A regular meeting of the Canton City Council was held on January
6th 1987 in Council Chambers. '
PLEDGE OF ALLEGIANCE OPENED THE MEE;TING FOLLOWED BY THE INVOCATION
GIVEN BY MAYOR DONALD E. EDWARDS.
Mayor Edwards asked for roll call at 6:30 p.m. Present: Aldermen
Kovachevich, Zilly, Steck, Sarff, Workman, Bohler, May, Chapman.
Absent: None.
MINUTES OF DECEMBER 2nd MEETING. Motion by Alderman Sarff, second
by Alderman Workman, the minutes of December 2nd be accepted
and placed on file. Voice vote, motion carried.
MINUTES OF DECEMBER 16 MEETING. Motion by Alderman Sarff, second '
by Alderman Workman, the minutes of December 16 be accepted and
placed on file. Voice vote, motion carried.
COMMUNICATIONS FROM DAVID LEEZER - COMMUNITY DEVELOPMENT DIRECTOR '
Q AND BUDGET ADMINISTRATOR. Finally received the first appraisal
~ from Tompkins Appraisal on the MSD property for the Canton prison.
~ Their estimate was $1,700 an acre with the total purchase price
of $170,000 for 100 acres. Harold Turley was sent the information
= for a second appraisal. He was contacted today and reported
~ that he had mailed the review appraisal and did concur with the
Q price of $1,700 an acre. We have already submitted $50,000 payment
in escrow from the Enterprise Zone monies.
Having a meeting with the DOC officials this Thursday morning.
Hoping to set up some plans on the prison.
On January 26-28 the Illinois Public Employer Labor Relations
Association and the Illinois Fire Chief's Association will sponsor
a school for fire chief's on labor relations. Basically on
collective bargaining. Cost is $295 for members of Illinois
Fire Chief's Association and will be held in Monticello. Motion
by Alderman Sarff, second by Alderman May, the fire chief be
allowed to attend the session. Roll call. AYES - Aldermen
Chapman, May, Bohler, Workman, Sarff, Steck, Zilly, Kovachevich.
NAYS - None. Motion carried. $ AYES 0 NAYS 0 ABSENT.
Received a monitoring report on the downtown sidewalk project
from DCCA. They found no problems with the program. The report
is available from Dave.
COMMUNICATIONS FROM CLIFF SAGASER - CITY ENGINEER. The lift
station for contract #2 was scheduled for today, but will not
be here for another week.
Have finished the preliminary drawings on the North Main 2-way
Street along the side of Spurgeons and West of the square. Copies
of the drawing will be available at the next committee meeting
and to receive your approval of the plans.
If there is to be a sidewalk project for 1987, I want to know
by the next two committee meetings as we should be preparing
plans to be able to proceed on time. And where the money will
be coming from.
At the next clerical committee meeting I'll be bringing a revised
estimate of fees from Daily & Associates.

Motion by Alderman Kovachevich, second by Alderman Steck, to
eliminate one parking space on West Pine Street for loading and
unloading purpose. Voice vote, motion carried. (Vic Mason business).

Public Works, Water & Sewer.
Council Action
Motion by Alderman May, second by Alderman Chapman, the approval
of a 30 day extension of a part-time employee (Keith Bitner) from
System Maintenance Dept. to the Sewer Plant at the same salary.
Roll call. AYES - Aldermen Kovachevich, Zilly, Steck, Sarff,
Workman, Bohler, May, Chapman. NAYS - Nane. Motion carried.

COMMUNICATIONS FROM MAYOR EDWARDS. Motion by Alderman Sarff,
second by Alderman Bohler, the appointment of Mike Farhrenbacher
to the Historical Preservation & Development Committee be
confirmed. Voice vote, motion carried.
Mayor Edwards said he okayed the purchase of 2 gallons of a
substance that's suppose to burn the feet of the starlings that
have become a nuisance in the downtown area. The fire chief
will furnish the fire truck so the substances can be painted
on the window sills. While investigating the problem on starlings
we noticed the condition of the J. Anthony building. One of
the big panes of glass fell out of the building a few weeks ago
and you know what that would do if it fell on someone. Jim
Malmgren has checked on ownership and the owner on record is
DAHM Inc. The corporation owners are Dr. Rod Maguire, Jack Hardy,
Ed Daily, Bud Ashley. They sold the building on a partnership
to A1 Painter, Jerry Jarnigan & Ray Rumler.
Jim Malmgren City Attorney said that notice has been given on
several different ocassions to several different firms. The
owners at record DAHM Inc. had entered into a contract with deed
arrangements with the other 3 individuals. There's been a record
search made by the abstractor that the contract purchaser allegedly
defaulted on the contract. DAHM Inc. apparently initiated and
still has pending a law suit against the purchasers to force
them to follow thru with their agreement to purchase. And of
course the city is caught in the middle. We've taken the position
we've give notice to everybody, and so far I've heard nothing.
And if something doesn't happen very quickly, you may want to
consider legal action.
Chief Derenzy said he would be willing to put up some plywood
when he's up there for the starlings.

