ORDINANCE NO. 4475
AN ORDINANCE APPROVING THE PURCHASE OF REAL ESTATE FROM THE
FULTON COUNTY,AS TRUSTEE (FOR THE TAXING DISTRICTS)AND
AUTHORIZING BIDDING FOR DEMOLITION OF REAL ESTATE
WHEREAS,the City of Canton, Fulton County, Illinois ("City"), is a non-home rule unit
of government;
WHEREAS, Section 11-61-3 of the Illinois Municipal Code (65 ILCS 5/11-61-3)
provides, in part:
The corporate authorities of each municipality having a population of less than 1,000,000
inhabitants shall have the express power to purchase or lease either real estate or personal
property for public purposes through contracts which provide for the consideration for such
purchase or lease to be paid through installments to be made at stated intervals during a
certain period of time,but, in no case, shall such contracts provide for the consideration to
be paid during a period of time in excess of 20 years nor shall such contracts provide for
the payment of interest at a rate of more than that permitted in"An Act to authorize public
corporations to issue bonds, other evidences of indebtedness and tax anticipation warrants
subject to interest rate limitations set forth therein", approved May 26, 1970, as amended.
The indebtedness incurred under this Section when aggregated with existing indebtedness
may not exceed the debt limits provided in Division 5 of Article 8 of this Code;
WHEREAS, Fulton County, as Trustee (For the Taxing Districts) has acquired title to
properties commonly known as: (i)442 S.2nd Avenue, Canton,IL 61520; (ii)256 W. Olive Street,
Canton, IL 61520; (iii)453 W. Elm Street, Canton, IL 61520; (iv) 352 W. Pine Street, Canton, IL
61520; (v) 226 W. Spruce Street, Canton, IL 61520; and(vi) 735 S. Pt Avenue, Canton,IL 61520
(collectively,the Properties");
WHEREAS,in order to address the dilapidated condition of the Properties,the City desires
to acquire the Properties;
WHEREAS,the Fulton County,as Trustee(For the Taxing Districts)has agreed to convey
the properties to the City for$750.00 each plus the necessary filing and/or recording fees;
WHEREAS,the corporate authorities of the City have determined that it is necessary and
in the best interest of the City to purchase the Properties;
WHEREAS, the corporate authorities of the City have further determined that it is
necessary and in the best interest of the City to demolish said Properties.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND THE CITY
COUNCIL OF THE CITY OF CANTON, FULTON COUNTY, ILLINOIS AS FOLLOWS:
1. That the City hereby fmds as fact the recitals set forth above and incorporates said recitals
herein as though fully set forth.

2. The Mayor and City Clerk, as applicable, are hereby authorized to execute and deliver any
and all purchase agreements,closing documents,or other documents necessary to purchase
(i) 442 S. 2nd Avenue, Canton, IL 61520; (ii) 256 W. Olive Street, Canton, IL 61520; (iii)
453 W. Elm Street, Canton, IL 61520; (iv) 352 W. Pine Street, Canton, IL 61520; (v) 226
W. Spruce Street, Canton, IL 61520; and (vi) 735 S. lst Avenue, Canton, IL 61520 from
the Fulton County,as Trustee(For the Taxing Districts)for up to $750.00 per property plus
necessary filing and/or recording fees;
3. The Mayor, or his designee, are hereby authorized to seek quotes and/or bids for the
demolition of the Properties;
4. This Resolution shall be in full force and effective immediately upon its passage by the
City Council of the City of Canton and approval by the Mayor thereof.
