PLEDGE OF ALLEGIANCE OPENED THE MEETTNG FOLLOWED BY THE INVOCATION GIVEN BY MAYOR DONALD E. EDWARDS. Mayor Edwards asked for roll call at 6:3~ p.m. Present: Aldermen Kovachevich, Zi11y, Falcone, Sarff, Workman, Bohler, Ma.y, Chapman. Absent: None. MINUTES OF OCTOBER 15TH MEETING, Motion by Alderman Zilly, second by Alderman May the minutes of October 15th be accep~e~. and placed on file. Voice vote, mo~ion car~ied. COMMUNICATIONS FROM CLIFF SAGASER - CITY ENGINEER. Two of the hea~ers in the Public Safety building were not functioning properly. Ray Hartle Maintenance Supt. called Dave's Repair to fix the heaters, and the cost is $647.14. Dave's Repair replaced 2 valves and put on new sensors, as the furnaces are electronic. Motion by Alderman Kovachevich, second by Alderman [~Torkman, the expend- i~ure of $647.14 to Dave's Repair be approved for payment. Roll call. AYES - Aldermen Chapman, May, Bohler, Workman, Sarff, Falcone, Zilly, Kovachevich. NAYS - none. Motion carried. Signs will sti11 be placed at Enterprise Drive as soon as poles are available from Spoon River Electric, at a price of $15.00 each for 3 or 4 poles. They should be finished within 15 days from now. The Santa Fe Railroad is working on the crossing on South Main Street. The r~flectors on barricades will be put on by the ~i~y and the railroad will reimburse the city for the expense. A sewer that exists between Jack Pollitt property and the Wilcoxen property on Hemlock Terrace has ~ewage that flows to a man-hole between these two (2) houses, Then goes Westerly to the back of Pollitt's yard. We've always loaded that manhole pretty heavily since I've been here, that's why it over flows. The sewage then runs off in a South West direction to an existing low area which also has a very wide easement thru it. Another sewer comes in the area across Hays & Windsor's property and drains into this same manhole. This manhole has been built excessely l.ow, its about 162 feet deep. We found a pipe complete~y plu~ged afer going out there and looking around. And it plugged again the next day which meant to us that dirt was coming in there someplace other then down the line, it was coming in from the top. I talked to the mayor about this and we called the same people we had used before to TV the l.ine. They ran their TV camera to 70 feet and due to the bad condition of thesewer ~hey couldn't ~et any further. This is where the dirt is coming from. We turned the camera around to the bottom side and could only get thru to Mr. Pollitt's tap. We came to the conclusion after calling several companies we talked to, about resleeving this and the price for fixing it was $15,000 and they wouldn't guarantee the location of the problem, so the staff and Cliff decided the best way to fix this was to come back onto the city's property and putting in a new manhole in front of Wilcoxen's property and running that sewage back to the South until we get to the point of where we can be on this outlot. The outlot is owned by everyone in this subdivision. We would get on their property and run thru their dam and tie back into this sewer. We can also check the condition of this sewer. The sewer is only an 8 inch sewer. We would want to put in a 10 inch sewer, If we can do this, then we would plug one of the sewers after we replace Pollitt's 1'7 CONTINUED NOVEMBER 6TH, 1985 and Wilcoxen's service, then will replace that with a 6 inch plastic line. Will then come back and fill the old sewer with concrete, The cost of doing this work is about $3,800 with the city doing all the work. This depends on the city getting an easement .from the owners of this outlot. Motion by Alderman Sarff, second by Alderman Falcone, to approve the expenditure of repairing and replacing the sewer area on Hemlock Terrace and the ability of the city engineer to get required outside assistance. Discussion. Cliff did not want ~Che city ~oing the back- hoe work. He wants to get a price from Leo Poggioli. (The motion was amended to allow this expendi~Cure). Roll call. I talked to the EPA about getting p~rmission to do this sewer work and ~ they said they had no permit to issue for an emergency new sewer. You can go in and repair if its an emergency. To construct a new one they ~ have no permit without plans, but ~o ahead and proceed and send the (U EPA a drawing of the abstract as soon as its completed. W m COMMUNICATIONS FROM DAVE DORGAN - BUDGET ADMINSTR.ATOR AND COMMUNITY a DEVELOPMENT DIRECTOR, A Loan Cormnittee meeting was held prior to the council meeting. The committee acted upon an application for B& K Specialty Casting for a request of $100,000 of our Enterprise Zone Loan Fund to c~nstru~t a foundry in the Enterprise Park, And the entire financial package is depended upon a$300,000 DCCA grant and a$500,000 SBA package, The loan was approved by the committee with conditions. Jim Malm~ren City Attorney said the Loan Comanittee recommends to the city council the approval of the l.oan application subject to the following four (4) contingency~s : 1) The loan would be subject to collateralization accep~able ~o the City of Canton a~ the required 133% principle amount of the loan. 2) Subject to the appl.icant obtaining the balance of the financing in conformity with the loan application and approved business plan, or in conformity with any amendment to the application and approved bus- iness plan by subsequently being approved by the Canton City Co~tncil. 