CONTINUED January 6th, 1987
The prison meeting will be January 8th at 10:00 a.m. A majority
of a quorum will be present. I'm gcing to declare that ~ closed
meeting for Negotiations of Land Acquisition.
Wi~ll be looking at the Utility Tax Ordinance. Were goin_q to ,
have to make a commitment to MSD and DOC officials on how were
going to pay for the land.
The Utility Tax could be very effective if we make the Industrial
Park a TIF area. Because than we could recapture the Utility
Tax in the Industrial Park and the prison has to pay utility
tax. This can only be done in an Industrial area.
Other governmental bodies will be asked to make donations on
payi'ng for the land according to David Leezer Community Development
Director. '
~ Jim Malmgren City Attorney said if the construction phase of
~ this portion is accelerated, it means you have 2 or 3 years less
to get prepared. At the January 22nd meeting of the MSD Board
= it is anticipated the Board will authorize the filing of a petition
m for Annexation and Rezoning of all that property into the city.
a Their bringing in about 239 acres which would be everything from
the Western boundaries of our Enterprise Park to Lone Barn/College
Road. Of that we would be purchasing 100 acres of the N.W. '
corner. The balance or the 139 acres, we would be told for
bringing that in we would abate the city's portion of the real
property taxes. So their tax situation does not change from
what it presently is, situated in the county. That's part of
the agreement will be working with.
Mayor Edwards said the first thing will be working on is the
Prison, the Utility Tax, Police & Fire Department because of
the prison coming in, and being brought upto the 1983 level,
putting a policeman back on the street instead of using as a
dispatcher.
Have received recommendations from the Historical Preservation
& Development Committee, and their going to be asking for set
aside monies for loan funds for the downtown buildings.
OLD BUSINESS:
ORDINANCE - PROVIDING FaR A STOP SIGN AT THE INTERSECTION OF
NORTH 16TH AVENUE AND EAST ASH STREET. Second reading, read
by title. Motion by Alderman Kovachevich, second by Alderman
Workman, the ordinance be placed on its passage. Roll call.
AYES - Aldermen Chapman, May, Bohler, Workman, Sarff, Steck,
Zilly, Kovachevich. NAYS - None. Motion carried. 8 AYES 0
NAYS 0 ABSENT. Ordinance being #1127.
NEW BUSINESS:
RESOLUTION - APPROVING AN AGREEMENT FOR SALE OF LAND FOR PRIVATE
DEVELOPNI~ENT MADE BY AND BETW'EEN THE CITY AND MIDWESTERN SAVINGS
ASSOCIATION. First reading, read by title. Mayor Edwards
recommended the resolution be sent to the committee on the 13th
of January and to the 20th council meeting. Jim Malmgren City

Attorney said this will be somewhat unusual procedurally because
o:~ the rec1uirenlents ~n the Tax Increment financing law. V~e car~
~n our downtown Tax~ In.crement area sell property like this. The
agreement itself is basically standard but the sale price has
never been agreed to. It definitely should go back to committee,
you cannot take final action on this until you solicit alternative
bids, but it was necessary that this be formally presented to
the council and have the notice in the newspaper on the 9th and
16th of Janaury.
Motion by Alderman Zilly, second by Alderman Kovachevich, the
resolution be sent to the Legal & Ordinance Committee. Voice
vote, motion carried.
EXECUT'IVE SESSION - NEGOTIATIONS, GRIEVANCE AND PERSONNEL.
IMMINENT/THREATENED PENDING LITIGATION. Motion by Alderman
Workman, second by Alderman Kovachevich, to go into executive
session. Voice vote, motion carried.
Council recessed the regular session at 7:17 p.m.
