' PLEDGE OF ALLEGIANCE OPEr1ED THE MEETING FOLLOWED BY THE ~ INVOCATION GIVEN BY MAYOR DONALD E. EDWARDS. Mayor Edwards asked for roll call at 6:30 p.m. Present: Aldermen Kovachevich, Zilly, Steck, Sarff, Workman, Bohler, May, Chapman. Absent: None. MINUTES OF JUNE 17. Motion by Alderman Sarff, second by ' Alderman Workman, the minutes of June 17 be accepted and placed on file. Voice vote, motion carried. ' COMMUNICATIONS FROM DAVID LEEZER - COMMUNITY DEVELOPMENT DIRECTOR AND BUDGET ADMINISTRATOR. The Loan Committee met before the council meeting with officials from IPR Inc. of , Jim Burk, Carl and Jim Sch~on~hard. Jim Burk gave an overview of the start up operation. They processed the first batch O of chips thru the system last week. The main problem their experiencing is their drying system. Its required that ~ the chips be in a bone dry condition for their biggest ~ supplier. Jim Burk stated that IPR Inc. has appreciated ' = all the help and support given to them. m David Leezer said the Loan Committee considered extending Q the loan from the HHS money, in the amount of $99,999. It had been extended to June 23rd. Problems arose that was not their fault and has caused delays in start up. The Loan Committee recommended to the City Council the delaying of the HHS payment till August 20th with interest accured and no penalty. The payment would be $7,683.29. Motion by Alderman May, second by Alderman Chapman, to extend until August 20th the DCCA loan and HHS loan with no penalty and interest accured. Discusion. Alderman Sarff asked how much the DCCA payment is? David Leezer replied two payments owned at $10,791.99. As long as the city makes their payments in a timely fashion we don't get any type of liquidated damages. The HHS monies is a$1 million loan to the City of Canton from Health & Human Services. The CDAP money was granted to the City to loan to the company. CDPA money is due quarterly on February, May, August & November. Roll call. AYES - Aldermen Chapman, May, Bohler, Workman, Sarff, Steck, Zilly, Kovachevich. NAYS - None. Motion carried. 8 AYES 0 NAYS 0 ABSENT. The Canton Township has approved Tax Abatement on the Enterprise Zone, similar to that of the City of Canton. This means that 4 taxings bodies have approved tax abatements on the Enterprise Zone. Attended a meeting on Enterprise Zones and received information on new laws. At the next Clerical meeting I will be recommending this fiscal year's budget. Had preliminary discussions with officials from the Department of Agricultural under the subsection of FmHA. Our $1 million HHS loan has been transferred from HHS to FmHA. Because of the transfer, it involves alot of paper work on the federal governments's part, so they froze our money until they had completed the transfer. After several letters, calls and discussions their making every effort to free up the remaining HHS money that basicially belongs to the City of Canton. The mayor, city engineer and David had premilinary discussions 44 CONTINUED July l, 1986 about Economic Development and Community Development in the City of Canton. One of the sites we feel is prime for that area is located on the square and owned by the city. We want to make it available to anyone who has a sound idea " for Economic Development to turn that into a commercial establishment. David said the lot is 72.5x79.5 and located on the South side of the square. Mayor Edwards feels the council should use the method in setting a price on the property as a precedent to Dr. Rushford and Dr. Matthews on establishing cost. We should seriously consider whether or not we follow the 1983 amendment and widen that street or leave it narrow and sell clear over to the corner. David's recommendation is to sell the lot in a two-tier way. Allowing the person to buy the whole lot at $2.00 square foot. If the buyer doesn't want the whole lot then sell what ever he wishes at $2.50 a square foot. Purchaser may find it more cost efficient to buy a whole lot. Cliff Sagaser City Engineer recommended the minimum sale price of 40x79.5 feet at $2.80 per square foot at a cost of $8,904. Alderman May felt that the city should sell the whole lot and not in sections. Motion by Alderman Zilly, second by Alderman Sarff, to refer the decision of how to sell the lot to the Community Development committee. Voice vote, motion carried. PUBLIC HEARING - PROPOSED USES OF FEDERAL REVENUE SHARING FUNDS AND THE PROPOSED APPROPRIATION ORDINANCE. 