HomeMy WebLinkAboutResolution #5512 - MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF CANTONN AND CANTON FIREFIGHTERS, LOCAL NO. 1897, I.A.F.F., A.F.F.I., AFL/CIO RESOLUTION NO. 5512 A RESOLUTION APPROVING A MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF CANTON AND CANTON FIRE FIGHTERS, LOCAL NO. 1897, I.A.F.F., A.F.F.I.,AFL/CIO WHEREAS,the City of Canton(the"City")and the Canton Fire Fighters,Local No. 1897, I.A.F.F., A.F.F.I., AFL/CIO (the "Union") are parties to a certain Collective Bargaining Agreement, dated May 1, 2024 through April 3.0, 2028 ("CBA"); WHEREAS, the City and the Union have negotiated a Memorandum of Understanding ("MOU"),which is attached hereto as Exhibit A; WHEREAS, the City Council of the City of Canton, Illinois has determined that it is necessary and in the best interests of the City to approve said MOU. NOW THEREFORE,BE IT RESOLVED by the City Council of the.City of Canton, Fulton County,Illinois. as follows: 1. That the Recitals set forth above, and all facts and statements contained therein, are found to be true and correct and are hereby incorporated and adopted as part of this Resolution; 2. That the MOU between the City of Canton and the Union, substantially in the form as attached hereto as Exhibit A, is hereby approved, and said Agreement is to be subject to and effective pursuant to the terms and conditions set forth therein; 3. The Mayor is authorized to revise the MOU prior to execution in the event further negotiations occur; 4. That the Mayor is hereby authorized to execute and deliver said MOU. 5. This Resolution shall be in full force and effect immediately upon the passage and approval of this Resolution and upon execution of the MOU by the Union. PASSED THIS 15th day of April, 2025. Smith-Walters, City Clerk MEMORANDUM OF UNDERSTANDING ("MOU") BETWEEN The City of Canton ("City") and Canton Fire Fighters, Local No. 1897, I.A.F.F., A.F.F.I., AFL/CIO ("Union") 1. The City and the Union are parties to a Collective Bargaining Agreement, dated May 1, 2024 through April 30, 2028 ("CBA"). This MOU will become effective as of the date the MOU is signed by both the City and the Union and approved by the City's corporate authorities ("Effective Date") and will be effective until April 30, 2028, with all other provisions of the CBA remaining in full force and effect except as set forth in this MOU. 2. The City,Mark Gilstrap(the"Grievant"),and the Union have reached an agreement through this MOU to clarify the language of Section 3.2 of the CBA and to resolve Grievance Nos. 25-01 and 25-02, filed on or about February 3, 2025 by the Grievant (collectively the "Grievances"). 3. Upon the execution of this Agreement, Section 3.2 of the CBA is hereby amended to state as follows: 3.2 Kelly Days Each Employee will be given five (5) Kelly Days per Fiscal Year. Four of these Kelly Days shall be scheduled one (1) per Employee per Quarter (May, June, July /August, September, October / November, December, January / February, March, April). One Kelly Day shall be considered floating and may be used by the employee at any point during the Fiscal Year. An Employee may not use or schedule more than one (1) Kelly Day, with the exception of the floating Kelly Day (f any remaining), per Quarter. Upon separation of employment with the City for any reason, any unused Kelly Days for that Fiscal Year shall be forfeited and the Employee will not be compensated for any unused Kelly Days. 4. Notwithstanding the foregoing, the City and the Union have agreed that the Grievant may use and schedule all of his Kelly Days for Fiscal Year May 1, 2025 through April 30, 2026 in the first Quarter of said Fiscal Year. This use of Kelly Days shall not be deemed precedential and may not be relied upon for purposes of past practice, rather it is a resolution reached in consideration of the Grievances being withdrawn and the amended language of Section 3.2 above. 5. Upon execution of this MOU, Grievance Nos. 25-01 and 25-02, filed on or about February 3, 2025 by Mark Gilstrap (collectively the "Grievances"), shall be deemed WITHDRAWN. Page 1 of 2 6. The parties agree that the resolution of the Grievances in the manner described in this MOU will not be used as precedent or as a claimed"past practice"with respect to any future grievances or claims.
