A regular meeting of the Canton Ci~y Council was held on January 7th,
1986 in Council Chambers.
PLEDGE OF ALLEGIANCE OPENED THE MEETING, FOLLOWED BY THE INVOCATION
GIVEN BY CITY CLERK NANCY WHITES.
Mayor Edwards asked for roll call at 6:30 p.m. Present: Aldermen
Kovachevich, Zilly, Sarff, Workman, May, Chapman. Absent: Alderman
Bohler was ill and Alderman Falcone resigned.
MINU3'ES OF I~ECEI~4BER 17 titi ~ MEETING , Correction on page 338 , the last
paragraph, the last word should read 'January' not December. On page
339 top of the page the sentence reads...the Chamber of Commerce of
Peoria, Canton, Quincy and etc., eliminate the word 'Peoria.'
Motion by Alderman Zilly, second by Alderr_lan Workman, the minutes of
December 17th be accepted and placed on file as corrected. Voice vote,
motion carried.
COMMUNICATIONS FROM CLIFF SAGASER - CITY ENGINEER. Bid letting on January
21st for the construction of Project 1 West Side Relief Sewer and
Project 2 South Side Relief Sewer and Pumping Station. Six contractors
have taken out specification sheets on the sewer project,
Cliff said he has had complaints on a section of Canton Lake road going
westerly. He suggested p~acing barricades at the east entrance to the
boat dock and Sebree Road, at the end of that road. Another barricade
South of the camping site on the East and T~est road that has access to
the lake .
Motion by Alderman Sarff, second by Alderman May, to direct the city
engineer to place barricades at the lake road. Voice vote, motion carried.
Cliff ine~ with Otis Michaels a specialist in soil and foundation work,
and a consulting engineer firm. When Mr. Michaels went over the
drawings of the dam he found a 1~ foot error in 1937 and again in 1940
where the spillway meets the old creek.
What has happened, some 40 years ago after the dam was constructed,
while the top of the dam hardened, making a type of arch over the core
area, the core itself softened from minute erosion areas and eventually
caved in.

Informational: Last year 309 boat licenses were sold, and out of that
figure only 51 of those licenses were of the higher horsepower. The
license sales totalled $6,272.00.
Public Safety & Traffic.
Council Action
Motion by Alderman Workman, second by Alderman Chapman, the city accept
$250 payment for the purchase of a mower belonging to the city and
sold at auction, from the city engineer, and the city pay $250 to
the city engineer for the purchase of a 1eve1 rod and Flue print
machine. Roll call, AYES - Aldermen Chapman, Ma.y, Workman, Sarff,
Zilly, Kovachevich. NAYS - None. Motion carried. 6 AYES 0 NAYS
1 ABSENT 1 RESIGNED.

Public Works - Water & Sewer.
Council Action
Motion by Alderman May, second by Alderman Chapman, to replace a chemical
feeder at the water plant in the amount of $3,549. Roll call, AYES -
Alderman Kovachevich, Zilly, Sarff, Workman, May, Chapman. NAYS - None.
Motion carried. 6 AYES 0 NAYS 1 ABSENT 1 RESIGNED.
COMMUNICATIONS FROM MAYOR EDWARDS, Motion by Alderman Sarff, second by
Alderman Kovachevich, the appointments of Kevin Meade to the Zoning
Board of Appe~.ls; and Mardelle Steck to the Betterment Commission be
confirmed. Voice vote, rnotion carried.
On January 9th a state health board meeting will be held in Chica~o for
the Graham Hospital and the Health Care Retirement Corporation of America
for a nursing care facility. Mayor Edwards is requestin~; that expenses
~ be paid for Cliff Sagaser City Engineer to attend this hearing for him.
~ Motion by Alderman Glorkman, second by Alderman Chapman, all expenses
be paid for Cliff to attend this hearing. Roll call. AYES - Aldermen

~ Mayor Edwards stated that $50,000 from the state has been approved in
Q the Enterprise Zone funds, of which $30,000 will be loaned to B&K
Specialty Casting.
B&K Specialty Casting is experiencin~; financial probelms, and a meeting,
is to be held in Springfield with DCCA,