7:00 P.M. The regular portion of the council meeting was recessed at 7:00 p.m. for the purpose of holding a public hearing for the proposed uses of Federal Revenue Sharing Funds and the proposed appropriation ordinance. COMMENTS FROM THE AUDIENCE. No comments were made from those in the audience. COMMENTS FROM THE COUNCIL. No comments were made by the council members. Motion by Alderman Bohler second by Alderman May, to adjourn the public hearing and return to regular session. Voice vote, motion carried. COMMUNICATIONS FROM CLIFF SAGAASER - CITY ENGINEER. The contractor had not worked on the sidewalk project for the last few days. An area of sidewalk has cracked that was " poured over a wet area, so the contractor was a little reluctant to work in the mud. The MFT bid letting wil be July 2nd, two contractors have requested specifications. The consulting firm for the dam project made some hand borings and also made an inspection in the tunnel. Discussion. Mayor Edwards said the main reason were doing ' this is for safety. Roll call. AYES - Aldermen Kovachevich, ' Zilly, Steck, Sarff, Workman, Bohler, May, Chapman. NAYS - None. I would like for the = city attorney to draft a resolution to replace fireman Jim . m Smith and to recall David Burnham from a temporary recall. Q Mayor Edwards referred this to the Personnel committee. OLD BUSINESS: , ~ORDINANC~. -PROVIDING FOR AND REQUIRING THE SUBMISSION OF THE QUESTION OF THE CITY OF CANTON BECOMING A HOME RULE UNIT OF LOCAL GOVERNMENT. Second reading, read by title. Mayor Edwards said Pat Wright City Treasurer had attended a meeting on Home Rule. She reported to staff that its not much different then what we presently have, its just common sense government. Jim Malmgren City Attorney had given out previously to all officials an overview of Home Rule Powers that are excerpted from the "Report of the Illinois Municipal League Committee of Home Rule Attorneys - 1970 Illinois Constitution," edited by Thomas W. Kelty, Associate General Counsel. The council has a limited number of choices in terms of financing. Your running a fairly substantial deficit in the fi_re and police departments. If this deficit is going to be made up, you really only have 3 alternatives: 1) To do what you can do under your present non-horne rule system o= powers. That involves either cutting back in the police department or fire department, or both depar~tmerits. Or cutting back in all departments in city government so the deficits are made up. 2) Or, it involves passing in what I consider to be horrendous taxes that you presently have powers to impose without going to referendum. This is referred specifically to an 5~ utility tax, which I do not r.ecommend. 3) Or, you can put the home rule issue to the voters in hopes they will pass it which will give you the powers to try to make up the deficit by using taxes which are not property taxes, but which are more on the naiure of a luxury tax. You can target these monies into the departments that need the influx of additional income.. If you abuse the powers of home rule the people will take it away from you. They have the right by referendum to revoke the home rule power. And once home rule power is 4~ CONTINUED July l, 1986 granted and revoked then everything the city council has done in the interim is revoked also, and you have to fall , back and redo everything as a non-home rule municipality. In terms of absolute power the present ceilings that are opposed on municipalities by State Statute will be removed. Example: Without going to a referendum in our police and fire protection tax, were presently at .15. If we went to a referendum and that tax increased, it could be raised to .40 but not beyond that. If we were home rule the city council without going to referendum could raise either of those taxes or any other property taxes as high as they want. There would be no cap on it. The people who make up the governing bodies of the municipalities are very aware as a practical matter what will happen if they abuse home rule powers. Its going to be taken away, and everything they've done in the interim will become