Edwards Way th 50 North 4 Avenue, Canton, Il 61520 A regular meeting of the Canton City Council was held on April 15, 2025 (6:30pm) at the Historic th Depot located at 50 North 4 Avenue Canton Illinois. STAFF IN ATTENDANCE: Mayor Kent McDowell, City Clerk Andi Smith-Walters, City Treasurer Crystal Wilkinson, Police Chief Mike Eveland, and Public Utilities Director Joe Carruthers. PUBLIC PARTICIPATION: MAYORAL COMMUNICATIONS/REQUESTED ACTION: Mayor Kent McDowell reminded council there is a special meeting on Tuesday, April 29 at 6:15pm. CITY CLERK COMMUNICATIONS /REQUESTED ACTION: DEPARTMENT HEAD COMMUNICATIONS/REPORTS: Police Chief Mike Eveland announced the police department will be starting up “Operation Clean Sweep” in the next couple of weeks. Public Utilities Director Joe Carruthers reminded council that Friday is a holiday for the public st works department and garbage will be picked up on the 21. COMMITTEE REPORTS: PUBLIC SAFETY AND LEGAL ALDERPERSON JUSTIN NELSON, CHAIR ORDINANCE APPROVING A SPECIAL USE-HOME OCCUPATION PERMIT FOR JOSEPH RILEY AND TH ASHLEY MCCOY FOR A BEAUTY SHOP LOCATED AT 686 N. 7, CANTON, IL 61520. Alderman John Lovell had a meeting with zoning and planning and there were no issues with this and the recommendation from P&Z is to pass the ordinance. Motion and second were made by Alderpersons Nelson/Chamberlin to approve an ordinance approving a special use-home occupation permit for Joseph Riley and Ashley McCoy for a beauty th shop located at 686 N. 7, Canton, IL, 61520. REGULATORY AND POLICY ALDERPERSON ANGELA HALE, CHAIR APPROVAL OF A DOWNTOWN SPECIAL EVENT PERMIT FOR BOWTY’S MUSIC EMPORIUM GRAND OPENING TO BE HELD ON MAY 17. The owner asked to use the city parking lot from 2pm-7pm. There is no insurance needed, and no alcohol will be served. Motion and second were made by Alderpersons Hale/Gossett for approval of a downtown special event permit for Bowty’s Music Emporium grand opening to be held on May 17. COMMUNITY & ECONOMIC DEVELOPMENT ALDERPERSON JOHN LOVELL, CHAIR Michelle Spiva from Spoon River Partnership and Economic Development gave a couple updates to the council. She stated there are a few surveys currently out in the community. One is a housing survey, and the other is a broadband survey. They will both be open until the end of the week. Once the broadband survey is closed the next step will be to contact local providers. With housing, Spiva is partnering with the Chamber of Commerce for their community work day on Saturday, April 26 at 9am in Jones Park. They have some projects going for our community entities. Most are landscaping and painting projects. ORDINANCE APPROVING AND AUTHORIZING THE EXECUTION OF A FIRST AMENDMENT TO THE TH CANTON 1-DOWNTOWN/5 AVENUE TIF DISTRICT REDEVELOPMENT AGREEMENT BY AND BETWEEN THE CITY OF CANTON, FULTON COUNTY, ILLINOIS, AND WORLD HUNTING GROUP ENTERPRISES INC. AND TIMOTHY M. WELLS AND KERRIE WELLS. st This amendment essentially extends the date to July 1 as weather has not been cooperative. Motion and second were made by Alderpersons Lovell/Nelson for approval of an ordinance th approving and authorizing the execution of a first amendment to the Canton 1-downtown/5 Avenue TIF District redevelopment agreement by and between the City of Canton, Fulton County, Illinois, and World Hunting Group Enterprises INC., and Timothy M. Wells and Kerrie Wells. LOCUST ST.) This is an apartment complex they plan to clean up and the agreement is to reimburse 25% not to exceed $3,750. Motion and second were made by Alderpersons Lovell/Chamberlin for approval of an ordinance approving and authorizing the execution of a redevelopment agreement by and between the City of Canton, Fulton County, Illinois, and Gregory LLC., and Andrew P. Gregory (142 W. Locust St.) to reimburse 25% not to exceed $3,750. LLC., AND DUSTIN B. TABER, D.B.A. JACK’S BAR (144 E. ELM ST.) This was discussed at the last meeting. This is to reimburse 25% not to exceed $2,225. Motion and second were made by Alderpersons Lovell/Chamberlin for approval of an ordinance approving and authorizing the execution of a Canton business development district no. 1 redevelopment agreement by and between the City of Canton, Fulton