AN ORDINANCE ANNEXING CERTAIN TERRITORY TO THE CITY OF CANTON,
FULTON COUNTY, ILLINOIS, OF GARY HULSEY AND SHARON HULSEY, 2060
NORTH MAIN STREET, CANTON, ILLINOIS.
WHEREAS, a Petition for Annexation signed by the owners of record of the
territory hereinafter described, was filed before the Planning and Zoning Commission of
the City of Canton, Illinois, requesting that said territory be annexed to the City of
Canton; and
WHEREAS, the territory which is the subject of this Petition is legally described
on Exhibit A, which is attached hereto and made a part of this Ordinance by reference,
and is located at 2060 North Main Street, in the City of Canton, Fulton County, Illinois;
and
WHEREAS, Gary Hulsey and Sharon Hulsey are the owners of record of the
territory to be annexed and there are no other owners of record and there are no
electors residing within the said territory to be annexed other than Gary Hulsey and
Sharon Hulsey; and
WHEREAS, the temtory to be annexed is not within the corporate limits of any
municipality, but is contiguous to the City of Canton, Illinois; and
WHEREAS, the territory to be annexed is part of the Copperas Creek Fire
Prote~ion District; and
WHEREAS, proper notice of the Petition for Annexation has been given to the
trustees of the Copperas Creek Community Fire Protection District as provided by law
and an affidavit that service of notice has been made as provided by law has been filed
with the Fulton County Recorder of Deeds; and

WHEREAS, all petitions, documents and other necessary legal requirements are
in full compliance with the statutes of the State of Illinois and the ordinances of the City
of Canton, Illinois, and proper notice of the filing of the Petition for Annexation was given
as provided by law; and
WHEREAS, a public hearing was held before the Planning and Zoning
Commission of the City of Canton, Illinois on October 14, 2002, pursuant to proper
notice published in the Canton Daily Ledger, a secular newspaper having 'a general
circulation in the City of Canton, County of Fulton and State of Illinois; and
WHEREAS, on October 14, 2002, the Planning and Zoning Commission of the
City of Canton, Illinois recommended to the City Council of the City of Canton, Illinois
that the territory described on Exhibit A be annexed to the City of Canton, Illinois in a
zoning classification of R-2 (Single Family Residential District), pursuant to the
provisions of 65 ILCS 5/7-1-8 of the Illinois Municipal Code; and
WHEREAS, the territory to be annexed has been used for may years as a single
family residence, is well suited for continued use as a single family residence and
should be annexed to the City of Canton, Illinois in an R-2 (Single Family Residential
District) zoning classification; and
WHEREAS, the highest and best use of the territory to be annexed and re-zoned
is its present use, i.e., single family residential purposes; and
WHEREAS, it is in the best interest of the City of Canton, Illinois that said
territory be annexed to the City of Canton, Illinois that said territory be annexed to the
City of Canton, Illinois in an R-2 (Single Family Residential District) zoning classification.

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of
Canton, Illinois, as follows:
1. That the City Council fords as facts the recitals hereinabove set forth.
2. That the territory described on Exhibit A, which is attached hereto and made
part of this Ordinance by reference, be and the same is annexed to the City of Canton,
Illinois.
3. That the territory described on Exhibit A shall be annexed to the City of
Canton, Illinois in an R-2 (Single Family Residential District) zoning classification.
4. That the Zoning Administrator of the City of Canton, Illinois is hereby directed
to make the appropriate changes to the zoning maps of the City of Canton to reflect this
annexation and re-zoning.
5. That Gary Hulsey and Sharon Hulsey are hereby directed to record with the
Recorder of Deeds of Fulton County, Illinois and to file with the County Clerk of Fulton
County, Illinois, a certified copy of this Ordinance together with an accurate map of the
territory annexed.
6. That this Ordinance shall be in full force and effect upon its passage by the City
Council of the City of Canton, Illinois, and approval by the Mayor thereof.
PASSED by a majority vote of the City Council of the City of Canton, Illinois,
and APPROVED by the Mayor thereof this 19~' of November, 2002, upon a roll call vote
as follows:
AYES: Aldermen Fillingham, Shores, Meade, Carl, West, Sarff, Hartford,
Molleck.
NAYS: None.

ORDINANCE NO. 1737
AN ORDINANCE ANNEXING CERTAIN TERRITORY TO THE CITY OF CANTON,
FULTON COUNTY, ILLINOIS, OF GARY HULSEY AND SHARON HULSEY, 2060
NORTH MAIN STREET, CANTON, ILLINOIS.
WHEREAS, a Petition for Annexation signed by the owners of record of the
territory hereinafter described, was filed before the Planning and Zoning Commission of
the City of Canton, Illinois, requesting that said territory be annexed to the City of
Canton; and
WHEREAS, the territory which is the subject of this Petition is legally described

and
WHEREAS, Gary Hulsey and Sharon Hulsey are the owners of record of the

WHEREAS, the territory to be annexed is not within the corporate limits of any

4. That the Zoning Administrator of the City of Canton, Illinois is hereby
directed to make the appropriate changes to the zoning maps of the City of Canton to
reflect this annexation and re-zoning.
5. That Gary Hulsey and Sharon Hulsey are hereby directed to record with
the Recorder of Deeds of Fulton County, Illinois and to file with the County Clerk of