annuled. Those municipalities that are presently home rule believe that its in the municipalities best interest to remain home rule. There is no real need to raise property taxes that high. Now as a home rule muncipality you would be a~le to impose luxury taxes on items that you can't presently put a tax on. As a practical matter this proposal does not include a proposal for change in the form of government we now have. You would remain an aldermanic form of government. Its the most direct form of democracy available to us. If on the other hand we would go home rule and become city manager type government, than I would not recommend that to you. The power of day to day control is removed from elected officials and placed in a non-elected official. David Leezer said this is the best use for local governments, we are still held accountable, but its not a cure all. Motion by Alderman Chapman, second by Alderman Sarff, the resolution be adopted. ORDINANCE - PROVIDING FOR AND REQUIRING THE SUBMISSION OF • THE QUESTION OF LEVYING AN ANNUAL TAX AT THE RATE OF NOT TO EXCEED .03~ OF THE VALUE, FOR OPERATING AND MAINTAINING A CULTURAL CENTER TO HOUSE THE CANTON MUSEUM. Second reading, read by title. Motion by Alderman Sarff, second by 1~lderman Bohler, the ordinance be placed on its passage. Roll call. NEW BUSINESS: RESOLUTION - SUPPORT FOR THE VILLAGE OF LIVERPOOL'S EFFORTS TO OBTAIN FUNDING FOR THE CONSTRUCTION OF A LEVY. First reading, read by title. Mayor Edwards had asked the Village President for a letter of support on the prison, so now their asking for support around the county. NAYS - Aldermen Sarff, Steck. ' Motion carried. 6 AYES 2 NAYS 0 ABSENT. Resolution being #1168. RESOLUTION - CANTON FRIENDSHIP FESTIVAL ASSOCIATION REQUESTING A PARADE ON SEPTEMBER 6, 1986. First reading, read by title. Motion by Alderman Kovachevich, second by Alderman May, ; the resolution be adopted as amended. Discussion. The ' resolution should have added to it the Friendship Festival will be responsible for any claims instead of the city. Roll call. AYES - Aldermen Kovachevich, Zilly, Steck, Sarff, Workman, Bohler, May, Chapman. NAYS - None. Motion carried. , 8 AYES 0 NAYS 0 ABSENT. Resolution being #1169. , Motion by, Alderman Workman, second by Alderman May, to extend 4~dinance #1161 for the 30 day appointments of full-time and part-time appointive employees. Discussion. ; O Jim Malmgren City Attorney was instructed to draft a ~ resolution for the remainder of the year. Voice vote, motion ~ carried. = Jim May referred to Ordinance #1024 and #1025 that made m Elm Street and Chestnut Street a two-way street. Jim wants ; Q it carried out to make the streets two-way. Mayor Edwards said we would have to petition the commerce commission to allow us to enter the railroad from both sides. Cliff estimates the cost at $14,681 for Chestnut Street and $15,116 for Elm Street. Motion by Alderman May, second by Alderman Workman, the city attorney petition the ICC that the railroad crossings be made two-way on Elm Street as provided by Ordinance #1024 and Chestnut Street two-way as provided by Ordinance #1025. Discussion. Alderman Sarff asked what is the balance left in MFT? Cliff Sagaser City Engineer said this time next year he expects to have $275,000. Alderman Sarff asked what's the major item on Chestnut Street? Cliff answered this is one of the items, and probably should be incorporated into that program. Alderman Chapman said he's against the ordinance for 3 reasons: l. Chestnut Street is to narrow. 2. The flow of traffic is just about as good as its ever going to be. 3. Elm Street was made one-way to accomodate traffic in and out of I.H.C. and I have faith that who ever is in that building of I.H.C. will have need of that traffic in the future. Mayor Edwards asked the council to go into Executive Session for property acquisition. He said it is relevant to the vote. Motion by Alderman Kovachevich, second by Alderman Sarff, to go into executive session. Voice vote, motion carried. Council adjourned into executive session at 7:52 p.m. Minutes of the executive session are on file. Council reconvened in open session at 8:05 p.m. 48 CONTINUED: July l, 1986 Motion amended to read...to petition the ICC that the railroad crossings be made two-way on Chestnut Street. Roll call.