3) The loan itself and our approval of it is subject to any Hea1~Ch and Human Services, OCS approval that's required. 4) The loan and disbursement of loan funds would be sub- ject to no disbursement being made witho~t binding legal commi~ments, in the full amount of $900,000 in conformity wi~h the application and approved business plan. Motion by Alderman Sarff, second by Alderman Zilly, the application i be approved with the four contingencys as outlined by the city attorney. Roll call. Motion carried. 8 AYES 0 NAYS 0 ABSENT, Bruce Buehrig President of the B& K Specialty Casting Company gave a brief update of his company's p~.ans for Canton. ~ 318 CONTINUED NOVEMBER 6TH, 1985 Its a small jobing foundry located in East S~. Louis Illinois. They presently have 42 hourly emp].oyees and appro.ximate~y 6 to 7 people on staff, They have been hit with a rather large electric increase, Their electric bill jumped from $12,000 a month to $36,000 a month. They were introduced to the CiCy of Canton by Senator Richard Luft. The elec~ric rate here is reasonable, and they would be locating in the Enterprise Park on lots 18 and 19. They hope to er.lployee by the first year 7S people. And if the}~ double their sales in the next 3 years, they would eventually employ 125 people. Alderman Chapman said the foundry is definitely going to be an assest to the City of Canton, and he's definitely for i~. COMMITTEE REPORTS: Public Safety & Traffic, Council Action None. Informational: The Disaster Plan is being reviewed. Inf.ormational: Jim Malmgren City Attorney reveiwed how he was instruct- ed by council to proceed to bring about condemnation proceedinas against 4 propertys. That was done and condemnation proceeding_,s have been initiated by the State's Attorneys office. This point in time basical- ly all condemnation proceedings as far as the legal action is concern is complete, Two of the propertys that we had requested condemnation be initia~ed on is subsequently sold to new owners, The new owners wish to rehabilitate the improvements to the real estate. It is the consensus of the com- mittee Chat the city council consider stopping any legal action with respect to condemnation on those two propertys and that the new owners be given a reasonable period of time to bring those propertys into compliance of our code specifications. It was discussed that we wauld like to have the Health Department and our engineering firm take a look at the houses rather imanediately and then make a reinspection in abou~ 12 months, The action that is needed is that the city council would direct the city attorney to write Che State's Attorney officially requesting that they drop the condemnation proceedings on those 2 houses, and advise those 2 owners they have 12 months to get houses in compliance with the co de . Motion by Alderman Falcone, second by Alderman ti,Torkman, to recommend to the State's A~torney that we rescind condemnation proceedings against the propertys at 59 ~~Tes~ Oak and 1016 E, Elm for a period of one year, and a building permit be issued at no cost. Council Action Motion by Alderman Workman, second by Alderman May, the approval of engine repairs on a dump ~ruck in the amount of $1,004.04. Roll call. MoCion carried. 8 AYES 0 NAYS 0 ABSENT, Informational: A resident on Middle Park Drive is requesting that a street light be replaced since the city stopped the overall street light program. The residen~s had CIPS install a security light after their street light had been removed. And at this time only one resident is paying for the security ligh~. The committe recommended no action be taken on this ma.tter. 319 Informational: Alderman Falcone stated that ~he police chief had sent out bid sheets for unleaded gas for ~he city tanks, and there due back on November 12~h, For various reasons were thinking abou~ putting in a large gasoline tank to be located in the area of the police department to gua.rantee were not losing gasoline thru leakage, Lake, Building & Grounds. Council Action None. Public Works, Water & Sewer. Council Action Motion by Alderman May, second by Alderman Falcone, the approval of the expenditure of a 6 inch valve replacemen~ at 12~h Avenue and Vine Street. Roll call. In W the mean time if wie don'C get the money will have to make band-aid m repairs. Q COMMUNICATIONS FROM MAYOR EDWARDS. Attended a meeting in Bloomington, which ~he meeting was designed to share in Mitshibishi wealth, Their needing suppliers within a~wo hour drive. Would like to have you think about supporting mass transit or helping someone in private enterprise. On October 28th Jim Malmgren City Attorney, Dave