A regular meeting of the Canton City Council was held on
November lst, 1988 in Council Chambers.
PLEDGE OF ALLEGIANCE OPENED THE MEETING FOLLOWED BY THE
INVOCATION GIVEN BY CITY CLERK NANCY WHITES.
Mayor Edwards asked for roll call at 6:30 p.m. Present
- Aldermen Kovachevich, Zilly, Steck, Sarff, Meade, Bohler,
May, Chapman. Absent - None.
MINUTES OF OCTOBER 18, 1988 MEETING. Motion by Alderman
Zilly, second by Alderman Sarff, the minutes of October
18, 1988 be accepted and placed on file. Voice vote, motion
carried.
COMMUNICATIONS FROM DAVID LEEZER - COMMUNITY DEVELOPMENT
DIRECTOR AND BUDGET ADMINISTRATOR. The office received
formal notice from the State of Illinois Department of
Commerce & Community Affairs that our request of expansion
of the Enterprise Zone has been approved. The expansion
encompasses the block south of the Aldi's project and where
Mr. & Mrs. D. J. Wilcoxen proposes to construct their
business on East Elm and South 5th Avenue.
Will be out of the office most of the day on November 3rd
to attend a meeting at Western Illinois University in Macomb
sponsored by DCCA on Economic Development.
A memorandum was circulated to all aldermen and staff
concerning IPRI debts. I'll answer any questions that
may arise.
COMMUNICATIONS FROM CLIFF SAGASER - CITY ENGINEER. Maxine
Goyen 1195 N. Main who owns a tract of ground at this address
and proposes to subdivide the land into 3 lots. A few
years ago the city constructed at her request a permanent
barricade at the north entrance to Lawrence Drive. She
had requested this as cars were being driven thru her private
property and coming out on N. Main, and she wanted to
eliminate that problem. Now that she is going to subdivide
she would like to have that barricade removed. Lawrence
Drive will remain part of her private driveway.
Motion by Alderman Sarff, second by Alderman Kovachevich,
the city remove the barricade located as requested by Maxine
Goyen. Voice vote, motion carried.
Mayor Edwards asked for bids from the audience on tree
removal. No one responded to the request.
The city crews will be finished with the slude work at
the sewer plant sometime tomorrow. This project was
originally done by Slack's Excavating.
Ray Benderick spokesman for residents of the subdivision
North of town located on Marlee Drive, the residents about
20 are wanting city water and were requesting how to proceed
with this request?

Cliff Sagaser City Engineer told Mr. Bendrick that the
city's Mechanical Committee decided not to participate
in the expense of this water line and the residents would
have to hire an engineer to draw up the plan, and to have
approval from the EPA and be responsible for applying for
the permit. And upon completion of the water line it would
be given to the city if they accept it and the city would
then maintain it.
Mayor Edwards told the property owners they would have
to annex or sign a pre-annexation agreement to be able
to receive city water.
Jim Malmgren City Attorney said the homeowners need to
apply for the permit from the EPA first, once you have
that permit you know you're allowed to build the line and
hook on to the city's main. Once you have that, then you
O can petition to come into the city.
~ Cliff was given permission by the mayor to call the EPA
for the residents on Marlee Drive.
= Ray Bendrick said that of the twenty residents, twelve
m do want the city water.

A gentleman from Marlee Drive reported that about seven
residents do not want city water. He stated that if a
poll was taken the majority of the people living on Marlee
Drive don't want city water nor a water line.
Cliff read a letter from Jerry Leander of 20th Avenue and
Route 9. Mr. Leander said he had discussed with Cliff
his intentions of running a water main from the termination
of the city's proposed water main on E. Walnut and 20th
Avenue to the South side of State Route 9. I want to propose
the following: 1) The property owners to pay construction
cost to run a 3 inch water main from the corner of Walnut
Street and 20th Avenue to the South side of State Route
9. This is including boring under Walnut Street, the Santa
Fe Railroad, County Highway 6 and State Route 9. 2) The
water main will be given to the City of Canton at no cost
after installation of city ownership. 3) The City of
Canton will assume responsibility for arranging lease of
any right-of-way with the Santa Fe Railroad. They can
also make arrangements with the County and IDOT for
installation on their property. 4) The City of Canton
by accepting ownership will be responsible for maintenance
and repair. 5) Property owners would share in constuction
cost with immediate and future tappage fees tabled to the
City of Canton. Water would be needed at each residence,
not at connections. Public water consumption rates standard
with the City of Canton. 6) Property owners would sign
a pre-annexation agreements with the City of Canton. Every
effort would be made to cooperate with the City of Canton
to make this project feasible for everyone. I would
appreciate your prompt consideration and attention.
Mayor Edwards said he did not see any advantage of the
city owning that water line.
Motion by Alderman Sarff, the letter from Jerry Leander
be referred to the Public Works, Water & Sewer committee.
Mayor Edwards said it will be three weeks before they
meet. Alderman Sarff withdrew his motion.

