ORDINANCE NO. 1731
AN ORDINANCE RE-ZONING CERTAIN PROPERTY IN THE CITY OF
CANTON, FULTON COUNTY, ILLINOIS -- LOTS 355, 370, 371 AND 386 IN
WRIGHT'S ADDITION -- INTERSECTION AT CHERRY AND SOUTH MAIN
STREET
WHEREAS, a Petition for Re-Zoning, signed by the contract purchasers of the
real estate hereinafter described, was filed before the Planning and Zoning Commission
of the City of Canton, Illinois, requesting that said real estate be re-zoned from R-2
(Single Family Residential District) to B-1 (Business District) zoning classification; and,
WHEREAS, the real estate which is the subject of this Petition is located at 643
South Main Street, in the City of Canton, Fulton County, Illinois and is legally described
as follows:
Lots 355, 370, 371 and 386 in Wright's Addition to the
City of Canton, situated in the City of Canton, Fulton
County, Illinois; and,
WHEREAS, Abel Vault and Monument Company is the owner of record and
contract seller and Tri-County Land Tile, Inc. is the contract purchaser of the real estate
to be re-zoned and there aze no other owners of record; and,
WHEREAS, the real estate to be re-zoned is within the corporate limits of the
City of Canton, Illinois; and,
WHEREAS, all petitions, documents and other necessary legal requirements aze
in full compliance with the statutes of the State of Illinois and the ordinances of the City
of Canton, Illinois, and proper notice of the filing of the Petition for Re-Zoning was given
as provided by law; and,
WHEREAS, a public hearing was held before the Planning and Zoning
Commission of the City of Canton, Illinois on June 10, 2002, pursuant to proper notice
published in the Canton Daily Ledger, a secular newspaper having a general circulation
in the City of Canton, County of Fulton and State of Illinois; and,
WHEREAS, on June 10, 2002, the Planning and Zoning Commission of the City
of Canton, Illinois recommended to the City Council of the City of Canton, Illinois that
the real estate described above be re-zoned from R-2 (Single Family Residential District)
to B-1 (Business District) zoning classification; and,
WHEREAS, the highest and best use of the real estate described above is for
business purposes; and,
WHEREAS, it is in the best interest of the City of Canton, Illinois that said real
estate be re-zoned from R-2 (Single Family Residential District) to B-1 (Business
District) zoning classification.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CANTON, ILLINOIS, as follows:
I. That the City Council finds as facts the recitals hereinabove set forth.
2. That the real estate described above be re-zoned from R-2 (Single Family
Residential District) to B-I (Business District) Zoning classification
3. That the Zoning Administrator of the City of Canton, Illinois is hereby
directed to make the appropriate changes to the zoning maps of the City of
Canton to reflect this re-zoning
4. That this Ordinance shall be in full force and effect upon its passage by the
City Council of the City of Canton, Illinois, and approval by the Mayor
thereof.
PASSED by the City Council of the City of Canton, Fulton County, Illinois at a
regular meeting this 2nd day of ~ Y , 2002, upon a roll call vote as