Dorgan Community Deve- lopment Director and the mayor went to Washington D,C, thru a discussion with H,H.S, it was felt to come to Washington D.C. and have a mee~ing, The meeting was very frui~ful and everything that was in ques~ion was settled, Mayor Edwards wants approval for the expenses. Motion by Alderman Falcdne, second by Alderman Kovachevich, the expenses incurred for the 3 to fly to Washington D, C. be reimbursed. I have been approached several times in th~e last several monChs about the Mausoleum in Greenwood Cemetery. The Mausoleum does not belong to the city o~"Greenwood Ceme~ary. It was originally sold by a corporation who sol.d cryp~s, And everybody assumed it woulcl have perpetual care, and it does not. The roof is in need of repairs, they don't seem to have money. T don'~ know what to do with it. There's 240 crypts in the Mauseleum and 200 are full. I want you to think about it. Alderman Sarff asked what corporation was responsible? Mayor Edwards said all the parties that were involved wi~h it are dead, there are still some local peopl.e who will accept responsibili~y because of parents being buried in there. I've not accepted any responsibility on it. In the downtown area,street lights will be started soon. s The one thing you see downtown and can't help but see, is the condition of the Capitol Theatre. I'm going to ask Cliff to look at this building and will come to the committee to ge~C some guidance on it. 320 CONTINUED NOVEMBER 6th, 1985 Cliff and I went to Norris Farms one day and seen a nice industrial building which was 1,a00 feet long and 50 fee~ wide. It would make about 4 nice buildings in our indu~trial park. We put in a request for it. OLD BUSINESS: ORDINANCE - GRANTING A SPECTAL USE PERMIT FOR A FLOWER SHOP AT 240 FULTON PLACE. Second reading, read by title. Motion by Alderman Workman, second by Alderman May, the ordinance be placed on its passage. Discussion. Alderman Jim May gave a presentatior~ to sup- port the passage of the ordinance. Alderman Falcone said he voted against this at the Planning and Zoning meeting. He said he has nothing against the business. My only problem voting against this is we seem to be ge~ting into so many Home Occupations that our Zoning Ordinance is just about useless ~o us in that respect. Alderman Falcone said he didn't know if the Zonin~ Board of Appeals would like it, but he understood they would ~ike a revamping of the Zoning Ordinance and it may be time to take a look at that, That is my only objection. Alderman Workman said there are 15 people on that board and they come f~om all walks of life and we rely on their judgemerr.t and I hate to question their ability to make a decision. Mayor Edwards said you should question it, It wasn't to long ago since a Home Occupational Use was given and that the man never lived in th~ house, so I wonder sometimes how thoroughly the investigation. We all need to be question- ing this one. Alderman May told Mrs, Clark to move into this house today or ~omor- raw. I know she wouldn'~ lie to me. Roll call. NEW BUSINDSS: RESOLUTION - APPROVING A"LETTER OF UNDERSTANDING" BETWEEN THE CITY AND THE ILLINOIS DEPARTMENT OF TRANSPORTATION. First reading, read by title. Mayor Edwards said IDOT sent him a letter on the upgrading of Rou~e 9. The street will be wic~en and th.e house on 5th and Linn will be demolished, there will also be a turning lane. Motion by Alderman Kovachevich, second by Alderman May, the resolution be approved, Discussion, Alderman Falcone asked if there's any cost to the city'? First reading, read by title. Dave Dorgan Community Development Director said this is the restructuring of Phillips loan we have existing from the Gity and the city has with H.H.S. H.H,S, came in and moni~Cored our program and ~ook a look at Phillips loan and saw it to a large degree o~ fnTorking Capital loan as opposed to Eapital Tmprovement loan and ask us to restr~ucture. We would reduce the terms from 25 years to 5 years. Motion by Alderman Sarff, second by Alderman Kovachevich, the resolution be adopted. First readin~, read by title. RESOLUTION ~ APPROVING AN AMENDMENT TO AN AGREEMENT BETWEEN THE CITY AND - LAROMA PIZZA INC. First read~ng, read by title, A correction of the errors at the time of ~he agreement, according to Dave Dorgan. One of those errors being at ~he time we negotia~ed the ~.oan ~ae had granted them a year's principle abatement, an~ when we had put the loan agreement togather it was not inclusive of ~he year abatement. And they had a constructural change by adding a 3rd partner. We also adjusted the amortization schedule. Motion by Alderman Zilly, second by Alderman Sarff, the resolution be adopted as amended. Discussion. Jim Malmgren City At~orney stated that there are 2 amendments to be made to the re~lacemen~ page. Section 2.1 the word should read "December" of 1985. Sec~Cion 2.5 is not there and should be, i~C reads...borrower shall have the right to prepay any and all interest and principle at anytime without penalty or additional interest. Roll call.