Motion by Alderman Bohler, second by Alderman Sarff the
letter of Jerry Leander be referred to the Legal & Ordinance
Committee. Voice vote, motion carried.
Rivercity Painting & Sandblasting received the bid to paint
two water towers owned by the city this past summer. During
this time calls were received by city officials that various
cars and equipment were damaged by paint from Rivercity
Painting & Sandblasting while they were painting the city
water towers.
Steve Dawson of Rivercity Painting & Sanblasting asked
council for the return of their bid bond of $3,060 and
approximately the same amount of monies still owed for
the performance of work, as the work they performed was
satisfactorily. We supplied insurance to the city when
the job was bid. If any claims are out there they are suppose
to go to the insurance company.
Mayor Edwards said he had letters from Jerry Grose, Wayne
Ahearn and White-Easley for Robert Fouts.
Steve Dawson said that White-Easley claims the air
conditioner of Robert Fouts was damaged by sand.
White-Easley pulled out the unit and replaced it with a
new one. How do we know it was damaged by sand. Your
holding our money for these claims. We did the job, turn
the claims over to our insurance company which is Intergated
Risk of Peoria, Illinois.
Jim Malmgren City Attorney recommended the bid bond and
retainage be released to Rivercity Painting & Sandblasting
less cash amount equal to the estimated aggregate of all
outstanding claims.
Jim Malmgren said as a alternative if you would consider
supplying a continuing performance bond as to these 2 claims
only, I would be willing to recommend the entire amount
be released to you. The two claims are Jerry Grose's
car and the air conditioner of Robert Fouts.
Motion by Alderman Steck, second by Alderman Chapman, we
release the bid bond less the $277. Discussion. Mayor
Edwards said the quality of work was excellant.
Motion amended to read, the bid bond and retainage be
released and the amount of $1,000 be withheld from this
amount. Roll call. AYES - Aldermen Chapman, May, Bohler,
Meade, Sarff, Steck, Zilly, Kovachevich. NAYS - None. 8

Motion by Alderman Steck, second by Alderman Sarff, that
a petition signed by residents of N. Main and Argonne Drive ,
concerning a high hedge obscuring traffic be placed on
file. Voice vote, motion carried. Petition being #535.
Streets & Garbage.
Council Action
Motion by Alderman Meade, second by Alderman Sarff, the
Janitorial Bids be referred to the Negotiations & Personnel
Committee and bring back recommendations at the next council
meeting. Voice vote, motion carried.
Lake, Building & Grounds.

~ Motion by Alderman Chapman, second by Alderman May, the
~ expenditure of $200 for the repair of 2 furnaces and a
= water heater for Fire Station #2 be approved. Roll call.

Council Action

COMMUNICATIONS FROM MAYOR EDWARDS. A memo was sent by
my office to bring your attention to the financial condition
of all departments. This is more of a warning as to what
were spending.
The Chamber of Commerce sent a letter that they will not
be able to participate in the service of supplying auxliary
policemen for the downtown area during the holidays. Mayor
Edwards said we are seeing a good jump in our sales and
I would like to continue the spirit and support having
auxiliary police in the downtown during the
holidays. We received from the Chamber of Commerce for
their Z share last year of $820.
Motion by Alderman Zilly, second by Alderman May, to continue
to provide the same auxiliary security as last year during
the holiday shopping season. Discussion. A letter was
read from the Chamber of Commerce as to why they can't
participate, the letter is as follows: Because of other
projects being offered to the community for the holiday
season funding is not available for security. Roll call.

Motion carried.
Motion by Alderman Kovachevich, second by Alderman Zilly,
the Clerical Committee scheduled for November 8th be
rescheduled for November 9th do to the election on November
8th. Voice vote, motion carried.

On Veterans Day November llth the dedication of the Veterans
Memorial will be held at 2:00 p.m.on the corner of E. Spruce
and lst Avenue.
Ray McKinney told the mayor that the lake is 85 inches
low.
A small sale by an auctioneer and the city' s public auction
will be held on November llth as Mayor Edwards gave the
auctioneer permission to make it a larger sale and bring
people downtown.
OLD BUSINESS:
None.
NEW BUSINESS:
BIDS - TREE SERVICE FOR FOUR TREES IN THE CITY OF CANTON.
Motion by Alderman Bohler, second by Alderman Zilly, to
open the bids. Voice vote, motion carried.
Bidders are: R.L.T. Tree Service in the amount of $1,090.
Bull's Tree Service in the amount of $910.
Motion by Alderman Sarff, second by Alderman Chapman, the
bid be forwarded to the engineering department and the
Clerical Committee for consideration. Voice vote,motion
carried.
ORDINANCE - AUTHORIZING, DIRECTING AND SETTING THE DATE
FOR THE SALE AT PUBLIC AUCTION OF CERTAIN PERSONAL PROPERTY
OWNED BY THE CITY AND NO LONGER NEEDED. First reading,
read by title. Motion by Alderman Chapman, second by
Alderman Sarff, the suspension of the rules for passage
of the ordinance. Roll call. AYES - Aldermen Kovachevich,
Zilly, Steck, Sarff, Meade, Bohler, May, Chapman. NAYS
- None. 8 AYES 0 NAYS 0 ABSENT. Motion carried.
Motion by Alderman Zilly, second by Alderman Sarff, the
ordinance be placed on its passage. Discussion. Mayor
Edwards said McMillen and Wife and Don Wolf will be the
auctioneer's. Roll call. AYES - Aldermen Chapman, May,
Bohler, Meade, Sarff, Steck, Zilly, Kovachevich. NAYS
- None. 8 AYES O NAYS O ABSENT. Motion carried. Ordinance
being #1219.
ORDINANCE - AMENDING TITLE 8, CHAPTER 10 TO PROVIDE FOR
METERS AND TAPS-WATER SERVICE ONLY. First reading, read
by title. Motion by Alderman Bohler, second by Alderman
Meade, the ordinance be sent to the Legal & Ordinance
Committee and then referred to the next council meeting.
- Voice vote, motion carried.
EXECUTIVE SESSION - IMMINENT, THREATENED/PENDING LITIGATION.
Motion by Alderman Meade, second by Alderman Sarff, to
go into executive session. Voice vote, motion carried.