Discussion. Alderman Zilly stated that the Planning & Zoning Commission
did submit findings of fact, and all in attendance did not vote for all
of the 8 findings. Roll call, AYES - Aldermen Kovachevich, Workman,
May, Chapman, Ma.yor Edwards. NAYS - Alderman Zilly, Sarff, Motion
carried. 5 AYES (Mayor voting) 2 NAYS 1 ABSENT 1 RESIGNED, Ordinance

ORDINANCE - AUTHORIZING AND DIRECTTNG THE T~2ANSFER OF FUNDS FROM THE
WORKING CASH FUND TO THE GENERAL CORPORATE FUND. Second reading, read

Alderman Sarff, second by Alderman Kovachevich, the ordinance be
returned to the Legal & Ordinance Committee. Discussion. Mayor Edwards
asked why? Alderma.n Sarff said he had calls on it and would rath.er
not ignore those calls he would rather send it to committee for more
discussion. Voice vote, motion carried.

ORDINANCE - PROVIDING F(~R AND REOUIRING THE SUBMISSION OF THE QUESTION
OF LEVYING AN ANNUAL TAX AT THE RATE OF ,25% OF THE VALUE, FOR THE
PURPOSE OF ACQUIRING, 01'ERATING AND MAINTAINING A CULTURAL CENTER TO
HOUSE THE CANTON MUSEUI~2. First reading, read by title. The petition
was read as follows...To the Honorable Mayor and City Council of the
City of Canton, Illinois. We, the undersigned, represent ourselves. to
be electors residing within the corporate limi~Cs of the City of Canton,
Illinois petition the Canton City Council to take such steps as may be
necessary to place the question of the levy and collection of a munici-
pal "Cultural Center" tax in conformity with Division 45.1, Illinois
Revised Statutes (1983) for, amon.g, other purposes, the establishment,
acquisition, operation, or, maintenance of the Canton Museum, by refer-
endum to the voters at the election to be held March 18, 1986.
Alderman Kovachevich said the way he reads this, is that tihe amount to
be levied? Jim Malmgren City Attorney said Alderman Kovachevich has
raised a good point, probably the language of the question should be ,
changed slightly, Section 4 of this division says any municipality
may levy a tax annually, not to exceed .25% of the value. The Sth
line of the question on the ordinance should be amended to read...
levy annual~ya tax of not to exceed .25% of the value.
Pat Wright City Treasurer said this .25% is the same for our corporate
levy .
Jim Malmgren City Attorney said from the comments I've heard hear, I
wonder if there isn't some misunderstanding of how this functions. The
city has no authority to levy a tax to give the City Museum. All were
allowed to do is levy a tax to acquire, operate, and maintain a cultural
center. So all were doing is giving ourselves some rnoney to do this,
We have no way of giving this money to the museum.
Motion by Alderman May, second by Alderman Chapman, the rate be .O1%.
Roll call. AYES - Aldermen Chapman, May, Kovachevich, rIAYS - Aldermen
Workman, Sarff, Zilly, Mayor Edwards. Motion defeated. 3 AYES 5!~1AYS

Mayor Edwards stated that if your going to quote a figure, it should be
realistic.

the rules for the purpose of passing the ordinance. Roll call. AYES -
Aldermen Kovachevich, Zilly, Sarff, ~Jorkman, NAYS - Aldermen May, Chapman.
Motion defeated. 4 AYES 2 NAYS 1 ABSENT 1 RESIGNED.
Mayor Edwards suggested the ordinance lay over to the next council meet-
ing.
EXECUTIVE SESSION - IMMINENT, THREATENED/PENDING LITIGATION, Motion
by Alderman Sarff, second by Alderman Kovachevich, to go into execu-
tive session. Roll call. AYES - Aldermen Chapman, May, Workman, Sarff,
Zilly, Kovachevich. NAYS - None. Motion carried. 6 AYES 0 NAYS
1 ABSENT 1 RESIGNED.
