A RESOLUTION APPROVING AN AGREEMENT BETWEEN THE FULTON COUNTY
AMATEUR RADIO CLUB AND THE CANTON EMERGENCY SERVICES AND DISASTER
AGENCY
WHEREAS, the Public Safety Committee of the City of Canton has determined that it is necessary
and in the best interests of the City of Canton to enter into an Agreement with the Fulton County Amateur Radio
Club whereby they will loan ESDA a dual band amateur radio to assist with communications in times of
emergency; and
WHEREAS, the City Council of the City of Canton has made a similar determination.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF
THE CITY OF CANTON, ILLINOIS, AS FOLLOWS:
1. That the Agreement is hereby approved in the form attached hereto and incorporated herein as
Exhibit A.
2. That the ESDA Coordinator is hereby authorized and directed to execute said agreement on
behalf of the City of Canton.
3. That this Resolution shall be in full force and effect immediately upon its passage by the City
Council of the City of Canton, Illinois and approval by the Mayor thereof.
PASSED by the City Council of the City of Canton, Illinois at a regular meeting this lst day of March,
2011 upon a roll call vote as follows:

AGREEMENT BETWEEN THE FULTON COUNTY AMATEUR RADIO CLUB AND
THE CANTON EMERGENCY SERVICES AND DISASTER AGENCY
This agreement is made on the day and year last written between the City of Canton, an
Illinois Municipal Corporation and the Fulton Amateur Radio Club (hereinafter "FCARC").
WHEREAS, local governments are responsible for preparing and responding to any
disaster which threatens the public health, safety and welfare of its residents; and
WHEREAS, in disaster situations, effective leadership, coordination, and unified on-
scene command is required to effectively respond to an incident and to insure that adequate
resources are applied to all disaster relief efforts; and
WHEREAS, a key component in assuring an effective response is a reliable
communications systems; and
WHEREAS, in the event of an emergency, the use of a dual band amateur radio could be
essential; and
WHEREAS, the Fulton County Amateur Radio Club has generously agreed to loan such
a radio to Canton ESDA.
NOW, THEREFORE, in'consideration of the preceding recitals of fact for the further
considerations hereinafter stated, IT IS AGREED AS FOLLOWS:
1. FCARC agrees to provide on loan to the Canton ESDA a new Kenwood
TM-V71AK dual band amateur radio, serial number BOC00077 ("the equipment"),
for Canton E.S.D.A.'s use in amateur radio communications during times of disaster,
severe weather, practice drills, radio nets, and such other times as Canton E.S.D.A.
may deem necessary.
2. The radio will remain the property of the FCARC.
3. The parties agree that the equipment is to be returned to the FCARC when
it is no longer needed or is no longer used by Canton E.S.D.A.
4. FCARC reserves the right to terminate this agreement at any time, for any
reason, with ten (10) days notification in writing to the Canton E.S.D.A. Coordinator.
5. The parties agree that Canton E.S.D.A. will be responsible for the use,
maintenance, operation, and repair (if needed) of the equipment.
6. FCARC assumes no liability for any misuse, malfunction, operator error,
or non-compliance with Federal Communications Commission rules and regulations.

7. The parties agree that the equipment will be operated in full compliance
with Federal Communications Commission rules and regulations, using generally-
accepted Amateur Radio practice, by, or under the direct supervision of, a licensed
Amateur Radio Operator holding at least a Technician-class license.
In Witness, the parties have executed this Agreement by authorized officials in Canton, Illinois
this day of , 2011, pursuant to the authority -
granted by the respective governing bodies of each party.