County, Illinois, and C and L Tap INC., and HT Tap Real Estate LLC., and Dustin B. Taber, D.B.A. Jack’s Bar to reimburse 25% not to exceed $2,225. This amendment is changing the payouts. The payouts will instead go to B&B Canton Properties instead of Jarvis. Motion and second were made by Alderpersons Lovell/Grimm for approval of an ordinance approving and authorizing the execution of the first amendment to a redevelopment agreement by and between the City of Canton, Fulton County, Illinois, and Jarvis Welding L.L.P., and Brien Jarvis and Brad Jarvis, and B&B Canton Properties L.L.C to change the payouts to go to B&B Canton Properties instead of Jarvis. PUBLIC WORKS ALDERPERSON ANGIE LINGENFELTER, CHAIR FINANCE ALDERPERSON ANDRA CHAMBERLIN, CHAIR APPROVAL OF THE CHANGE ORDER REQUEST #3 FROM LEANDER CONSTRUCTION, INC FOR THE OPERA HOUSE PLAZA PROJECT IN THE AMOUNT OF $27,803.81. Public Utilities Director Joe Carruthers explained the change order is for the Opera House. The site had some compaction issues to it, and this is an increase for widenings and footings for the side. The work has been completed already. Motion and second were made by Alderpersons Chamberlin/Grimm for approval of the change order request #3 from Leander Construction, INC for The Opera House Plaza project in the amount of $27,803.81. Alderman Ralph Grimm recommended approval. Motion and second were made by Alderpersons Grimm/Nelson for approval of a resolution approving memorandum of understanding with Canton Fire Fighters, Local 1987, I.A.F.F., A.F.F.I.,/CIO. PROPERTY ALDERPERSON PATRICK KETCHAM, CHAIR ORDINANC AUTHORIZING LICENSE AGREEMENT WITH CANTON BANNER SOLAR 1, LLC AND LINDA HENDERSON. Attorney Jump stated this was still being negotiated as of today otherwise this would have been brought to councils attention sooner. This has been an ongoing discussion for quite some time with Joe Carruthers and city engineer Keith Plavec having been involved. There is a solar project that is pending in Banner. Jump was contacted by the solar company initially. There was some surveying that had to be done. Miss Henderson owns a parcel of land that is adjacent to the cities raw water main transmission easement located in Banner. The solar company is needing permission to cross the easement for purposes of installing and maintaining the solar facility. A conversation was had with the Mayor as they were not seeking to necessarily compensate for this. The goal is to keep the city protected as they will be crossing a water main. The city does not own the land. It was an easement that was granted to the city. The current owner is Prairie Hills Conservancy. There is still some language going back in forth. Attorney Jump is trying to figure out who they want the parties to be. He is leaning towards the city just granting the permission for the license and consent agreement to the solar company. Motion and second were made by Alderpersons Gossett/Lingenfelter for approval of an ordinance authorizing license agreement with Canton Banner Solar 1 LLC, and Linda Henderson. ORDINANCE APPROVING RE-ZONING OF PROPERTY LOCATED AT 125 EAST LOCUST FROM B-2 TO R-4. Alderman John Lovell explained this was also discussed at the planning and zoning meeting. It is located at the corner of the BD school, and they are wanting to convert it to student housing. Spoon River stated they are in need of 35 units. Motion and second were made by Alderpersons Gossett/Hale for approval of an ordinance approving re-zoning of property located at 125 East Locust From B-2 to R-4 for student housing. APPROVAL OF ADA IMPROVEMENTS TO THE WATER DEPARTMENT’S CUSTOMER SERVICE WINDOW. Carruthers explained there are two options. These are improvements to the window where you walk up and talk to the billing clerk. There is a string that pulls down which is problematic as it is not reachable and the counterspace is non-compliant. The preferred option provides a push button mechanism that lowers the motorized screen in front of the window and costs $13,595. Motion and second were made by Alderpersons Gossett/Lingenfelter for approval of ADA improvements to the water department’s customer service window, option one, in the amount of $13,595.
