLUTION IMPOSING A MUNICIPAL BOND FEE FOR THE CITY OF CANTON WHEREAS, on August 15, 2011, Public Act 097-0368 became effective; and WHEREAS, the Act amends the Illinois Municipal Code by adding Section 1-2-12.1 as follows: A municipality may impose a fee up to $20.00 for bail processing against any person arrested for violating a bailable municipal ordinance or a State or federal law; and WHEREAS, the City of Canton Police Department wishes to impose a twenty dollar ($20.00) fee for bail processing against any person arrested for violating a bailable municipal ordinance or a State or Federal law; and WHEREAS, the Legal and Ordinance Committee has determined that imposition of said fee will off-set the expenses incurred by the Canton Police Department to process bail for Fulton County, Illinois; and WHEREAS, the City Council has made a similar determination. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Canton, Fulton County, Illinois, as follows: 1. Municipal Bond Fee. The City of Canton Police Department shall impose a fee of twenty dollars ($20.00) for bail processing against any person arrested for violating a bailable municipal ordinance or a State or federal law. 2. Fee for Returned Payments. A fee of $25.00 shall be charged for any payment that is returned to the City for any reason, including, but not limited to, insufficient funds, account closed, or referred to maker 3. This Resolution is adopted pursuant to the powers granted in 65 ILCS 5/1-2-12.1. 4. This Resolution shall be in full force and effect immediately upon its adoption.
